Who should the beneficiary of enterprise annuity write?
It will be better for the beneficiary of enterprise annuity to write immediate family members. After all, according to the relevant provisions of the Trial Measures for Enterprise Annuities, if an employee who participates in enterprise annuities dies before retirement, the balance in the personal account of the employee's enterprise annuity will be collected by his designated beneficiary or legal heir. Therefore, it is better to fill in the immediate family members, and you can fill in the children, which can also prevent moral hazard.

And because the designated beneficiary must provide death certificate, cancellation certificate and other materials when receiving the enterprise annuity of the deceased employee. Moreover, these materials are generally more convenient for relatives to get, and it is difficult for non-relatives to get them. Therefore, filling in immediate family members is the best choice.

If there is no provision, the employee who participated in the enterprise annuity died unfortunately before retirement, and the legal heir who received the enterprise annuity is usually the child.

Connotation:

First, only employees who participate in the enterprise annuity plan are beneficiaries, and other employees who do not participate in the enterprise annuity plan are not beneficiaries;

Second, because an enterprise can have multiple annuity plans, the employees who participate in one annuity plan and enjoy the trust beneficiary right are not the beneficiaries of other plans, and the beneficiaries of other annuity plans may not become the beneficiaries of this plan;

Third, according to the relevant provisions of the Trust Law, employees who participate in the annuity plan will not lose their beneficial rights because they are people with limited or no civil capacity, but they are still qualified beneficiaries and enjoy the beneficial rights of enterprise annuities;

Fourthly, in view of the fact that China's trust law has no restrictive provisions on foreigners, employees of enterprises who are foreigners can also become qualified beneficiaries as long as they participate in the annuity plan.

Legal basis:

Article 63 of the Insurance Law of People's Republic of China (PRC), the insured or the applicant may change the beneficiary and notify the insurer in writing. After receiving the written notice of change of beneficiary, the insurer shall endorse the insurance policy. When the applicant changes the beneficiary, he must obtain the consent of the insured.
