The Hanjiang River Basin as mentioned in these Regulations refers to the waters and land within the catchment area of the main stream of the Hanjiang River and its tributaries within the administrative region of this province, including Shiyan City, Shennongjia Forest Region, Xiangyang City, Jingmen City, Suizhou City, Xiaogan City, Qianjiang City, Tianmen City, Xiantao City and Wuhan City. Article 3 The protection of water environment in Hanjiang River Basin adheres to the principles of giving priority to protection, combining prevention with control, comprehensive management, collaborative linkage, public participation and liability for damage. Article 4 The people's governments at or above the county level in the province and the Hanjiang River Basin shall incorporate the water environmental protection work in the Hanjiang River Basin into the national economic and social development plan, formulate the water environmental protection objectives and annual plans, and incorporate the government's funds for water environmental protection in the Hanjiang River Basin into the fiscal budget at the same level. Establish and improve the water environmental protection mechanism in the Hanjiang River Basin, and support the scientific and technological research on water environmental protection and the popularization and application of advanced and applicable technologies.
Township people's governments and sub-district offices shall, within the scope of their duties, carry out water environmental protection work in the Hanjiang River Basin, conduct daily inspections, report problems in a timely manner and coordinate and supervise the handling.
Village (neighborhood) committees shall assist in the water environment protection in Hanjiang River Basin. Article 5 The competent departments of ecological environment of the people's governments at or above the county level in the province and the Hanjiang River Basin shall exercise unified supervision and management over the water environment protection work in the Hanjiang River Basin within their respective administrative areas.
The competent departments of development and reform, economy and informatization, public security, finance, natural resources, housing and urban and rural construction, transportation, water administration, agriculture and rural areas, culture and tourism, health and market supervision and management are responsible for the supervision and management of water environmental protection in the Hanjiang River Basin within their respective functions and duties. Article 6 The provincial people's government is fully responsible for the water environment quality of the Hanjiang River Basin, and the people's governments at all levels in the Hanjiang River Basin are responsible for the water environment quality of the Hanjiang River Basin within their respective administrative areas.
The target responsibility system and assessment system are implemented for water environmental protection in Hanjiang River Basin, and the water environmental quality, construction and protection of drinking water sources, water quality of water functional areas, water quality of surface water assessment sections, total control of key water pollutants and ecological flow are included in the target assessment. The daily work of the joint meeting shall be undertaken by the competent department of ecological environment of the provincial people's government.
The competent department of ecological environment of the provincial people's government shall, jointly with the water administrative department and the people's government at or above the county level in the Hanjiang River Basin, establish a coordination mechanism for joint prevention and control of water environmental protection, and implement unified planning, unified standards, unified monitoring and unified prevention and control. Article 9 The provincial people's governments and their ecological environment and water administrative departments shall strengthen the coordination and cooperation of inter-provincial water environment protection in the Hanjiang River Basin, establish and improve the linkage working mechanism with the relevant provincial people's governments in the Hanjiang River Basin and their relevant departments and river basin management institutions, strengthen the sharing of water environment information, carry out water environment monitoring, law enforcement and emergency linkage, and jointly respond to and handle inter-provincial sudden water environment incidents and water pollution disputes. Article 10 All units and individuals shall abide by laws and regulations on water environmental protection, raise awareness of environmental protection, and develop a green, low-carbon and environmentally-friendly production and lifestyle. Chapter II Planning and Standards Article 11 The provincial people's government shall organize the departments in charge of development and reform, water administration, natural resources and ecological environment, and in conjunction with the relevant river basin management agencies, formulate and revise the water resources planning of the Hanjiang River basin in this province according to the national comprehensive water resources planning and relevant regulations, rationally allocate and uniformly dispatch the water resources of the Hanjiang River basin, strengthen the control and management of the total water intake and water consumption intensity, and ensure the water for life, production, management and ecological environment.
The provincial people's government shall determine the total control index of water resources utilization in the Hanjiang River Basin and the total amount of water intake in various places according to law. If the total water intake reaches or exceeds the total water intake control index, the approval of new water intake for construction projects will be stopped; The total amount of water intake is close to the total amount of water intake control index, and the approval of new water intake for construction projects is restricted. Article 12 The competent department of ecological environment of the provincial people's government shall delimit the water functional zones of the main stream and main tributaries of the Han River, and implement them after the approval of the provincial people's government. The municipal people's government divided into districts in the Hanjiang River Basin demarcates the functional areas of other tributaries of the Hanjiang River within its administrative area, which shall be implemented after being approved by the provincial people's government.
The water functional zones in Hanjiang River Basin shall be assessed regularly, adjusted according to the needs of water environmental protection and relevant national requirements, and implemented after being approved by the provincial people's government.
Delineation and adjustment of water functional areas should be scientifically demonstrated and publicly solicited opinions.
