(7) The clinic must be fixed for a long time (not owned by the applicant, with a lease agreement of more than 5 years), which meets the requirements of the Basic Standards for Medical Institutions promulgated by the Ministry of Health. Article 3 An application for opening an individual clinic shall be submitted to the county (city) or district health administrative department where the household registration is located, and the following materials shall be submitted: (1) An application for opening an individual clinic (which must be declared as a profit-making medical institution); (2) Feasibility study report; (3) Site selection report and architectural design scheme; (4) Other materials (copy of ID card, certificate of registered capital issued by accounting firm, health check-up form issued by hospitals at or above the county level, doctor's qualification certificate and doctor's practice certificate, personal resume, original unit consent certificate provided by retirees, and lease agreement required for renting a house). Article 4 After accepting the application, the administrative department of health shall give a written reply of approval or disapproval within 20 working days according to these regulations and the establishment plan of local medical institutions. If it is approved, it shall issue a Letter of Approval for the Establishment of a Medical Institution to the applicant (it shall be marked as a profit-making medical institution). Article 5 An applicant shall complete the preparatory work within 3 months after obtaining the Approval Letter for the Establishment of a Medical Institution, and apply for the practice registration of a medical institution to the health administrative department that approved its establishment; After accepting the application, the administrative department of health shall, within 20 working days, conduct an audit according to the relevant provisions of the Regulations on the Administration of Medical Institutions, the Law on Medical Practitioners and the Basic Standards of Medical Institutions. Those who pass the examination shall be registered and issued with the Practice License of Medical Institution, and the profit-making medical institution shall be indicated on the original and copy of the Practice License of Medical Institution. Private clinics must carry out diagnosis and treatment activities within the approved scope. Article 6 After obtaining the Practice License of Medical Institution, an individual clinic shall go through the relevant registration formalities with the departments of industry and commerce, taxation and price at the same level. Private clinics such as sexually transmitted diseases and urology are temporarily not approved. Article 9 In principle, private clinics can only set up 1 diagnosis and treatment subjects. Article 10 In accordance with the Regulations on the Administration of Medical Institutions, the Law on Medical Practitioners and other laws and regulations, strengthen the management and supervision of established individual clinics, and severely investigate and punish illegal acts such as hiring medical personnel without authorization, setting up second-class western medicines and third-class Chinese medicines without authorization, so as to ensure medical safety and safeguard the vital interests of the broad masses of the people. We must resolutely ban illegal medical tourism and unlicensed medical practice according to law and maintain normal medical order. Article 11 State functionaries in charge of examining and approving individual clinics shall examine and approve according to law, and those who violate relevant regulations by practicing fraud, neglecting their duties, abusing their powers and engaging in malpractices for selfish ends shall be investigated for responsibility according to law.
