The Regulations on Continuing Education of Professional and Technical Personnel was discussed and passed at the 70th ministerial meeting in Ministry of Human Resources and Social Security on August 3rd, 20th15th, and is hereby promulgated, and shall come into force on June 5th, 20th/KLOC-0.

Provisions on continuing education of professional and technical personnel

Chapter I General Principles

Article 1 In order to standardize continuing education activities, safeguard the rights and interests of professional and technical personnel, and continuously improve the quality of professional and technical personnel, these Provisions are formulated in accordance with relevant laws and regulations and the provisions of the State Council.

Article 2 These Provisions shall apply to the continuing education of professional and technical personnel of state organs, enterprises, institutions and social organizations (hereinafter referred to as employing units).

Article 3 Continuing education should be guided by economic and social development and scientific and technological progress, centered on capacity building, focused on pertinence, practicality and foresight, and adhered to the principles of integrating theory with practice, teaching according to needs, paying attention to practical results and combining training with use.

Article 4 The employing unit shall guarantee the right of professional and technical personnel to participate in continuing education.

Professional and technical personnel should adapt to the needs of their posts and the requirements of career development, actively participate in continuing education, improve their knowledge structure, enhance their innovation ability and improve their professional level.

Article 5 The mechanism of joint investment by the government, society, employers and individuals shall be implemented in continuing education.

The funds required for professional and technical personnel of state organs to participate in continuing education shall be guaranteed in accordance with relevant state regulations. Enterprises and institutions shall, in accordance with laws, administrative regulations and the relevant provisions of the state, extract and use funds for employee education, and continuously increase the investment in continuing education funds for professional and technical personnel.

Sixth continuing education work to implement the overall planning, grading responsibility, classification guidance management system.

Ministry of Human Resources and Social Security is responsible for the comprehensive management and overall coordination of continuing education for professional and technical personnel throughout the country, formulating continuing education policies, preparing continuing education plans and organizing their implementation.

The local administrative departments of human resources and social security at or above the county level shall be responsible for the comprehensive management and organization of the continuing education of professional and technical personnel in this area.

The competent department of industry shall do a good job in the planning, management and implementation of continuing education in this industry according to law within the scope of their respective duties.

Chapter II Contents and Methods

Article 7 Continuing education includes public needs and professional subjects.

Public subjects include basic knowledge such as laws and regulations, theoretical policies, professional ethics and technical information that professional and technical personnel should generally master. Professional subjects include professional knowledge such as new theories, new knowledge, new technologies and new methods that professional technicians should master in their professional work.

Eighth professional and technical personnel to participate in continuing education time, the annual cumulative should not be less than 90 hours, of which, professional subjects are generally not less than two-thirds of the total hours.

Professional and technical personnel to participate in continuing education in the following ways, included in my continuing education hours:

(a) Attending training courses, seminars or refresher courses;

(two) to participate in relevant continuing education practice activities;

(three) to participate in distance education;

(four) to participate in academic conferences, academic lectures, academic visits and other activities;

(five) other ways in accordance with the provisions.

The specific measures for determining the mode and hours of continuing education shall be formulated by the administrative departments of human resources and social security of provinces, autonomous regions and municipalities directly under the Central Government.

Article 9 An employing unit may organize continuing education activities or participate in continuing education activities organized by its own industry in accordance with these regulations and in combination with its development strategy and job requirements, so as to provide convenience for its professional and technical personnel to participate in continuing education.

Article 10 Professional and technical personnel may, according to post requirements and career development needs, participate in continuing education activities organized by their own units, or use their spare time or working hours with the consent of the employing units to participate in continuing education activities organized by their own units.

Eleventh professional and technical personnel engaged in professional qualification certification in accordance with relevant laws and regulations, the employer shall provide protection for their participation in continuing education activities.

Twelfth professional and technical personnel with the consent of the employer, full-time or part-time to participate in continuing education activities, the employer shall pay wages, benefits and other benefits in accordance with relevant state regulations or agreements with workers.

If the employer arranges professional and technical personnel to participate in continuing education activities outside working hours, both parties shall agree on the way of cost sharing and related treatment.

Thirteenth employers can jointly carry out continuing education activities with production, teaching, scientific research and other units, and establish a continuing education model combining production, teaching, scientific research, projects, funds and talents.

Article 14 The state supports the continuing education of professional and technical personnel in key fields, special regions and key positions by implementing major talent projects and continuing education projects, talent training projects in special regions and counterpart support.

Chapter III Organization Management and Public Service

Fifteenth professional and technical personnel should abide by the relevant learning discipline and management system, and complete the required continuing education hours.

Professional and technical personnel bear all or most of the expenses of continuing education, and the employer shall not designate continuing education institutions.

Article 16 The employing unit shall establish an incentive mechanism linking the continuing education of professional and technical personnel with the use and promotion, and take the participation of professional and technical personnel in continuing education as an important basis for the assessment and post employment of professional and technical personnel.

