First, labor dispatch units and employers should establish trade union organizations according to law and recruit labor dispatch workers to join trade unions. No organization or individual may obstruct or restrict it.

Labor dispatch workers should first choose to join the labor union of the labor dispatch unit, and the labor union Committee of the labor dispatch unit should have a corresponding proportion of labor dispatch work as members. If the labor dispatch unit has not established a trade union organization, the labor dispatch workers directly participate in the labor union of the employer.

Second, during the period of labor dispatch, the labor union of the labor dispatch unit may entrust the labor union of the labor dispatch unit to keep it on its behalf. The labor dispatch unit trade union and the labor unit trade union sign an entrustment management agreement, clarifying the responsibilities and obligations of both parties to the activities of member organizations and the maintenance of rights and interests.

Third, the labor union funds of the labor dispatch workers are extracted and allocated by the employing unit according to 2% of the total wages of the labor dispatch workers, and the funds that should be turned over to the higher-level trade union are turned over by the labor dispatch unit trade union according to the prescribed proportion. Where the employer's trade union accepts the entrustment to manage the labor dispatch workers' members, the retained part of the trade union funds shall be used by the employer's trade union or determined by the labor dispatch unit and the trade union through consultation.

Fourth, the number of labor dispatch workers is counted by subordinate units. Joining the labor dispatch unit trade union, including entrusting the labor dispatch unit to manage, shall be counted by the labor dispatch unit trade union, and directly joining the labor dispatch unit trade union shall be counted by the labor unit trade union.
