Article 2 National defense education is the foundation of building and consolidating national defense and an important way to enhance national cohesion and improve the quality of the whole people.
Article 3 Through national defense education, the state enables citizens to enhance their national defense concepts, master basic national defense knowledge, learn necessary military skills, stimulate patriotic enthusiasm, and consciously fulfill their national defense obligations.
Article 4 National defense education adheres to the principles of participation by the whole people, long-term persistence and paying attention to practical results, implements the principles of combining regular education with centralized education, combining popular education with key education, and combining theoretical education with behavioral education, and determines the corresponding educational content for different objects to organize and implement.
Article 5 All citizens of People's Republic of China (PRC) have the right and obligation to receive national defense education.
Popularizing and strengthening national defense education is the common responsibility of the whole society.
All state organs, armed forces, political parties and social organizations, enterprises and institutions, and grass-roots mass autonomous organizations shall organize and carry out national defense education according to the actual conditions of their respective regions and units.
Article 6 the State Council leads national defense education. The Central Military Commission cooperated with the State Council to carry out national defense education for all.
Local people's governments at various levels shall lead the work of national defense education within their respective administrative areas. Resident military organs shall assist and support local people's governments in developing national defense education.
Article 7 Institutions of national defense education plan, organize, guide and coordinate national defense education.
The local institutions responsible for national defense education at or above the county level shall organize, guide, coordinate and inspect the national defense education within their respective administrative areas.
Eighth education, civil affairs, cultural propaganda and other departments are responsible for national defense education within the scope of their respective duties.
Departments of conscription, national defense scientific research and production, national economic mobilization, civil air defense, national defense transportation and protection of military facilities are responsible for national defense education in accordance with the provisions of this Law and relevant laws and regulations.
Trade unions, the Communist Youth League, women's federations and other relevant social organizations shall assist the people's governments in developing national defense education.
Article 9 The China People's Liberation Army and the Chinese People's Armed Police Force shall carry out national defense education in accordance with the relevant regulations of the Central Military Commission (CMC).
Article 10 The State supports and encourages social organizations and individuals to carry out activities beneficial to national defense education.
Article 11 The state and society shall commend and reward organizations and individuals who have made outstanding contributions in national defense education in various forms.
Article 12 The state establishes a national defense education day for all. Thirteenth national defense education in schools is the basis of national defense education for the whole people and an important part of implementing quality education.
The administrative department of education shall incorporate national defense education into the work plan, strengthen the organization, guidance and supervision of national defense education in schools, and regularly evaluate the national defense education in schools.
Fourteenth primary schools and junior high schools should incorporate the content of national defense education into relevant courses, combine classroom teaching with extracurricular activities, and carry out national defense education for students.
Conditional primary schools and junior high schools can organize students to carry out juvenile military school activities with the theme of national defense education. The administrative departments of education, the Communist Youth League organizations and other relevant departments shall strengthen the guidance and management of the activities of juvenile military schools.
Primary schools and junior high schools can hire off-campus counselors as needed to assist schools in carrying out various forms of national defense education activities.
Article 15 Institutions of higher learning, senior middle schools and schools equivalent to senior middle schools should combine classroom teaching with military training to educate students on national defense.
Colleges and universities should offer appropriate national defense education courses, senior middle schools and schools equivalent to senior middle schools should arrange special national defense education contents in relevant courses, and can carry out various national defense education activities among students.
Military training for students in institutions of higher learning, senior middle schools and schools equivalent to senior middle schools shall be organized and implemented by military training institutions of schools or military teachers in accordance with relevant state regulations. Military organs shall assist schools in organizing military training for students.
Sixteenth schools should incorporate national defense education into their work and teaching plans, and take effective measures to ensure the quality and effect of national defense education.
When organizing military training activities, schools should take measures to strengthen security.
Seventeenth educational institutions that undertake the task of training national staff should incorporate national defense education into their training plans and offer corresponding national defense education courses.
According to the needs, the state sends local and departmental leaders to relevant military academies for training, so as to learn and master the national defense knowledge necessary for performing leadership duties. Article 18 State organs shall, according to the nature and characteristics of their work, conduct national defense education for their staff in various forms.
State functionaries should have basic knowledge of national defense. State functionaries engaged in national defense construction must learn and master the national defense knowledge necessary for performing their duties.
* * * Members of all regions and departments shall perform the duties of organizing and leading their own regions and departments to carry out national defense education according to law.
Nineteenth enterprises and institutions should incorporate national defense education into the education plan for employees, and carry out national defense education for employees in combination with political education, professional training, culture and sports.
Enterprises and institutions undertaking tasks such as national defense scientific research and production, national defense facilities construction, and national defense transportation security shall formulate corresponding national defense education plans according to the tasks and conduct targeted national defense education for their employees.
Social organizations should carry out national defense education according to the characteristics of their respective activities.
Article 20 The people's armed forces departments of military regions, provincial military regions (garrison commands), military sub-regions (garrison commands), counties, autonomous counties, cities and municipal districts shall, in accordance with the relevant provisions of the state and the army, conduct national defense education for militia and reservists in combination with political education and organizational rectification, military training, performance of duties, conscription work and major festivals and anniversaries.
The national defense education of the militia and reserve personnel should focus on the backbone militia, the first type reserve personnel and the militia and reserve personnel who hold leading positions, establish and improve the system, and ensure the implementation of the educated personnel, education time and education content.
