Measures of Wuhan Municipality on the placement and assistance of released prisoners and reeducation-through-labor personnel
Article 1 These Measures are formulated in accordance with the relevant provisions of the state and the province and in light of the actual situation of this Municipality, in order to standardize and strengthen the resettlement education of released prisoners and those released from reeducation through labor, prevent or reduce recidivism, and maintain social stability. Article 2 These Measures shall apply to the resettlement and assistance of released prisoners and persons released from reeducation through labor within the administrative area of this Municipality. Article 3 Persons released from prison and persons released from reeducation through labor shall enjoy equal rights with other citizens, perform civic duties and be free from discrimination. Article 4 The resettlement assistance and education work shall adhere to the principles of combining individualized measures with classified implementation, combining social resettlement assistance and education with family resettlement assistance and education with supervision places. Article 5 People's governments at all levels shall strengthen their leadership over the work of helping and educating immigrants, regard the work of helping and educating immigrants as an important part of implementing the responsibility system for comprehensive management of social security, formulate and organize the implementation of annual work plans and measures for helping and educating immigrants, and establish and improve the working system.

The municipal and district judicial administrative departments are in charge of resettlement education within their respective administrative areas.

Sub-district offices and township (town) people's governments shall be responsible for the resettlement education within their respective jurisdictions, and the daily work shall be undertaken by the judicial office.

All relevant departments, social organizations, news organizations, residents' committees, villagers' committees and other organizations and families should cooperate with each other to jointly do a good job in resettlement and education. Article 6 A judicial office shall perform the following duties of resettlement and assistance:

(a) according to the annual immigration work plan formulated by the people's government at a higher level, formulate and implement the local immigration work plan;

(2) Handling the relevant registration procedures for resettlement assistance and education;

(3) Handling and receiving letters and visits from released prisoners and reeducation-through-labor personnel;

(four) to guide and coordinate the resettlement work of relevant units and residents' committees and villagers' committees;

(five) do other work related to resettlement. Article 7 People's governments at all levels shall include the funds for immigrant assistance and education in the fiscal budget at the same level, which shall be used for special purposes, and no unit or individual may occupy, intercept or misappropriate them. Article 8 The judicial administrative department and the administrative department of labor and social security shall strengthen their contacts with prisons and reeducation-through-labor institutions, assist them in providing legal and moral education and guidance and relevant vocational and technical training to those who are about to be released from prison and released from reeducation through labor, and create conditions for their employment after returning to society. For prisoners and reeducation-through-labor personnel who have passed the unified examination, the administrative department of labor security shall issue certificates of completion and professional qualifications. Article 9 The district judicial administrative department and the public security department shall, within 7 days from the date of receiving the Notice of Released Persons or the Notice of Dismantling Reeducation-through-Labor Personnel, respectively notify the judicial office and the public security police station where the original household registration is located. After receiving the notice, the judicial office shall promptly notify the residents' committee or villagers' committee and their families, and do a good job in resettlement and education in accordance with the prescribed duties. Article 10 Persons released from prison and persons released from reeducation through labor shall, within 30 days from the date of receiving the Notice of Release from Prison or the Notice of Release from Reeducation through Labor, go to the judicial office and police station where the original household registration is located to go through the formalities of registration of resettlement assistance and education and household registration transfer.

When the judicial office handles the registration of resettlement assistance and education, it shall ask the released prisoners whether they have gone through the household registration procedures; For those who have not gone through the registration formalities in registered permanent residence, they shall be informed to go to the police station in accordance with the regulations, and be informed to go through the registration of resettlement assistance and education.

When registering in the household registration, the police station shall ask the released prisoners whether they have gone through the registration procedures for resettlement assistance and education; For those who have not gone through the registration procedures for resettlement assistance and education, they shall be informed to go to the judicial office in accordance with the regulations and inform the judicial office of the household registration.

For released prisoners and reeducation-through-labor personnel who have not gone through the formalities of resettlement assistance and education registration and household registration, the judicial office and the police station shall report to the higher authorities respectively. Article 11 Where an ex-convict lives outside his original domicile and needs to be resettled and assisted by the judicial office in his current domicile, the judicial office and police station in his original domicile shall, with the consent of the district judicial administrative department in his original domicile, hand over the relevant materials to the judicial office in his current domicile within 7 days, and the judicial office will implement the resettlement and assistance. Twelfth meet the conditions of schooling, resumption of schooling, education and reeducation through labor, and I request to continue to go to school, the education administrative department and the school shall approve their admission.

The administrative department of education shall allow released prisoners and reeducation-through-labor personnel who apply for admission to institutions of higher learning, secondary specialized schools and various vocational schools, and may apply for admission if they meet the admission requirements; Those who meet the prescribed admission standards shall be admitted without discrimination. Thirteenth released prisoners and reeducation-through-labor personnel in prison, reeducation through labor period and the original unit to retain labor relations, after the release or reeducation through labor by the original unit placement. Article 14 If a person released from prison or released from reeducation through labor is registered in the countryside before serving his sentence or reeducation through labor, and the contracted cultivated land continues to be contracted by his relatives during the period of serving his sentence or reeducation through labor, the villagers' committee shall adjust the contracted cultivated land to its own contracted cultivated land after returning to the village after serving his sentence or released from reeducation through labor; If the contracted cultivated land is managed by the villagers' committee, the villagers' committee shall arrange for it to continue the contracted operation after being released from prison or released from reeducation through labor and returning to the village; If the contracted responsibility field has been requisitioned, the contracted responsibility field shall be allocated separately; If the whole village land is no longer contracted or completely expropriated, it shall be properly placed in accordance with relevant regulations.
