personal information
The undergraduate course comes from four departments of the Fifth Hospital, with a preliminary test score of 400+, majoring in international law. There is not much hesitation in choosing Daihatsu International Law School. I like international law, private international law and international economic law during my undergraduate course. In addition, the strength of the University of France in international law is obvious to all. From this, I set my own goals.
I also took the 202 1 legal professional qualification examination. In view of the small proportion of international law in the law examination, I can only prepare for the law examination when I have spare capacity. With the mentality of trying, I finally passed. Whether to participate in the second interview can be decided according to your own situation.
Public class
1, English:
English uses the real questions of Huang Zhangjian Pi, and it takes about an hour to brush the questions every day. There are still many mistakes in the real question of 2005- 12 (cloze and reading 5-8 mistakes). Later, when I brushed the real questions of 05- 13 and 14, I found that there were only one or two mistakes in gestalt and reading comprehension, so the time for political review was relatively short at that time. Organize the composition template a few days before the exam.
Lesson: It is very important to brush the questions! ! !
2. Politics:
Politics is the most time and energy I spend besides civil law, but I also feel that the cost performance is quite low. I gave all the time I spent in English at night to politics, and even squeezed into the English recess at the back, so from mid-September to the exam, I spent an average of 3 hours on politics every day. The materials used are Xiao Xiurong's complete set. The bookstore buys whatever it comes, and also uses "strong grass in the wind", but the font is too flowery, so I want to poke my eyes and give up. 9- 1 1 at the end of September, mainly brushing multiple-choice questions, especially philosophical multiple-choice questions. Because Mao Zhongte is closely integrated with modern history and ideological accomplishment. As well as current political hotspots, I have mastered the basic knowledge points in the early stage, focusing on these three subjects, and the question 1000 is almost the same. Specifically, read the full text of "Exquisite" carefully, and then do the corresponding chapter of "1000 Question".
After almost165438+1early October, the summary of knowledge points also came out (express the philosophical mind map in the summary, make good use of it! ), and then brush "1000 question" for the second time.
Then back to the current political situation (very important, according to the old Xiao Man's words accounted for 40%, combined with Mao Zhongte and modern history. When I tried for the first time, I also encountered several questions about current politics, or I made a mistake and didn't review them again, so my impression during the exam was rather vague) and "test site prediction" were the real questions for Xiao Ba and Xiao Si. Master Xiao is amazing again this year.
Specialized courses: textbook+personal experience+note arrangement (a core textbook+supplementary use of other textbooks) 1, legal synthesis
Civil Law: An Introduction to Civil Law in Liang Huixing,
Ma Junju's Original Theory of Civil Law
Constitution: from constitutional norms to normative constitution,
Lecture on constitution,
constitutional jurisprudence
Law: law,
History of western legal thought
Star sign is a teaching material that I think is useful for preparing for the initial test. As mentioned above, I mainly read the book twice and began to sort it out after understanding it. Before sorting out my notes, I read the real questions I can find over the years (the real questions are mainly collected from the postgraduate entrance examination group and obtained from last year's seniors) several times, then marked the real questions in the textbook catalogue, made clear what the key points are, and then marked them in my notes (electronic notes) for future review. Because last year's General Principles of Civil Law just came out, I also marked the revised provisions in my notes. To tell the truth, civil law is not difficult, but there are too many contents. You can take the real questions of the past years as a reference, grasp the key points first, and then consider others when time permits. In contrast, the constitution and jurisprudence are very kind, and the arrangement of annotations is the same as that of civil law. It's just that the Lecture Notes on Constitutional Law is in the form of lecture notes and the language is colloquial, so I took it as the backbone of my notes, and then revised it with reference to From Constitutional Norms to Normative Constitutions and Constitutional Law (I only read Chapter 6).
Lesson: One disadvantage of attaching importance to real questions is that it is easy to review incompletely, such as the harmonious system of * * * in the Constitution and the theory of national legal person, as well as dialectical reasoning of jurisprudence. Although the notes have been sorted out, they are not the focus of review. I was confused. I feel that I will die on the spot after taking the law comprehensive exam. Fortunately, this year's civil law is still kind.
