Measures for handling violations of discipline and discipline in civil service examination and employment
Article 1 These Measures are formulated in accordance with the Civil Service Law of People's Republic of China (PRC) and other relevant provisions in order to standardize the identification and handling of violations of discipline and discipline in the recruitment of civil servants, enforce the examination discipline and ensure the fairness and justice in the recruitment of civil servants.
Article 2 These Measures shall be applicable to the identification and handling of violations of discipline and discipline of candidates and staff in the recruitment of civil servants.
Article 3 The identification and handling of violations of discipline and discipline shall be based on clear facts, conclusive evidence, standardized procedures and accurate applicable provisions.
Article 4 The competent departments of civil servants, recruitment agencies, examination institutions and other relevant institutions shall, in accordance with the duties and powers stipulated in the laws and regulations on the recruitment of civil servants, identify and deal with the violations of disciplines and regulations of applicants and staff.
Article 5 If the application materials or information provided by the applicant about the qualification for examination are untrue, the recruitment agency or the competent department of civil servants in charge of qualification examination shall cancel the qualification for examination.
Candidates who maliciously register registration information, disturb the registration order or falsify academic credentials and other related materials to defraud the examination qualifications and other serious violations of discipline and discipline will be disqualified from this examination by the central recruitment agency or the competent department of civil servants at or above the municipal level, and recorded in the integrity file of civil servants' examination and employment for a period of five years.
Article 6 If an applicant commits any of the following violations of discipline and discipline during the examination, the examination institution, the recruitment agency or the competent department of civil servants who specifically organized and implemented the examination shall give him an invalid examination result in this subject (time period):
(1) Bringing the articles exceeding the requirements into the examination room and failing to place them in the designated position as required, and still failing to make corrections after being reminded;
(2) Failing to take the exam at the designated seat, or leaving the seat or examination room without the permission of the staff, and still failing to make corrections after being reminded;
(3) Failing to fill in (fill in) my information as required after being reminded;
(4) Taking the test paper, answer sheet and answer sheet out of the examination room, or intentionally damaging the test paper, answer sheet and answer sheet;
(five) in the test paper, answer sheet, answer sheet outside the prescribed position marked with my information or other special marks;
(6) Answering questions before the start signal of the exam is issued, or continuing to answer questions after the end signal of the exam is issued;
(seven) other violations of discipline that should be given when the examination results of this subject (session) are invalid.
Article 7 If an applicant commits one of the following serious violations of discipline and discipline in the examination, his qualification for this examination shall be cancelled and recorded in the integrity file of civil service examination, with a record period of five years:
(1) Plagiarism or assisting plagiarism;
(two) to take the exam with forged documents;
(three) the use of prohibited self-contained communication equipment or electronic equipment with computing and storage functions;
(four) other serious violations of discipline should cancel the qualification of this examination.
Those who apply for civil servants of the central organs and their directly affiliated institutions shall be handled by the competent department of civil servants of the central organs or the central level recruitment agency. Those who apply for civil servants in local organs at all levels shall be handled by the provincial civil servant department or the municipal civil servant department with districts.
Article 8 If an applicant commits one of the following particularly serious violations of discipline and discipline during the examination, the central civil servant competent department or the provincial civil servant competent department will give him the treatment of canceling the qualification of this examination and record it in the integrity file of civil servant examination and employment for a long time:
(1) colluding in cheating or participating in organized cheating;
(2) Taking the exam instead of others or letting others take the exam instead of themselves;
(3) Other violations of discipline and discipline with particularly serious circumstances and bad influence.
Ninth in the process of marking, it is found that the answers of candidates in the same subject are similar, and the examination institutions that organize the implementation of the examination will give them invalid examination results in this subject (time period) after confirmation by the marking expert group. Examination institutions at or above the provincial level determine the specific methods and standards for answering the same questions.
Candidates who have the same answer in the same subject and have other relevant evidence to prove that their cheating is established shall be dealt with in accordance with the provisions of Articles 7 and 8 of these Measures as the case may be.
