Regulations of Ningxia Hui Autonomous Region on Prevention of Duty Crimes
Chapter I General Provisions Article 1 These Regulations are formulated in accordance with the provisions of the Constitution and relevant laws and in light of the actual situation of the autonomous region, with a view to preventing duty crimes, strengthening and standardizing the work of preventing duty crimes, ensuring state functionaries to perform their duties according to law, promoting the building of a clean government and anti-corruption work, and promoting economic and social development. Article 2 These Regulations shall apply to the prevention of duty crimes by state organs, state-owned enterprises, institutions and people's organizations within the administrative area of the autonomous region. Article 3 The term "duty crimes" as mentioned in these Regulations includes crimes of corruption and bribery, crimes of dereliction of duty by state functionaries, crimes of violating citizens' personal rights and democratic rights by taking advantage of their powers, and other crimes. Article 4 The prevention of duty crimes shall adhere to the principle of treating both the symptoms and the root causes and comprehensive management, and establish and improve a duty crime prevention system that pays equal attention to education, system and supervision. Article 5 State organs, state-owned enterprises, institutions and people's organizations shall perform their respective duties, cooperate with each other and participate in the prevention of duty crimes. Chapter II Duties Article 6 State organs, state-owned enterprises, institutions and people's organizations are responsible for the prevention of duty crimes in their own units and systems and perform the following duties:

(a) to formulate the work plan for the prevention of duty crimes, improve the working mechanism, and organize the implementation;

(two) the implementation of laws, regulations and rules and regulations, strengthen management;

(three) establish and improve the internal management system of personnel and finance, and strengthen the supervision and management of positions and links prone to duty crimes;

(four) to educate the staff of the unit and the system on the prevention of duty crimes;

(five) accept the guidance, supervision and inspection of the relevant departments, and truthfully provide relevant information and materials;

(six) to supervise and inspect the work of the subordinate units to prevent duty crimes;

(seven) to investigate and deal with violations of discipline according to law, report cases in a timely manner and transfer them to procuratorial organs for handling according to law;

(eight) other duties to prevent duty crimes. Article 7 The people's procuratorates shall guide and supervise the prevention of duty crimes and perform the following duties:

(a) to supervise criminal proceedings, civil trial activities, administrative proceedings and criminal cases that are not transferred by administrative law enforcement organs according to law, and to put forward procuratorial suggestions and correct illegal opinions;

(two) to investigate the causes, characteristics and laws of duty crimes in relevant units, industries and systems, and put forward preventive countermeasures and measures;

(three) in conjunction with the relevant units and departments to carry out case prevention, systematic prevention and special prevention activities;

(four) combined with the legal supervision function of procuratorial organs and the cases of duty crimes investigated, to carry out publicity, education and consultation activities on the prevention of duty crimes;

(five) check the relevant units and departments to perform their duties of prevention, to carry out the work of preventing duty crimes, and put forward suggestions and opinions;

(six) to formulate the work plan for the prevention of duty crimes, and summarize and popularize the experience of preventing duty crimes;

(seven) other duties to prevent duty crimes. Eighth duty crime prevention work to implement the leadership responsibility system. The main persons in charge of units and departments shall take overall responsibility for the prevention of duty crimes, and other persons in charge shall assume direct leadership responsibility according to the division of labor. Article 9 State functionaries shall be fair, honest, conscientious, law-abiding and subject to supervision. When performing their duties, they shall not commit any of the following acts:

(a) the use of authority, in the selection and appointment of state staff, abuse of power for personal gain;

(two) using the influence of authority or position to interfere with the judicial organs or administrative organs to perform their duties according to law and seek personal gain;

(three) to intervene in market activities such as land use right transfer, property right transaction, real estate development and management, government procurement, etc. For personal benefit;

(four) to intervene in the bidding of construction projects or to seek benefits for individuals and groups in exercising the power of administrative examination and approval and arranging the use of funds;

(5) Receiving the currency, negotiable securities, payment vouchers and valuables of units and individuals;

(6) Taking advantage of his power and position to seek illegitimate interests for his spouse, children, relatives and friends and staff around him, or conniving at or shielding his spouse, children, relatives and friends and staff around him from violating the law;

(seven) loans, grants, loans or guarantees for others in violation of regulations;

(eight) breach of privilege, dereliction of duty, causing losses to the state, collective property and citizens' lives and property;

(nine) the use of authority to infringe upon the personal rights and democratic rights of citizens;

(ten) other illegal acts committed by taking advantage of their powers. Chapter III Education Article 10 State organs, state-owned enterprises, institutions and people's organizations shall provide ideological and moral education, professional ethics education, preventive methods education, system discipline education and legal education to state functionaries, so as to enhance their awareness of legal system and self-discipline. State functionaries should receive education on the prevention of duty crimes.

Culture, education, press and publication, radio and television, judicial administration and other departments should take various forms to carry out legal publicity and education, and promote all sectors of society to actively participate in the prevention of duty crimes. Eleventh duty crime prevention education adhere to the combination of comprehensive education and key education, pay attention to strengthen the education of leadership positions, key positions, important departments and key industries.