2. Public international law: written in three sections: theory+case+current affairs.
Theories: (at least two) Public International Law (Jia Bingbing, 2008 edition), Public International Law: Interpretation and Application in peacetime (* * Jia Bingbing, 20 15 edition), international law (* * Shao Jin, 5th edition), international law (Shao Shaping, 2066).
Case books: (at least two) Comments on Classic Cases of Public International Law (China University of Political Science and Law Press, 1995 Edition), Recent Case Studies of the International Court of Justice (1990-2003) (* * Shao Shaping, 2006 Edition), Comments on Typical Cases of International Law (* *).
Current affairs hotspots:
They mainly use several official WeChat accounts: Wuda Bianhai, Center for the Promotion of International Law (The Voice of the International Rule of Law by Teacher Yang Guohua), China International Law Frontier and Political Commentator's International Law Review (the official number of Pan Xuechang admitted on 20 17), and Xinhua International Headline.
There are also several international law reviews in universities: Peking University International Law and Comparative Law Review, Wu Da International Law Review and International Law Review (Tsinghua University Press). Read the latest issues (generally 20 15 and 20 16).
Review ideas: mainly teaching materials, refer to case books and treaties involved in relevant chapters. The commentary focuses on combining classic cases with hot spots in international law.
Let's talk about why there are at least two textbooks. Referring to the real questions in previous years, we can find that Mr. Jia's books are completely inadequate. For example, the real question of 20 17, the case of shooting down a Korean passenger plane (some brothers and sisters said it was Malaysia Airlines, which I don't think is like it, but it must be proved that it was combined with hot spot investigation) and the content of the air defense identification zone of 14 all need the content of international air law, as well as Mr. Jia. Then look at the basic textbooks mentioned above. Mr. Shao Jin's book is simple and complete, but some viewpoints are far from Mr. Jia's, such as national identity. Because I read Mr. Shao Jin's book first, I am preconceived, and then I read Mr. Jia's book. I have been fighting in my mind. But there is really no way, so I choose to read Mr. Shao's book first, because Mr. Jia's book is really difficult, academic and his translation accent is very strong. He has no foundation. After reading the first chapter, he really couldn't stand it. He decided to read Shao Jin's textbook first, master some basic knowledge and then come back to read Jia's book. After reading it for the first time, he was still at a loss. It was not until I learned from my seniors about the 20 15 edition that the review of international law was on the right track (15 edition added contents, such as Chapter 15, National Disputes and the Right to Resort to War, and recent case analysis, focusing on reading sentences through! ! ! )
Then talk about why at least two case books should be used. First of all, the layout of most case books is consistent with the teaching materials, which means that case books may only pay attention to one aspect of the case. However, each case will involve many chapters. For example, the Corfu Strait dispute case of 15 involves the jurisdiction of the International Court of Justice, state responsibility, the right of innocent passage of the territorial sea and other issues. And no one can cover all the important cases (mainly those involved in Mr. Jia's book), but if you can find a comprehensive analysis, one should be enough. At first, I used the book Comments on Classic Cases of Public International Law (China University of Political Science and Law Press, 1995 edition), but its practice only reached 1993, and it was co-authored by teachers, and the quality of comments was uneven. Teacher Liang Shuying, her analysis is both in place and comprehensive. It's a pity that I didn't know about the book "Case Course of International Law" by Teacher Liang Shuying until the initial test, and I haven't read it yet. The recent Case Study of the International Court of Justice (1990-2003) (* Shao Shaping, 2006 edition) is the most comprehensive and detailed case book I have ever seen. Quoting the original judgment, the judge's opinions and legal analysis are in place, but there are too many contents, which need to be read patiently. Comments on Typical Cases of International Law (edited by Mao) is a book about the law of the sea and state responsibility, including the shooting down of a Korean passenger plane. It is very detailed from legal analysis to the introduction of case contents and the development of relevant principles, and there are some expanding ideas behind it, which is very enlightening. A classmate asked me, do I need to master all the cases mentioned in Teacher Jia's book? Personally, I think it is necessary. )
Let's talk about why it should be combined with treaties in relevant chapters (especially the law of the sea):
The general idea of each chapter of Mr. Jia's book is: general principles (general common law principles and mandatory laws embodied in treaties)+general rules (relevant provisions of treaties)+general practice (classic cases or China practice). So this is also the general arrangement of my notes.