Article 10 If an applicant conceals an illness or medical history that affects employment during the physical examination, the recruitment agency or the competent department of civil servants will refuse to hire him. Those who collude with the staff to cheat or ask others to take the place of physical examination, exchange and replacement of laboratory samples will be rejected by the recruitment agency or the competent civil service department, and will be recorded in the integrity file of civil service examination and employment by the central recruitment agency or the competent civil service department at or above the municipal level for a period of five years.
Article 11 If an applicant practices fraud, conceals the real situation or has other behaviors that hinder the normal conduct of the inspection, the recruitment agency or the competent department of civil servants responsible for organizing the inspection will give him a rejection. Serious violations of discipline and discipline with serious circumstances and bad influence shall be recorded in the integrity file of civil service examination and employment by the central recruitment agency or the competent civil service department at or above the municipal level with districts, and the recording period shall be five years.
Article 12 If an applicant is found to be in violation of discipline and discipline on the spot, the staff member shall stop or terminate his/her continuing to take the exam, collect and keep the corresponding evidence materials, truthfully record the facts of violation of discipline and discipline and the on-site handling, which shall be signed by two or more staff members and reported to the department responsible for organizing the examination and employment.
Thirteenth before making a decision on the applicant's violation of discipline and discipline, it shall inform the applicant of the decision to be made and the relevant facts, reasons and basis, and inform the applicant of the right to state and defend according to law. The competent department of civil servants, the recruitment agency or the examination institution that made the decision shall review the facts, reasons and evidence put forward by the candidates.
Article 14 If a decision is made on the handling of an applicant's violation of discipline and discipline, a Decision on Handling Violations of Discipline and Discipline in the Employment of Civil Servants shall be made and delivered to the applicant according to law.
Article 15 During the probation period, if the applicant is found to have violated the rules and regulations listed in these Measures, the recruitment agency at the central level or the competent department of civil servants at or above the municipal level with districts shall cancel the employment and deal with it accordingly in accordance with the relevant provisions of these Measures.
After post grading, if any violation of discipline and discipline listed in these Measures is found, it shall be dismissed or dismissed.
Sixteenth candidates should consciously maintain the order of examination and employment, obey the management of staff, and be ordered to leave the examination room if they have one of the following acts; If the circumstances are serious, it shall be handled in accordance with the provisions of Articles 7 and 8 of these Measures; Violation of the "People's Republic of China (PRC) Public Security Administration Punishment Law" shall be dealt with by the public security organs according to law; If the case constitutes a crime, criminal responsibility shall be investigated according to law:
(1) Deliberately disturbing the order of examination recruitment workplaces such as examination centers and examination rooms;
(2) Refusing or obstructing the staff to perform their management duties;
(3) Threatening, insulting, slandering or framing staff members or other applicants;
(four) other acts that disrupt the order of examination and employment management.
Seventeenth hiring staff in violation of relevant laws and regulations, or the provisions of Article 33 and Article 34 of the Regulations on the Employment of Civil Servants (Trial), shall be punished in accordance with the relevant provisions. Among them, civil servants who organize, plan or play a major role in organized cheating should be dismissed. If a crime is constituted, criminal responsibility shall be investigated according to law.
Eighteenth candidates who are dissatisfied with the decision to deal with violations of discipline and discipline may apply for administrative reconsideration or bring an administrative lawsuit according to law.
If the employed personnel are dissatisfied with the punishment due to violation of discipline and discipline, they may apply for review or lodge a complaint according to law.
Article 19 These Measures shall apply to the identification and handling of violations of discipline and discipline in the recruitment of staff of organs (units) managed by reference to the Civil Service Law.
Article 20 Measures for the administration of integrity files in civil service examination and employment shall be formulated by the central competent department of civil servants.
Article 21 These Measures shall come into force on June 20, 20 10. 11.9 The Measures for Handling Disciplinary Actions in Civil Servant Recruitment Examination (Trial) promulgated by Ministry of Human Resources and Social Security in 2009 (Ministry of Human Resources and Social Security Decree No.4) shall be abolished at the same time.
