In enterprises, institutions and organs, manual workers and mental workers whose main source of livelihood is wages have the right to join and organize trade unions according to law, and no organization or individual may restrict or deprive them. Article 4 Trade unions must abide by and safeguard the Constitution, take the Constitution as the fundamental activity criterion, and carry out their work independently in accordance with the articles of association of the trade union.
Enterprises, institutions and organs shall collect reports, support trade unions to carry out their work according to law, and respect the legitimate rights and interests of trade unions. Trade unions shall support enterprises, institutions and organs in exercising their functions and powers according to law. Article 5 Trade unions organize and educate workers and staff to exercise their democratic rights in accordance with the provisions of the Constitution, laws and regulations, give full play to their role as masters, participate in the management of state affairs, economic and cultural undertakings and social affairs through various channels and forms, assist the people's government in its work, and organize workers and staff to participate in the democratic management and supervision of their own units in accordance with the provisions of laws and regulations. Article 6 Trade unions must keep close contact with workers, listen to and reflect their opinions and demands, care about their lives, help them solve their difficulties, serve them wholeheartedly and safeguard their legitimate rights and interests. Article 7 Trade unions shall mobilize and educate employees to be masters of their own affairs, cherish the property of the state and enterprises, observe labor discipline, and mobilize and organize employees to work hard to complete production tasks and work tasks.
Trade unions organize workers to carry out socialist labor competitions, carry out mass rationalization proposals, technological innovation and technical cooperation activities, improve labor productivity and economic benefits, and develop social productivity. Article 8 Trade unions shall educate workers in patriotism, collectivism, socialism, democracy, legal system, discipline and science, culture and technology, improve their ideological and moral, scientific and cultural, technical and professional qualities, and make them become workers with ideals, morality, culture and discipline. Article 9 Provincial and municipal Federation of Trade Unions shall develop friendly cooperation with local trade unions and industrial trade unions in various countries and friendly exchanges with trade unions in Hong Kong and Macao in accordance with the principles of independence, equality, mutual respect and non-interference in each other's internal affairs. Chapter II Trade Union Organizations Article 10 Trade union organizations at all levels shall be established in accordance with the principle of democratic centralism, and trade union organizations at higher levels shall lead trade union organizations at lower levels.
Trade union committees at all levels are democratically elected by the general assembly or the general assembly, and accept the supervision of the general assembly or the general assembly. Eleventh local trade unions at all levels or industrial trade unions can send personnel to grass-roots units that have not established trade union organizations, publicize the "People's Republic of China (PRC) Trade Union Law" and relevant laws and regulations, and guide and help the establishment of grass-roots trade unions. Article 12 The establishment of trade union organizations at all levels shall be approved by the trade union at a higher level.
When the local organizational system changes, the local Federation of Trade Unions will adjust accordingly; In case of merger or division of industries, industrial trade unions shall be merged or divided accordingly; When an enterprise terminates or a public institution or organ is revoked, the grass-roots trade union shall be revoked accordingly.
No unit or individual may revoke or merge trade union organizations at will. Thirteenth local Federation of trade unions and industrial trade unions at all levels have the status of social organizations as legal persons from the date of establishment.
Grass-roots trade unions have the legal person qualification stipulated in the General Principles of the Civil Law of People's Republic of China (PRC), and have the legal person qualification of social organizations after being confirmed by higher-level trade unions according to law. Article 14 The chairman and vice-chairman of a trade union shall be democratically elected according to the provisions of the articles of association of the trade union, and the term system shall be implemented, and they may be re-elected. During his tenure, he enjoys the treatment prescribed by the state. Those who no longer serve as the chairman or vice-chairman of the trade union at the expiration of their term of office shall be resettled according to relevant policies. Fifteenth trade union chairman, vice chairman of the term is not full, shall not be arbitrarily transferred from their posts. When it is really necessary to transfer due to work, a decision can be made only after obtaining the consent of the trade union committee at the same level and the trade union at the next higher level. Sixteenth enterprises, institutions and organs in accordance with the relevant provisions of the state with full-time and part-time trade union cadres, to ensure the smooth development of trade union work. Chapter III Rights and Obligations of Trade Unions Article 17 Trade unions of state-owned and collective enterprises and institutions shall organize and represent employees to participate in the democratic management of their own units, establish and improve the system of workers' congresses and other democratic management systems, and ensure employees' rights to exercise democratic management according to law.
The trade union at a higher level may send representatives to investigate the infringement of the legitimate rights and interests of employees by enterprises, institutions and organs affiliated to the trade union organization, and the relevant units and personnel shall provide assistance. Article 18 Trade unions shall supervise the implementation of labor laws and regulations by the masses on behalf of employees. Where an enterprise or institution violates labor laws and regulations and infringes upon the legitimate rights and interests of employees, the trade union has the right to require the enterprise or institution or the relevant department to deal with it severely. The unit or department responsible for handling the problem shall notify the trade union of the handling within fifteen days after the problem is handled.
Trade unions and their women workers' committees have the right to require enterprises and institutions to correct acts that violate laws and regulations protecting the special rights and interests of women workers.
