Measures of Jilin Province for the Administration of Tourism Safety
Article 1 In order to strengthen the management of tourism safety and ensure the personal and property safety of tourists, these Measures are formulated according to the actual situation of this province. Article 2 The term "tourism safety management" as mentioned in these Measures refers to the management activities involving the personal and property safety of tourists. Third units and individuals engaged in tourism safety related work within the administrative area of this province shall abide by these measures. Article 4 The tourism administrative departments of the people's governments at or above the county level shall be in charge of the tourism safety management within their respective administrative areas, and other relevant departments of the people's governments at or above the county level shall supervise and manage the tourism safety work according to their respective functions and duties. Article 5 Tourist hotels, travel agencies, travel companies, designated foreign-related business units of tourism, business units of tourist attractions and other enterprises and institutions engaged in tourism business (hereinafter referred to as tourism business units) shall be responsible for the following safety management of their own units:

(a) the establishment of full-time (part-time) safety management institutions or equipped with full-time (part-time) safety management personnel;

(two) to establish and improve the safety management system;

(three) to implement the responsibility of safety management to each department, post and employee;

(four) to carry out safety education and training for employees to improve their safety skills;

(five) adhere to the daily safety inspection work, timely eliminate unsafe hidden dangers;

(six) timely reporting of tourism safety accidents;

(seven) to assist the relevant departments to deal with the aftermath of tourism safety accidents. Article 6 A unit applying for tourism business must have a safety management organization or personnel, have a sound safety management system and be examined by the tourism administrative department at or above the county level. Those who fail to pass the examination shall not engage in tourism business. Article 7 The tourism safety review and acceptance conducted by the tourism administrative department must be completed within 30 days from the date of receiving the written application materials from the tourism business unit. There are safety management institutions or personnel, and the safety management system is sound, so they are allowed to engage in tourism business and notify the applicant in writing; Those who do not have the safety management organization or personnel and the management system is not perfect shall not engage in tourism business and notify the applicant in writing. If the unit applying for tourism business fails to receive the notice that the tourism administration department is not allowed to operate tourism business within the time limit, it can be regarded as that the tourism administration department agrees to operate tourism business. Eighth tourism business units must regularly check and maintain tourism safety facilities and equipment to ensure their safe operation.

No unit or individual may illegally damage tourist safety facilities and equipment. Ninth tourist hotels and designated restaurants shall, in accordance with the provisions of the relevant laws, regulations and rules on food hygiene, establish a health responsibility system and do a good job in food hygiene. Tenth tourist hotels must be equipped with fire fighting equipment and facilities in accordance with the provisions of relevant fire laws, regulations and rules, and do a good job in the fire fighting work of their own units. Article 11 When arranging tourists' sightseeing activities, travel agencies should make careful travel plans and take practical preventive measures against factors that may affect safety. Twelfth travel agencies should take good care of tourists' luggage, and when handing over to the relevant units, they should have complete handover procedures, clarify their responsibilities and prevent damage or loss. Thirteenth travel agencies must ensure the safety of the vehicles and boats used to arrange tourists' travel activities. A taxi boat shall sign a safe use agreement with the lessor to clarify the responsibilities. Fourteenth travel agencies should implement travel accident insurance in accordance with the relevant provisions of the state when receiving overseas tourists. Fifteenth units that use cars and cruise ships to carry out tourism business shall regularly maintain cars and cruise ships, and must conduct a comprehensive inspection before carrying out commercial transportation to ensure safety. Sixteenth tourists should strengthen their own safety precautions, pay attention to personal safety and take good care of property. Seventeenth found unfavorable factors or hidden dangers of accidents, anyone has the right to report to the local tourism administrative departments, other relevant departments and tourism business units. After receiving the report, the tourism administrative department, other relevant competent departments and tourism business units shall immediately take measures or urge the relevant units to take measures to eliminate unsafe factors and hidden dangers in time. Eighteenth tourism safety accidents, the relevant personnel shall immediately organize rescue, and shall promptly report to the local tourism administrative departments and public security, insurance and other relevant departments. Nineteenth tourism administrative departments at all levels and tourism business units must establish tourism safety accident files for inspection. Twentieth units and individuals in any of the following circumstances in the management of tourism safety shall be commended or rewarded by the local tourism administrative department:

(a) the tourism safety management system is sound, safety education is popularized, preventive measures are implemented, safety management is outstanding, and no safety accidents have occurred within 5 years;

(two) to help tourists in distress, or to protect the property of tourists from heavy losses;

(three) timely report the hidden dangers of accidents to avoid major accidents;

(four) made outstanding contributions in other aspects of tourism safety. Twenty-first in violation of the provisions of article sixth of these measures, without the tourism safety review of the tourism administrative department, engaged in tourism business without authorization, the tourism administrative department at or above the county level shall order it to immediately correct, and impose a fine of more than 5,000 yuan on 500 yuan.
