Legal analysis: If a school, kindergarten or other educational institution that has the obligation to educate, manage and protect minors according to law fails to perform relevant obligations within the scope of its duties, causing personal injury to minors or personal injury to others by minors, it shall bear the corresponding liability for compensation. If a third party causes personal injury to minors, it shall be liable for compensation. If schools, kindergartens and other educational institutions are at fault, they shall bear corresponding supplementary liability for compensation.

Legal basis: Article 120 1 of the Civil Law of People's Republic of China (PRC) (hereinafter referred to as "Civil Law"), if a person with no capacity for civil conduct or a person with limited capacity for civil conduct suffers personal injury from a third person during his study and life in a kindergarten, school or other educational institution, the third person shall bear the tort liability; Kindergartens, schools or other educational institutions that fail to fulfill their management responsibilities shall bear corresponding supplementary responsibilities. Kindergartens, schools or other educational institutions may claim compensation from third parties after assuming supplementary responsibilities.
