Recently, the Nanchang Municipal People's Government issued the Notice on Further Improving the Work of Expropriation and Compensation for Houses on State-owned Land in Urban Areas of our City (hereinafter referred to as the Notice), and formulated new regulations on expropriation and demolition compensation. The new regulations will be implemented from June this year 10 to 10/0/0. Housing expropriation projects that have been implemented before the implementation of this notice shall still be implemented according to the original provisions.

A compensation plan should be drafted and reported.

The notice made it clear that the people's governments of all districts in Nanchang City are the main bodies of house expropriation on state-owned land, and should be responsible for the house expropriation and compensation in this region in strict accordance with relevant laws, regulations and provisions, and assume full responsibility. Entrusted by the local people's government, the administrative committees of development zones and new districts are responsible for the expropriation and compensation of houses on state-owned land. The housing levy department determined by the district people's governments is responsible for organizing the implementation of the housing levy and compensation work in this area; Responsible for supervising the entrusted housing expropriation implementation unit to organize the implementation of housing expropriation and compensation, and bear legal responsibility for the consequences of its actions.

At the same time, the expropriation compensation scheme shall be drawn up by the housing expropriation departments of each district, and submitted to the government of the jurisdiction, which shall organize the demonstration and publication of the expropriation compensation scheme, solicit public opinions, and make amendments and timely publication according to the solicited opinions.

The nature of the house to be expropriated shall be subject to the house ownership certificate and the house registration book.

The "Notice" stipulates that the nature, use and construction area of the houses that have been registered according to law within the scope of house expropriation shall be subject to the records of the house ownership certificate and the house registration book; If the house ownership certificate is inconsistent with the house registration book, unless there is evidence to prove that the house registration book is indeed wrong, the house registration book shall prevail; If the nature of the use of houses and non-residential houses that have not been registered with the ownership is unclear, the expropriated person shall provide the relevant building procedures to the implementation unit of house expropriation, and the District People's Government shall formulate the operating rules for appraisal according to the relevant laws and regulations of the state, province and city, and organize relevant units to form an appraisal working group for investigation and appraisal. The appraisal working group put forward specific treatment opinions and reported them to the local government for approval.

The expropriated person can choose monetary compensation or house property right exchange.

The "Notice" stipulates that after the scope of house expropriation is determined, it is not allowed to build, expand, rebuild houses and their attachments and change the use of houses and land within the scope of house expropriation, and no compensation will be given in violation of the provisions. The house expropriation department shall notify the relevant departments in writing of the matters listed in the preceding paragraph to suspend the relevant procedures, and the written notice to suspend the relevant procedures shall specify the suspension period. The suspension period shall not exceed 1 year from the date of collection announcement.

The notice also made it clear that the expropriated person can choose monetary compensation or house property rights exchange. If the expropriated person chooses monetary compensation, the expropriated person shall be given a temporary resettlement compensation subsidy of 6 months; If the expropriated person chooses to exchange property rights, in principle, the nearest local resettlement shall be implemented. If the nearest local resettlement is not possible, the resettlement in different places shall be implemented.

If the expropriated person signs a contract in advance and moves, he will be rewarded.

In order to encourage the expropriated person to sign a contract for relocation in advance, if the expropriated person signs an expropriation compensation agreement in advance and completes the relocation, the notice stipulates that the corresponding reward can be given according to the number of days in advance: every household will be rewarded with 200 yuan, and the maximum reward will not exceed 1 .2 million yuan per household; Expropriation of non-residential houses, every day in advance, the construction area of each household 100 square meters, the operating non-residential households will be rewarded with 20 yuan per square meter, and other non-residential households will be rewarded with 10 yuan per square meter; Every household with a building area of 100 square meter (excluding 100 square meter) will be rewarded with 2000 yuan for operating non-residential households and 1000 yuan for other non-residential households. The maximum reward for operating non-residential houses is not more than 60,000 yuan, and the maximum reward for non-operating non-residential houses is not more than 30,000 yuan.

If the expropriated person meets the housing security conditions, he may apply for housing security as required.

In order to promote the work of house expropriation and solve the difficulties and inconveniences caused by house expropriation, the Notice clearly stipulates that those who meet the housing security conditions can apply for housing security as required. After the expropriated residents move out of their original residence, they can choose to continue to enroll in the nearest place where the original household registration and home address are located, or they can enroll in the nearest place where the resettlement house is located, or the education department can arrange a degree near the expropriated rental house.

For families with difficulties who meet the minimum living standard for urban residents, the minimum living guarantee shall be approved by the civil affairs department where the resettlement house is located with the supporting materials issued by the civil affairs department where the resettlement house is located; Residents who moved in due to expropriation and the original residents where the resettlement house is located enjoy the same treatment in employment, training, medical care, social security and other public services, and can participate in the cooperative medical insurance for urban and rural residents where the resettlement house is located according to the principle of territorial management.