Article 21 Urban residents' committees and rural villagers' committees shall incorporate national defense education into the construction of socialist spiritual civilization in communities and rural areas, and carry out national defense education for residents and villagers in combination with conscription work, supporting the army and giving preferential treatment to its dependents and major festivals and anniversaries.
Urban residents' committees and rural villagers' committees may employ ex-servicemen to help carry out national defense education.
Twenty-second departments and units of culture, journalism, publishing, broadcasting, film and television should take various forms to carry out national defense education according to the requirements of the situation and tasks.
Radio stations, television stations, newspapers and periodicals of the central government and provinces, autonomous regions, municipalities directly under the Central Government and cities divided into districts shall set up national defense education columns or columns to popularize national defense knowledge.
Article 23 Martyrs' cemeteries, revolutionary sites and other museums, memorial halls, science and technology museums, cultural centers, youth palaces and other places with the function of national defense education shall provide convenience for citizens to receive national defense education, and offer preferential treatment or free of charge to organized national defense education activities; If it is named as a national defense education base in accordance with the provisions of Article 28 of this Law, it shall be open to organized primary and secondary school students free of charge; Open to the public free of charge on National Defense Education Day. Article 24 People's governments at all levels shall incorporate national defense education into the national economic and social development plan, and ensure the funds needed for national defense education in the financial budget according to the needs of developing national defense education.
Twenty-fifth state organs, institutions and social organizations to carry out national defense education funds, charged in the budget of the unit; The funds needed for enterprises to carry out national defense education shall be included in the staff education funds.
The funds needed for the school to organize students' military training shall be implemented in accordance with the relevant provisions of the state.
Article 26 The State encourages social organizations and individuals to donate property to finance the development of national defense education.
The property funded by social organizations and individuals for national defense education shall be managed by the national defense education fund established according to law or other public welfare social organizations.
The state encourages social organizations and individuals to provide or donate collected objects of national defense education significance. Users shall properly keep the physical objects provided for use and return them in time after use.
Twenty-seventh national defense education funds and property funded by social organizations and individuals must be used for national defense education, and no unit or individual may misappropriate or deduct them.
Article 28 A place specified in Article 23 of this Law may be named as a national defense education base with the approval of the people's governments of provinces, autonomous regions and municipalities directly under the Central Government if it meets the following conditions:
(1) Having a clear theme of national defense education;
(2) Having a sound management organization and rules and regulations;
(3) Having corresponding national defense education facilities;
(4) Having the necessary financial guarantee;
(five) has a significant social education effect.
National defense education base should strengthen construction, constantly improve and give full play to the function of national defense education. If the named national defense education base no longer meets the requirements specified in the preceding paragraph, its name shall be revoked by the original approval authority.
Twenty-ninth people's governments at all levels should strengthen the planning, construction and management of national defense education bases and provide necessary guarantees for them to play their roles.
People's governments at all levels should strengthen the collection, collation and protection of cultural relics of national defense education significance.
Thirtieth national defense education adopts a unified national defense education program. The outline of national defense education shall be formulated by the national defense education institution.
National defense education textbooks suitable for different regions and different types of education objects shall be compiled by the relevant departments or localities according to the national defense education syllabus and combined with the characteristics of their own regions and departments.
Thirty-first national defense education institutions at all levels shall organize and coordinate relevant departments to do a good job in the selection, training and management of national defense education teachers, and strengthen the construction of national defense education teachers.
Teachers of national defense education should be selected from those who love national defense education and have basic national defense knowledge and necessary military skills.
Article 32 The China People's Liberation Army and the Chinese People's Armed Police Force shall, according to needs and possibilities, send military teachers to the local area to organize national defense education activities, and provide necessary military training venues, facilities and other convenient conditions.
On National Day, China People's Liberation Army Army Day and National Defense Education Day, approved military camps can be opened to the public. Measures for the opening of military camps shall be formulated by the Central Military Commission (CMC). Article 33 State organs, social organizations, enterprises, institutions and other social organizations that refuse to carry out national defense education activities in violation of the provisions of this Law shall be criticized and educated by the relevant departments of the people's government or the higher authorities and ordered to make corrections within a time limit; Refuses to correct, resulting in adverse effects, the person in charge who is directly responsible shall be given administrative sanctions according to law.
Article 34 whoever misappropriates or deducts funds for national defense education in violation of the provisions of this law shall be ordered by the relevant competent department to return them within a time limit; The directly responsible person in charge and other directly responsible personnel shall be given administrative sanctions according to law; If a crime is constituted, criminal responsibility shall be investigated according to law.
Thirty-fifth occupation, destruction of national defense education base facilities, damage to exhibits, by the relevant competent departments to give criticism and education, and ordered to make corrections within a time limit; Relevant responsible personnel shall bear corresponding civil liabilities according to law.
One of the acts listed in the preceding paragraph, in violation of public security regulations, shall be punished by the public security organs according to law; If a crime is constituted, criminal responsibility shall be investigated according to law.
Thirty-sixth, disturb the order of national defense education work and activities, or steal the name of national defense education to defraud money, the relevant competent departments shall criticize and educate and stop it.
Article 37 State functionaries responsible for national defense education who neglect their duties, abuse their powers or engage in malpractices for selfish ends shall be given administrative sanctions according to law; If a crime is constituted, criminal responsibility shall be investigated according to law. Article 38 This Law shall come into force as of the date of promulgation.
