The development of the discipline of international law in the Law School of Hunan Normal University has seized the opportunity of legal education, and closely combined with the realistic requirements put forward by the new changes of China's socialist market economy and political and economic structure in the era of globalization to various fields of international law. On the one hand, the introduction of talents and the training of existing law teachers have been continuously strengthened, forming a discipline echelon combining teaching and scientific research with the old, middle and young; On the other hand, it is necessary to integrate the important legal education resources in the province, strengthen the scientific research strength of legal education and strengthen academic exchanges with foreign countries. It has formed its own characteristics in the four main research directions of private international law, WTO law, international economic law and international civil and commercial law, and has achieved systematic and fruitful research results, which has had a significant impact in China. This discipline has been listed as a key discipline in Hunan Province during the Eleventh Five-Year Plan period, and it has become the key support and development object of Hunan Province during the Eleventh Five-Year Plan period. First, the historical origin of the formation of this discipline. The discipline of international law in the Law School of Hunan Normal University started in the early 1990s. 1992 * * * After the 14th National Congress put forward the goal of establishing the reform of the socialist market economy system, the leaders and experts of our school were keenly aware of the important role of law in the construction of China's socialist market economy, and also realized the significance of law for Hunan Normal University to become a research-oriented and comprehensive university. After consultation with Wuhan University, Professor Li, a famous scholar of private international law in China, was hired as a tenured professor, and he undertook the arduous task of the construction of law specialty in our university. 1993 the law major of our school was officially granted the right to confer master's degrees, and in the same year, it began to recruit master's students in the direction of private international law in the master's degree program of law. After several years' efforts, it was officially awarded the right of 1998 international master's degree, becoming the first international master's degree program in Hunan Province. In 2002, it was established as a school-level key discipline by Hunan Normal University, and in 2006, it was awarded the right of 1 international doctor's degree. In addition, in order to strengthen the strength of doctoral program echelon and enhance the teaching and scientific research strength of doctoral program, we are actively creating conditions to establish an international postdoctoral mobile station of law. Two. The current situation of this discipline (I) Construction of teaching staff The Law School of Hunan Normal University has a strong faculty of international law, including 7 professors, 4 associate professors, 2 lecturers, 1 member of the legal expert group of the State Council Discipline Appraisal Group (the third session), 1 member of the Law Teaching Steering Committee of the Ministry of Education, 6 doctoral supervisors and 9 echelon members with doctor of law degrees. Five teachers have entered the post-doctoral mobile station and have left the station. Nearly 80% of the teachers in this subject have doctoral degrees. On average, 17-24 graduate students are trained every year. Among them is Professor Li, who is regarded as one of the founders of private international law in New China. Professor Guo, a well-known expert in international economic law at home and abroad; A group of experts and scholars, including Professor Jiang, a member of the Teaching Steering Committee of Law Specialty of the Ministry of Education, have formed a teaching team with reasonable age structure, coordinated professional titles, rich teaching experience and strong scientific research strength. Whether it is the scale of teachers, the number of doctoral degrees, the number of senior titles, or extensive contact with judicial practice, it is in the forefront of our province. (2) Scientific research: As the leading discipline in our college, international law has always attached great importance to teaching and scientific research, and closely integrated theory with practice. In terms of scientific research, the discipline fully taps the potential of academic research teams and organizes the declaration of national, provincial and ministerial scientific research projects. On the basis of three-level scientific research projects, a number of landmark high-quality scientific research achievements have been produced. Up to now, 5 national projects and 33 provincial projects have been completed and undertaken; Won the third prize of the Ministry of Education 1, 2 prizes of the Ministry of Justice, the first prize of the Provincial Social Science Fund 1, 2 second prizes and 3 third prizes. He has published more than 370 professional academic papers in core journals at home and abroad, such as Legal Research, China Law and World Investment Magazine. He has published more than 50 academic monographs in law publishing houses and Peking University publishing houses, published 25 teaching materials of all kinds compiled by the whole country and the whole province, and translated and published 6 important legal works and dictionaries such as Daisy and Morris on Conflict of Laws, Oxford Law Dictionary and Modern Roman Law System (Volume VIII). He has won nearly 20 awards, including the Humanities and Social Sciences Award of the Ministry of Education, the Outstanding Scientific Research Achievement Award of the Ministry of Justice and the Social Sciences Achievement Award of Hunan Province. He has hosted the only academic publication published by Hunan legal circles, Time Law, and published the series of International Law and Comparative