To apply for a new farm house, one of the following conditions must be met: being a member of a village (community) collective economic organization; Villagers (residents) who are not members of collective economic organizations; Do not belong to the above two situations, but have obtained the right to use the homestead according to law, including obtaining the approval document of the homestead land or obtaining the collective land use certificate/immovable property certificate.
Reasonably refine the identification standard of "one household, one house"
According to the spirit of relevant national and provincial documents, the new regulations refine the identification standard of "one household, one house". The term "one household, one house" as mentioned in the Measures means that one household can only own homestead and above-ground farmhouses that meet the requirements. These include:
(1) "One household" is based on the household registration of the public security organ, and can be identified as a household after reaching the age of 18. However, after marriage, both husband and wife are recognized as one household.
(2) "One household and one house" refers to the upper limit of the rights and interests that each household can enjoy for the protection of rural houses, that is, the total land area of the homestead used for the construction of rural houses by each household shall not exceed 150 square meters; The total construction area shall not exceed 4 times of the land area.
(III) Each household and its members can be divided into households according to the new regulations of "one household", and if the total land area and total construction area of the homestead used for building rural houses under its name do not exceed the sum of the rights and interests of rural houses that can be enjoyed after household separation, it can also be recognized as "one household and one house".
The land area of homestead shall not exceed 150 square meters.
Reconstruction, reconstruction or new rural housing shall meet the following construction standards:
(a) the total land area of the homestead used for the construction of rural houses shall not exceed 150 square meters, the total construction area shall not exceed 4 times of the land area, and the orthographic projection of rural houses shall not exceed the red line of the homestead land.
(2) In principle, the number of building floors shall not exceed 4, and the total height of the building shall not exceed 16m. If the first floor and above are used for courtyards, green spaces, parking facilities, etc. , and meet the requirements of the total construction area, allowing the number of floors to relax to no more than 6, the height of no more than 23 meters.
(3) It is allowed to build a top-floor ladder house with a building area of no more than 30 square meters and a building height of no more than 3 meters (except for areas where elevator equipment needs to be installed). If the design scheme is recommended in the General Atlas of Rural Housing Design, the building area and building height of the ladder house are not included in the total building area and total building height; If it is not used, the building area and height of the stairwell shall be included in the total building area and height.
(four) in principle, the building form should adopt sloping roof or semi-sloping roof, and the height is not included in the total height of the building.
(five) fire exits and building spacing should be reserved as required.
(6) Farmhouses facing the street should give way to the red line of the road. If it cannot be satisfied due to objective reasons, its building structure and construction scope shall not exceed the red line of adjacent roads (including green belts).
Pay attention to the improvement of rural residential style, and avoid "a thousand villages"
The "Measures" propose that towns and streets should organize the compilation of general atlas of rural residential design with Lingnan characteristics and regional characteristics based on the rural landscape guidelines compiled by the Municipal Bureau of Natural Resources, combined with the surrounding environment, natural texture, traditional culture and architectural landscape elements. , for free use by building families. The design of rural houses should pay attention to regional characteristics and harmony, give clear guidance on the material, color and style of the facade of rural houses, and adopt architectural forms such as courtyards, arcades and apartments according to local conditions to avoid "a thousand villages on one side". Encourage villages (communities) to guide villagers to adopt the design scheme recommended by the general design atlas to rebuild, rebuild or build new farmhouses, do a good job in style control, and form a unified style.
Encourage the combination of self-construction and unified construction, and towns, streets and villages (communities) will actively guide and promote the unified planning and construction of rural houses to create high-quality contiguous rural housing communities.
Encourage towns and streets to demarcate the forbidden, restricted and buildable areas of rural houses within their jurisdiction according to the needs of development.
Clear supervision, management and responsibility.
The "Measures" require that all towns and streets should incorporate the illegal construction of rural houses into the joint law enforcement meeting mechanism of illegal land use and illegal construction in towns and streets, establish a multi-department joint inspection and stop and rapid disposal mechanism, and prohibit water supply and power supply during illegal construction. Report the illegal construction of rural houses as a "smart network project" and establish a reward mechanism for reporting illegal construction of rural houses. All relevant units in cities, towns and streets should incorporate the law-abiding situation of rural housing construction into the management of social credit system, incorporate illegal acts into the record of dishonesty, and punish the subject of dishonesty according to law.