Finally, talk about hot spots: hot spots are really important to me. For example, when the final text of the Treaty on the Prohibition of Nuclear Weapons was adopted in 20 17, the first test was the "Consultation on the Legality of the Threat and Use of Nuclear Weapons", and the Catalonia independence incident that was raging last year, and then the principle of people's self-determination was tested for the second time. I didn't spend much time focusing on hot spots. I just had a boring look after dinner, flipped through the official WeChat account (mentioned above), and ran to the library to flip through the periodicals after reading the textbooks. (Almost all the periodicals in the past two years will involve the analysis of the relevant legal system of the island, and they have also been tested this year. )
3. International economic law: an overview of international economic law,
International Economic Law (Yu Jinsong, 4th Edition)
Famous teachers give lectures on international economic law (Che Pizhao, 2008).
Research on International Economic Law (Che Pizhao, Paper)
Generally speaking, the "outline" is enough, and the key points of the exam are clear, including introduction, international commercial law, international investment law and related government management measures. What is more surprising this year is that I took the case, but the content of the test is also the content of international commercial law, so it is enough to master the important content. If you are not at ease, you can borrow a case book from the library. I remember that I borrowed a Case Course of International Commercial Law from Tsinghua Publishing House in the library before the second interview, but I couldn't find it when I found it later. Teacher Yu's textbook is very detailed and can be used as a supplement. Teacher Che's essay can be read with boredom, which is conducive to further understanding some concepts in the textbook, such as market access.
4. Private International Law: A Concise Course of Private International Law.
Private international law (Pi Huang Wang Li, 20 14),
Comparative Private International Law (Chen, 20 12 Edition)
Private international law is the kindest of all subjects, and there are traces to follow. The real question is very important! The contents of the concise tutorial and the Yellow Book are really similar (almost the same), but there will be some differences at some point in a certain chapter. I mainly focus on concise tutorials, and the yellow book I bought in May 438+10 is a supplement to my notes. Mr. Chen's book has also been read several times, and relevant viewpoints are mixed in his notes as a supplement to his own views. (Actually, it doesn't matter if you don't look. Teacher Li's book is completely sufficient for the first attempt. )
Summary:
I wrote so much not to say how hard I worked, but how many detours I took. Unless you are really interested, students who are preparing for the exam are not advised to spend too much energy. It is wiser to master other subjects first and then deal with them when you have spare capacity. At least make sure you cross the line. Of course, I didn't get the point myself, so I took so many detours. But I think it's not bad. After all, there are many roads to walk and scenery to see. )
Miscellaneous words:
1, on the purchase of papers and materials:
Is it necessary to read the paper? According to the experience and opinions of seniors who have been admitted over the years, it is not necessary. Personally, for the first time, the role of the paper is really limited. But I still read some papers on jurisprudence, public international law and international economic law (after all, what I have read is what I know. ). Then, because I really didn't know how to organize my notes at first, I bought my senior brother's law notes (I recognized my senior brother's law notes, well, I organized them in detail), and I finished reading his thoughts and organized them myself. As for whether it's better to memorize predecessors' notes or take your own notes, it's better to look at the individual. I think sorting out notes is a process of internalizing knowledge, and sorting out notes is my favorite process (it is very painful to recite).
Fourth, write it at the back.
I don't like to compare the postgraduate entrance examination to washing clothes in a dark room. The day of postgraduate entrance examination is also a mobile life, so there is no need to live a miserable life. It is necessary to eat and sleep on time, choose a time period every week to relax and do your favorite exercise every day. Learning is already very tiring, so do happy things to soothe your tired heart.
Of course, no one knows whether it will succeed in the end. However, it seems that "I can't do it" is a good word. It was impossible, if only it succeeded. You have to run with a home run mentality, so it's cool to strike out. Of course, I can't say such a philosophical thing, which is said in the Japanese drama "The Battle of Marriage Proposal".
I remember when I was ready to go out in the morning, I felt that I was finished. But on second thought: even if you climb today, you should climb to the examination room.
In this way, I thought I couldn't do it, but I could clumsily run to the finish line. That's it. It's not enough, but it's really a good word.
I wonder if there are any friends who like Mayday? If you like their works, I think you may have heard of Fool. As far as I'm concerned, there's nothing wrong with being a fool, at least I dare to speak my mind. * * * Whatever you want.