Law edited by Professor Li all the year round. These are not only the basis of theoretical research in this discipline, but also an important garden for communication between this discipline and the theoretical and practical circles of law at home and abroad. In order to meet the needs of the continuous improvement of teaching and scientific research level, this discipline attaches great importance to the construction of teaching and scientific research service facilities, invests a lot of money, and has modern multimedia classrooms, computer rooms and multi-functional mock trials; There are 2 subject and system reference rooms, more than 2 1.96 thousand professional books and more than 2 1.8 kinds of various newspapers and magazines. (III) Academic exchanges In terms of academic exchanges, the discipline actively participates in academic activities at home and abroad, and adopts the policy of combining "going out, please come in". On the one hand, teachers are encouraged and funded to go abroad, and five teachers have been senior visiting scholars in Germany, Switzerland, the United States and other countries, and each professional teacher is guaranteed to attend a national academic conference every year, thus expanding the academic influence of disciplines and teachers. On the other hand, we have made full use of distinguished professor's resources, established extensive contacts with the State Council Legislative Affairs Office, Ministry of Foreign Affairs, Ministry of Commerce and other government and practical departments, and established close academic contacts with overseas academic institutions and universities such as Max Planck Institute, Swiss Institute of Comparative Law, Georgetown University, City University of Hong Kong and Soochow University in Taiwan Province Province. At the same time, on average, more than 20 well-known experts and scholars at home and abroad are invited to give lectures and attend academic seminars in our hospital every year. China International Private Law Research Association Annual Meeting 1999, WTO Senior Experts Seminar in May 2004, National International Economic Law Annual Meeting in 2005, Fourth Academic Forum on Legal Research and Legal Journals in April 2006, Li International Private Law Seminar in 2006, International Trade and Human Rights Protection Seminar in 2007 and China Arbitration Law Seminar have been successfully held. Three. Research direction and development prospect of this subject. Since 1998 was officially awarded the right to master's degree in international law, this discipline has paid attention to strengthening the research on the basic theory of international law on the one hand, and on the other hand, it has also paid attention to the research on branches and marginal disciplines of international law, streamlining the direction of the discipline and implementing optimal combination. It has formed distinctive research directions such as private international law, WTO law, international civil and commercial law, international economic law, etc., focusing on strengthening the research on international human rights law, contemporary conflict law, WTO legal issues, international finance law, international investment law, international adoption law and international environmental law. Each direction has its own characteristics and coordinated development. (I) Private International Law This research direction mainly studies the ontology of private international law, namely, the basic theory of conflict law, the construction of a new international civil and commercial order, the international civil litigation and commercial arbitration system, and the legal issues of international adoption. Its characteristic is based on the objective need of establishing the socialist market economic system in China for the study of legal theory, using comprehensive methods and comparative methods to study the basic theory of private international law and the practical legal problems that need to be solved urgently in China's legal practice. Professor Li, a well-known expert in private international law in China, closely combined with the realistic legal needs of the socialist market economy, took the lead in putting forward the viewpoint of convergence of private international law, and advocated that the function of private international law should be changed from traditional conflict resolution to the construction of a new international civil and commercial order, thus realizing the transformation of the function of private international law and adapting to the needs of the globalization era, which had a far-reaching impact on the academic circles of private international law in China. He has published more than 80 academic papers and works 17 (including 4 important translations) in domestic and foreign law magazines. 200 1 Edited Essays on International and Comparative Law (now published to 16). He also presided over, translated and published the British and German legal classics Daisy and Morris on Conflict of Laws, savigny's Modern Roman Law System (Volume VIII) and Oxford Law Dictionary. 2 1 Century Professor Jiang, an academic leader, contributed to the emergence and perfection of the theory that private international law takes the establishment of a new international civil and commercial order as its own responsibility. Professor Jiang has devoted himself to the research on the basic theory of private international law for a long time, and presided over the 1 national social science fund project and six provincial and ministerial projects. He has published more than 60 papers in law core journals such as Law Research, China Law, Jurist and Law Review. In addition, his research achievements in the field of international adoption law are obvious to all. At present, two monographs have been published, namely, Adoption Law, Research on International Adoption Legal System and Comparative Study on Adoption Law, and nearly 20 academic papers on international adoption law have been published, covering the basic theoretical issues of international adoption legal system, which is of great guiding significance