The term "ancient trees" as mentioned in these Measures refers to trees that are more than 100 years old.
The term "famous trees" as mentioned in these Measures refers to trees that are precious, rare or have important historical, cultural and scientific research value and commemorative significance. Article 3 Ancient and famous trees shall be subject to territorial management and graded protection, and the principle of combining government leadership with social participation and combining regular maintenance with daily maintenance shall be adhered to. Article 4 People's governments at or above the county level shall strengthen the protection and management of ancient and famous trees, organize, coordinate, publicize and popularize protection knowledge, enhance public awareness of protection, and encourage and support scientific research and popularization and application of ancient and famous trees protection.
The funds needed for the protection of ancient and famous trees are included in the government budget. Article 5 The competent forestry and urban greening departments of the people's governments at or above the county level (hereinafter referred to as the competent departments of ancient and famous trees) shall be responsible for the protection and management of ancient and famous trees within their respective administrative areas in accordance with the functions and powers prescribed by the people's governments at the corresponding levels.
The departments of finance, land resources, environmental protection and cultural relics management of the people's governments at or above the county level shall, in accordance with their respective duties, do a good job in the protection and management of ancient and famous trees. Article 6 The departments in charge of ancient and famous trees of the people's governments at or above the county level shall regularly conduct a general survey of ancient and famous trees resources within their respective administrative areas, verify and identify them, register them, uniformly number them, and establish graphic files and electronic information databases of ancient and famous trees.
Units and individuals shall report the information of ancient and famous trees to the competent department of ancient and famous trees, and the competent department of ancient and famous trees shall timely verify the registration. Article 8 Anyone who disagrees with the identification of ancient and famous trees shall apply to the competent department of ancient and famous trees of the Municipal People's Government with districts for review. The competent department of ancient and famous trees of the Municipal People's Government with districts shall organize experts to re-identify. Article 9 After the identification and publication of ancient and famous trees, the scope of protection shall be delineated. (a) famous trees and first-class protected ancient trees, the scope of protection is not less than 3 meters outside the vertical projection of the crown;

The protection scope of ancient and famous trees in urban planning areas and other special areas can be delineated separately according to the actual situation. Article 10 The competent department of ancient and famous trees of the people's government at the county level shall set up protection signs and necessary protection facilities.
No unit or individual may move or damage the protection signs and protection facilities of ancient and famous trees without authorization. Eleventh county people's government departments in charge of ancient and famous trees in accordance with the following provisions, to determine the conservation units or individuals of ancient and famous trees (hereinafter referred to as conservation):
(a) in the organs, organizations, enterprises and institutions within the scope of land, the unit for the maintenance of people;

(four) in the cultural relics protection units, places for religious activities and other land within the scope of ancient and famous trees, the unit for the maintenance of people;
(five) the ancient and famous trees within the scope of public land such as public green space, parks and urban roads managed by the landscaping management department, and the urban landscaping management unit is the maintainer;
(six) the ancient and famous trees in other areas shall be determined by the competent department of ancient and famous trees of the people's government at the county level in accordance with the ownership relationship and management responsibilities to coordinate the local villagers' committees and residents' committees to determine the maintainers. Twelfth to encourage social forces to donate money to protect and adopt ancient and famous trees. According to the level of protection, donation amount, geographical location, etc. It can be agreed that the donor and the adopter will sign their names and titles within a certain period of time and carry out corresponding publicity. Thirteenth people's governments at or above the county level shall establish an incentive mechanism for the protection of ancient and famous trees.
The competent department of ancient and famous trees of the people's government at the county level shall, according to the actual situation of protection level, growth environment and maintenance status, sign a maintenance agreement with the maintainer, clarify the maintenance responsibility, maintenance requirements, reward and punishment measures and other matters, and give appropriate subsidies to the maintainer.
