Regulations of Shaanxi Province on Soil and Water Conservation
Chapter I General Provisions Article 1 In order to prevent and control soil erosion, protect and rationally utilize soil and water resources, mitigate floods, droughts and sandstorms, improve the ecological environment, promote the construction of ecological civilization, and ensure the sustainable development of economy and society, these Regulations are formulated in accordance with the Law of People's Republic of China (PRC) on Soil and Water Conservation and relevant laws and administrative regulations, combined with the actual situation of this province. Second units and individuals engaged in soil and water conservation activities or natural resources development and utilization, production and construction that may cause soil erosion within the administrative area of this province shall abide by these regulations. Article 3 The work of soil and water conservation shall follow the principles of prevention first, protection first, overall planning, comprehensive management, adjusting measures to local conditions, highlighting key points, scientific management and paying attention to benefits, and adhere to the principle that whoever develops and utilizes resources is responsible for protection, and whoever causes soil erosion is responsible for control and compensation. Article 4 The people's governments at or above the county level shall establish and improve the coordination mechanism of soil and water conservation, study and solve major problems of soil and water conservation, incorporate soil and water conservation into the national economic and social development plan at the corresponding level, ensure the special funds and working funds for soil and water conservation, and organize the implementation of the tasks determined in the soil and water conservation plan.

The people's governments at or above the county level shall establish and improve the target responsibility system for the prevention and control of soil erosion, incorporate soil and water conservation into the target responsibility assessment system, and assess, reward and punish the implementation of the responsibility system for soil and water conservation of subordinate departments and people's governments at the next lower level. Article 5 The water administrative department of the people's government at or above the county level shall be in charge of the work of soil and water conservation within their respective administrative areas.

The development and reform, land and resources, environmental protection, housing and urban and rural construction, transportation, agriculture, forestry, poverty alleviation and other departments of the people's governments at or above the county level shall, in accordance with their respective responsibilities, do a good job in the prevention and control of soil erosion. Article 6 People's governments at or above the county level shall encourage and support soil and water conservation institutions, institutions of higher learning, scientific research institutions and mass scientific and technological organizations to carry out scientific research, experimental demonstration, technology popularization, training, guidance and services on soil and water conservation. Seventh people's governments at or above the county level shall encourage and support social forces and private capital to participate in the prevention and control of soil erosion, give support in terms of funds, technology and taxation, and safeguard the legitimate rights and interests of participants in the prevention and control of soil erosion. Eighth people's governments at all levels and their relevant departments should strengthen the publicity and education of soil and water conservation, popularize scientific knowledge of soil and water conservation, and enhance public awareness of soil and water conservation.

The news media should publicize the public welfare of soil and water conservation, and primary and secondary schools should incorporate the basic knowledge of soil and water conservation into the educational content. Ninth units and individuals have the obligation to protect water and soil resources and maintain water and soil conservation facilities, and have the right to report the destruction of water and soil resources and water and soil conservation facilities.

After receiving the report, the water administrative department shall promptly investigate and deal with it and give feedback to the informant. Tenth people's governments at or above the county level shall commend and reward units and individuals that have made remarkable achievements in soil and water conservation. Chapter II Planning Article 11 The provincial water administrative department shall be responsible for organizing the investigation of soil erosion in this province. The investigation contents of soil erosion include distribution, type, area, causes, hazards and changing trends, prevention and control, benefits, etc. The survey results shall be reported to the water administrative department of the State Council for the record and announced to the public. Twelfth people's governments at or above the county level shall, according to the survey results of soil erosion, delimit and publish the key prevention areas and key control areas of soil erosion within their respective administrative areas.

Areas with more than 40% forest and grass coverage and less soil erosion, as well as areas with high potential risk of soil erosion such as Heyuan District, water conservation area, drinking water source area and basic farmland protection area, are designated as key areas for soil erosion prevention and control.

Areas with serious soil erosion, such as forest and grass coverage below 40%, moderate soil erosion and high population density, harsh natural conditions, fragile ecological environment, serious floods, droughts and sandstorms, dangerous areas of landslides and debris flow-prone areas, are designated as key areas for soil erosion control. Thirteenth water administrative departments at or above the county level shall, jointly with relevant departments, formulate water and soil conservation plans. Cross-regional or river basin water and soil conservation planning shall be compiled by the common water administrative department at the next higher level in conjunction with relevant departments and river basin management agencies, and shall be organized and implemented by the water administrative department after being approved by the people's government at the same level or its authorized department.

Comprehensive management of small watersheds, construction of warping dams, and land reclamation in ditches shall draw up special plans for soil and water conservation, which shall be compiled by the water administrative department at or above the county level in conjunction with relevant departments and implemented after being approved according to the examination and approval authority. The special plan for soil and water conservation shall conform to the plan for soil and water conservation.

The compilation of soil and water conservation plans and special plans for soil and water conservation shall solicit the opinions of experts and the public. Article 14 Where soil erosion may be caused during the implementation of infrastructure construction, mineral resources development, urban construction, public service facilities construction, land development and consolidation, industrial parks, cascade development of water elevators, tourist attractions, etc., the compilation unit shall put forward countermeasures and measures for soil erosion prevention and control, and obtain the consent of the water administrative department at the same level before the planning is submitted for examination and approval. Chapter III Prevention Article 15 People's governments at all levels shall strictly protect plants, sand shells, hard shells, lichens, etc. according to soil and water conservation plans and special plans, and take measures such as enclosure protection, natural restoration and returning farmland to forests (grasses). , strengthen the supervision and management of soil, sand, quarrying and other activities to prevent and reduce soil erosion.

It is forbidden to engage in activities that disturb the surface and induce geological disasters, such as earth borrowing, sand digging, mining and quarrying, in dangerous areas of landslides and areas prone to mudslides.