to the construction of China's adoption legal system, especially the legislation, law enforcement and justice of foreign adoption. Through the visit to Max Planck, Germany, the study of transnational adoption law in our school has a certain international influence. (II) WTO Law The WTO law focuses on the treaties, resolutions and related cases of the World Trade Organization, focusing on legal issues such as international investment, international finance, intellectual property rights and international trade dispute settlement mechanism related to trade. At the same time, it pays attention to the mutual penetration and integration of WTO and international economic law, the construction of WTO and international civil and commercial order, and the construction and perfection of WTO and Hunan's foreign-related legal system. In view of the actual situation of Hunan's opening up after its entry into WTO, it discusses and studies the construction and perfection of WTO and Hunan's foreign-related legal order, WTO and environmental protection. The academic leader of this research direction is Dr. Wang Guiguo, distinguished professor of Hunan Normal University, who is mainly engaged in the teaching and research of international economic law and World Trade Organization law. In recent five years, his main research achievements are: International Monetary and Financial Law (single edition), International Investment Law (single edition), China Economic Law (single edition) and World Trade Organization Law (single edition), etc. He has published 46 academic papers in international and domestic academic journals such as World Investment Magazine and Jurist. He has presided over the completion of major research topics such as "Comparative Study on the Laws of China Mainland and Hongkong", "Functional Transformation of the International Monetary Fund after the Asian Financial Storm", "Influence and Countermeasures of China's Entry into WTO on Cross-Strait Intellectual Property Protection", "Research on International Investment Law" and "Research on Convergence of International Commercial Dispute Settlement Mechanism", which can be closely combined with the actual situation and needs of China's foreign-related economic exchanges to conduct in-depth research, with outstanding theoretical value and practical operability. (III) International Civil and Commercial Law International civil and commercial law takes international conventions, international practices and "model laws" formulated by international organizations such as the United Nations Trade Commission, the International Chamber of Commerce and the Rome Institute for the Unification of Private Law after the 1960s as the research object. This research direction has made outstanding achievements in the field of international contract law, especially the study of American contract law, which is in a leading position in China. In addition, the research in the field of modern commercial law has also had a certain impact on academic circles. Professor Li Xianbo, an academic leader, has made many achievements in the fields of comparative contract law, international civil litigation and intellectual property law. He has published 6 monographs, including Private International Law and International Civil Procedure, Comparative Study on Contract Validity, Contract Law Theory, International and Domestic Protection of Intellectual Property in the Knowledge Economy Era, Special Study on International Civil and Commercial Law, International Civil and Commercial Law and Legal Construction in China, and edited 6 monographs on WTO Legal Issues. He has published more than 40 papers in Legal Research, China Law, Law Review and Legal Business Research. Undertake 3 provincial projects and participate in national projects 1. His Comparative Study on the Effective Establishment of Contracts won the third prize of the 6th Excellent Social Science Works in Hunan Province. On the Coordination of International Civil Jurisdiction won the second prize of the first excellent paper of China Private International Law Research Association. Professor Zheng Yuanmin is good at studying modern commercial law in international trade, including international treaty law, international economic law and network law, and pays attention to international law in the network. He has published monographs such as Modern Commercial Law and Comparative Study on Bankruptcy Legal System, and published dozens of related papers in domestic core journals such as Legal Research, China Law, Law Review and Law. (IV) International Economic Law The research direction of international economic law mainly studies treaties and practices that regulate international economic relations, among which the most important parts are international trade law, international investment law, international financial law and the legal system and legal principles of international economic organizations. Its characteristics are mainly reflected in highlighting the world monetary and financial legal system and government procurement law research. Professor Xiao Beigeng, an academic leader, has long devoted himself to the study of basic theoretical issues of international economic law. He has published academic monographs on international economic law such as International Economic Law and International Regulation of Government Procurement, published more than 30 professional academic papers in law core journals such as Modern Law and Law, presided over 3 provincial-level projects, participated in 2 national-level projects, and presided over or participated in 4 various projects. Professor Chen Yunliang studied in Japan and has been engaged in the research of internationalization of economic law for a long time. He took the lead in studying international economic law from the perspective of domestic law, and conducted in-depth discussion and research on the basic theory and system of international economic law. He has published more than 30 papers and 2 monographs in core journals such as China Law and Modern Law, presided over 1 project at the national level and 3 projects at the provincial level.
