According to Article 16 of the Regulations of China People's Liberation Army on Officers' Ranks, the first award of officers' ranks shall be approved in accordance with the following provisions:
(1) General, Lieutenant General, Major General, Senior Colonel and Colonel shall be awarded with the approval of chairman of the Central Military Commission;
(2) Lieutenant Colonel and Major shall be awarded with the approval of the head of the People's Liberation Army headquarters, major military regions, arms and services or other units equivalent to military regions;
(3) Captains, lieutenants and second lieutenants shall be conferred with the approval of the heads of the group army or other units at the corps level that have the power to appoint and dismiss officers.
According to the provisions of Article 17 of the Regulations of China People's Liberation Army on Military Ranks, military ranks are promoted according to the following conditions:
(1) Time limit for promotion to the rank of officer in peacetime: second lieutenant is promoted to lieutenant, two years for those who have graduated from junior college or above, and three years for others; Captain promoted to captain, captain promoted to major, major promoted to lieutenant colonel, lieutenant colonel promoted to colonel, colonel promoted to senior colonel, each for 4 years; Promotion to the rank of senior colonel or above is based on the officer's position, ability and political integrity and contribution to national defense construction;
(2) The time limit for the promotion of officers' ranks in wartime may be shortened, and the specific measures shall be formulated by the Central Military Commission (CMC) according to wartime conditions.
The time spent by officers studying in institutions of higher learning is included in the period of rank promotion.
