Since the early 1950s, Professor Ning Zhiyuan has been devoted to the teaching and research of legal documents, including Judicial Documentary (edited by China University of Political Science and Law Press, 1989, won the Excellent Textbook Award of the Ministry of Justice, and 1 won the Excellent Textbook Award of the State Education Commission) and The Language Use of Judicial Documents and Legal Documents in China (co-authored by both of them). Professor Ning Zhiyuan, as one of the main academic leaders in the discipline of legal literature, has made unremitting efforts for the establishment and development of this discipline. Based on this, from 65438 to 0994, the Ministry of Personnel approved Professor Ning as an expert with outstanding contributions to enjoy the special government allowance granted by the State Council.
Professor Ning Zhiyuan is not only one of the main founders of legal philology in China, but also devoted all his energy to this subject. According to Professor Ning, after retiring from the teaching post of China University of Political Science and Law in the early 1990s, he still did not stop the research and practical teaching of legal documents. In the summer of 2004, he also recorded the teaching contents and teaching guidance materials of the legal documents course of China Central Radio and TV University, and since 2005, he has presided over the revision of several sets of legal documents teaching materials. Professor Ning took the initiative to step aside, and it was also a beautiful talk at China University of Political Science and Law and the Legal Literature Research Association. According to his colleagues in the seminar, in 2004, 78-year-old Professor Ning and a group of old scholars who "repaired the world" in the field of legal documents offered to let young people take the lead and happily handed over the work of the seminar to a group of young scholars. This is a kind of trust in young scholars, a kind of support for practical actions in legal literature research, and a kind of silent care.
Professor Ning Zhiyuan tried to host professional theoretical journals during his legal literature research. In the early 1980s, he borrowed the periodical number won by foreign legal practice departments to write judicial documents, which were distributed by local practice departments. However, the journal dropped several times, and it stopped publishing after four years, and then stopped publishing for four years after three years. Professional periodicals are the position of theoretical research and the platform of professional communication. With a position and platform, we can give full play to the influence and role of the theory. According to Professor Ning's recollection, in the early years, criminal trial middle schools generally did not write the contents of the prosecution and the defense points of the reply. At that time, Professor Ning Zhiyuan and others organized a discussion on this in the magazine. After the appeal, the substantive department later wrote the contents of both the prosecution and the defense into criminal judgment. Talking about this matter, Professor Ning believes that the role of legal document research is also reflected in the promotion and promotion of practical work bit by bit.
1964 a leader of the Supreme People's Court, the superior department in charge of Beijing University of Political Science and Law, wrote to the college, saying that there were too many problems with the legal documents of the court at that time, and suggested that the college offer the course of judicial documents. Under the organization of Gao Chao, the director of the teaching and research section, Professor Ning Zhiyuan and others began to prepare materials at 1964, and began to give lectures at 1965, which was unique in all political and legal colleges at that time. Unfortunately, with the arrival of the "Cultural Revolution", 1966 school was closed, and the course of legal documents was closed. After the "Cultural Revolution", Yu Jizhi, a teacher at Southwest University of Political Science and Law at that time, compiled a textbook of legal documents, trying to introduce various legal documents. Later, the Ministry of Justice set up a law textbook editorial department. At first, the legal documents in Chinese course were mainly written by Mr. Yu Jizhi. Later, due to the requirements of legal documents and other aspects, Beijing University of Political Science and Law was given priority to, and Professor Ning Zhiyuan was mainly responsible for taking over the compilation of teaching materials for this course. Professor Ning Zhiyuan used writing theory for the first time to analyze various writing elements of legal documents and some problems that need to be improved urgently. Universities at that time, including the then Central Radio and TV University, also adopted this book as a teaching material. Professor Ning Zhiyuan was also invited to give a lecture on this course originally offered by RTVU. The Ministry of Justice also entrusted China University of Political Science and Law to train two teachers of judicial documents in national political science and law colleges, and appointed Professor Ning Zhiyuan as the head teacher. Now these people are the backbone of the teaching of judicial documents in political and legal colleges. At that time, due to the lack of information, the writing characteristics and basic theories of legal documents were gradually explored. Although the teaching materials at that time were a little rough in retrospect today, it was from this rough starting point that the teaching materials and materials of legal documents were improved step by step, which made them relatively accurate and complete today.
At present, the writing of legal documents in practical work has been standardized as a whole, but there is still room for efforts in the coordination and unification between departments and industries. When it comes to the study of legal documents, Professor Ning thinks that some problems need to be coordinated and unified by relevant departments. Professor Ning only takes the document numbers of the public, procuratorial and legal departments as a very small example for analysis. At present, various departments in the numbering sequence maintain different sorting habits according to their own practices. However, from the perspective of maintaining judicial unity and reflecting the seriousness and authority of legal documents, the numbering order of documents should be further unified, which is also an inevitable requirement for the standardization of legal documents. In fact, this kind of unification does not need too much theoretical proof, nor does it necessarily increase economic costs. However, as a legal department and a legal professional group, jurisprudence, in the words of Mr. Wang, "has a lot to do in theoretical research and practical exploration of legal documents."
When I first started my research, some departments refused to provide relevant information to scholars for anatomical research on the grounds that relevant legal documents were confidential. In contrast, the research conditions and atmosphere at that time had been greatly improved, and the Legal Documents Research Association itself actively absorbed more researchers from practical departments to participate. Speaking of this, Professor Ning sincerely feels gratified by the great progress of this discipline research combining theory with practice, lamenting the progress of the research environment of the discipline of law, and lamenting that it is through the accumulation and step-by-step breakthrough and transcendence of countless scholars, legal professionals and countless ordinary people that the national legal system construction has been promoted from one side to the other.
Regarding the current situation of legal document practice, Professor Ning thinks that the polarization trend of domestic legal document writing is worthy of attention. On the one hand, stylization is obvious, there are many forms in legal documents, and the writing content can basically be completed by filling in the blanks. The efficiency of this simple tabular processing is improved, but too much emphasis on efficiency will easily lead to mechanical understanding and operation of the law, which is a tendency that should be paid attention to in the process of making legal documents. On the other hand, the trend of academic documentation in legal document writing has also been manifested. Legal documents do need to be fully reasoned, but the judgment of a civil case is always 20 thousand to 30 thousand words, and the reasoning is too detailed and complicated. Legal documents should pay attention to the nature and decision of reasoning and avoid discussion authentication. Professor Ning put forward his own views. "Some classic judgments in ancient China are accurate and concise, which embodies a kind of writing skills and legal majesty, and are not without reference value today". Professor Ning believes that the writing of legal documents is still worthy of our whole legal professional group's serious experience and thinking, and there is a problem of making the past serve the present. We don't have to quote the classics, and we don't have to call it Greece, but we should learn more nutrition from the excellent legal documents at home and abroad in terms of expression skills and expression style.
