Idle educational land
The land provided by the government to kindergartens free of charge belongs to the land use right obtained by allocation. According to Article 56 of the Land Management Law, "If a construction unit uses state-owned land, it shall use the land in accordance with the paid use contract such as land use right transfer or the approval document for land use right allocation". After obtaining the land use right according to law, the kindergarten shall start development and construction within the prescribed time limit (i.e. 1 year). In case of special circumstances, if the development and construction cannot be started within the prescribed time limit, the development and construction time can be extended after being approved by the people's government that originally approved the land, but the longest extension time shall not exceed 1 year. Without the consent of the people's government that originally approved the use of land, the construction land that has not started development and construction within the prescribed time limit shall be recognized as idle land. Kindergarten has been idle for 4 years without development and construction, which undoubtedly belongs to idle land. According to the Measures for Disposal of Idle Land, the people's government at or above the county level has the right to recover the land use right of the kindergarten without compensation if it has not been used for two consecutive years and has been approved by the original approval authority, and to re-transfer or transfer it to units and individuals that meet the allocation conditions. As for the government's recovery of the transfer to the factory, the problem that the factory construction brings security risks to kindergarten preschool education should be another matter. It is suggested that kindergartens report to the government or relevant government departments that the government or relevant government departments have the responsibility and obligation to urge the factory to eliminate the unsafe hidden dangers caused by construction in time to ensure the safety of kindergarten children's education.
