Residential property as mentioned in this Law refers to houses for families to live in (including residential parts in the same building as other functional spaces) and their supporting facilities, equipment and related venues. Third residential property fire safety management should implement the principle of putting prevention first and combining prevention with elimination, and implement comprehensive management.
The fire safety management of residential property shall implement the fire safety responsibility system and implement the fire safety management standards of residential property. Article 4 The people's governments of cities, districts and counties (cities) shall strengthen the leadership over the fire safety management of residential properties, establish a work coordination mechanism, organize the fire safety inspection of residential properties, and implement the fire safety management responsibility of residential properties.
Neighborhood offices and township (town) people's governments shall incorporate the fire safety management of residential properties into the comprehensive management of grassroots society, establish and improve fire safety organizations, and implement fire safety management measures for residential properties. Fifth fire departments responsible for the supervision and management of residential property fire safety work, mainly perform the following duties:
(a) to guide and supervise the fire safety work of residential properties such as neighborhood committees, property service enterprises and micro fire stations;
(two) to accept complaints and reports of fire hazards, timely investigate and verify, and investigate and deal with them according to law;
(3) Organizing and directing on-site fire fighting and emergency rescue work;
(four) the organization of fire safety publicity, education and training of residential property;
(five) to provide technical guidance for emergency plan drills, fire fighting and life-saving skills training;
(six) other duties as prescribed by laws, regulations and rules.
Housing and urban-rural construction departments shall, in accordance with the relevant provisions of property management laws, regulations and rules, do a good job in fire safety management of residential properties; Other relevant departments and institutions shall, in accordance with their respective responsibilities, do a good job in the fire safety management of residential properties. Article 6 Property management industry associations shall formulate a convention on fire safety management of residential properties, and give play to the role of industry self-discipline. Seventh radio, television, newspapers, Internet and other news media should publicize the fire safety knowledge of residential properties, and supervise the rectification of fire hazards through public opinion. Eighth to encourage the use of Internet, Internet of Things and other information and intelligent technologies to improve the quality and level of residential property fire safety services. Article 9 Where residential property is entrusted to a realty service enterprise for management, the contents stipulated in the realty service contract shall comply with the relevant provisions on fire safety management.
Owners, property users, owners' congress, owners' committee and property service enterprises shall perform their fire safety responsibilities in accordance with relevant fire safety management regulations and contractual agreements. Article 10 A realty service enterprise shall perform the following fire safety responsibilities:
(a) to implement the responsibility system for fire safety, determine the personnel responsible for fire safety in each position, clarify the responsibilities of fire safety in each position, and formulate and implement the fire safety system, operating procedures and emergency plans;
(two) the establishment of volunteer fire brigade, at least once a quarter to carry out fire fighting and life-saving skills training, at least once a year to organize owners and property users to focus on the use of fire fighting facilities and equipment, fire fighting and safe evacuation of fire prevention publicity and drills;
(3) Conduct routine inspections on the common parts and shared fire-fighting facilities and equipment such as evacuation passages, safety exits and fire truck passages within the residential property management area, and conduct fire prevention inspections at least once a month to find and eliminate fire hazards in time, and keep the exits and passages unblocked and the fire-fighting facilities and equipment intact and effective;
(4) If there is a fire control room, it shall be equipped with automatic fire control system operators who have obtained the work license, and the fire control room shall be on duty 24 hours a day;
(five) regular maintenance of automatic fire control facilities, at least once a year to conduct a comprehensive inspection of automatic fire control facilities, to ensure the normal operation of fire control facilities;
(six) regularly carry out fire safety publicity and education training, set up fire warning signs, fire public service advertisements, fire windows and other fire knowledge publicity facilities in the residential property management area, and regularly update the publicity content according to the characteristics and conditions of the fire;
(seven) immediately report to the police when a fire is found, actively organize fire fighting, protect the fire scene, and assist in the investigation of fire accidents;
(eight) other duties as prescribed by laws, regulations, rules and fire technical standards.
If the residential property is not managed by the realty service enterprise, the owners' meeting, the owners' committee, the owners and the users of the property shall perform the duties of fire control safety specified in the preceding paragraph, and the neighborhood (village) committees shall strengthen the organization, guidance and supervision. Eleventh owners and property users shall perform the following fire safety responsibilities:
(a) to comply with the provisions on fire safety management and fire technical standards, to comply with the fire safety matters stipulated in the realty service contract, and to implement the decisions of the owners' congress and the owners' committee on fire safety management;
(two) to cooperate with the property service enterprises to do a good job in fire safety management and report fire hazards in a timely manner;
(three) do a good job in the fire safety of self-occupied houses, equipment and places, and timely investigate and rectify fire hazards;
(four) shall not destroy the scene of the fire, cooperate with the relevant departments to carry out the investigation of the cause of the fire;
(five) other duties as prescribed by laws, regulations, rules and fire technical standards.