The participation of professional and technical personnel in continuing education should be regarded as an important condition for the appointment of professional and technical posts or the declaration and evaluation of qualifications at the next higher level. Where the relevant laws and regulations stipulate that professional and technical personnel participate in continuing education as a necessary condition for the registration or filing of professional qualifications, such provisions shall prevail.

Seventeenth employers should establish a continuing education registration management system, record the types, contents, time and examination results of professional and technical personnel to participate in continuing education.

Eighteenth institutions of higher learning, scientific research institutes, large enterprise training institutions and other types of education and training institutions (hereinafter referred to as continuing education institutions) established according to law can provide continuing education services for professional and technical personnel.

Continuing education institutions should have places, facilities, teaching materials and personnel suitable for the purposes and tasks of continuing education, and establish and improve the corresponding organizational structure and management system.

Nineteenth continuing education institutions should conscientiously implement the continuing education teaching plan, open the scope, content, charging items and standards of continuing education to the public, establish teaching files, and truthfully issue certificates for professional and technical personnel to participate in continuing education according to the examination results.

Continuing education institutions can make full use of modern information technology to carry out distance education, form an open continuing education network, and provide convenient and efficient services for grassroots and front-line professional and technical personnel to update their knowledge structure and improve their ability and quality.

Twentieth continuing education institutions shall, in accordance with the principle of combining full-time and part-time jobs, employ professional backbones and experts and scholars with rich practical experience and high theoretical level to build continuing education teachers.

Twenty-first Ministry of Human Resources and Social Security shall, in accordance with the relevant provisions of the state, choose continuing education institutions with high training quality and good social benefits, and play a leading and exemplary role in continuing education, and build a national-level continuing education base for professional and technical personnel.

The local administrative departments of human resources and social security at or above the county level and the competent departments of relevant industries may, according to the actual situation, build regional and industrial continuing education bases for professional and technical personnel.

Article 22 The administrative department of human resources and social security shall, jointly with relevant industry authorities and industry organizations, establish and improve the public service system of continuing education, build a comprehensive service platform for public information of continuing education, and issue a guide to public and professional subjects of continuing education.

The administrative department of human resources and social security shall, jointly with the relevant industry authorities and industry organizations, strengthen the construction of courses and teaching materials system according to the different positions, categories and levels of professional and technical personnel, recommend excellent courses and teaching materials, and promote the sharing of high-quality resources.

Twenty-third human resources and social security administrative departments and related industry departments directly organize continuing education activities, which should highlight public welfare and shall not charge fees.

Where the administrative department of human resources and social security and the competent department of relevant industries entrust continuing education institutions to hold continuing education activities, they shall choose through bidding according to law, and sign a government procurement contract with the continuing education institutions to clarify the rights and obligations of both parties.

Encourage and support enterprises, institutions and industry organizations to hold public welfare continuing education activities.

Article 24 The administrative department of human resources and social security shall establish a statistical system for continuing education, make routine statistics and random statistics on the number, time and funds of continuing education, and establish a database for continuing education of professional and technical personnel.

Article 25 The administrative department of human resources and social security or the third-party evaluation agency entrusted by it may evaluate the effect of continuing education, and the evaluation results will serve as an important reference for the government to support related projects.

Twenty-sixth human resources and social security administrative departments shall supervise and inspect the implementation of these Provisions by employers and continuing education institutions according to law.

Chapter IV Legal Liability

Article 27 Where an employing unit violates the provisions of Articles 5, 11, 12, 15, paragraph 2, 16 and 17 of these Provisions, the administrative department of human resources and social security or the competent department of relevant industries shall order it to make corrections; If it causes damage to professional and technical personnel, it shall be liable for compensation according to law.

Article 28 If professional and technical personnel violate the provisions of Article 8, paragraph 1, and Article 15, paragraph 1, of these Provisions, fail to participate in continuing education without justifiable reasons, or violate the study discipline and management system during their study, the employing unit may give criticism and education, refuse to reimburse or request a refund of study fees according to the circumstances.

Twenty-ninth continuing education institutions in violation of the provisions of the first paragraph of article nineteenth, the administrative department of human resources and social security or the relevant industry departments shall be ordered to correct, and give a warning.

Article 30 If the administrative department of human resources and social security, the competent departments of relevant industries and their staff fail to perform their duties seriously or engage in malpractices for selfish ends, abuse their powers or neglect their duties in the management of continuing education, the competent department at a higher level or the supervisory organ shall order them to make corrections, and the directly responsible person in charge and other directly responsible personnel shall be dealt with according to the management authority.

Chapter V Supplementary Provisions (Supplementary Annex18192357260)

Article 31 These Provisions shall come into force as of 20 15 years 10/0/day. The Interim Provisions on Continuing Education of Professional and Technical Personnel in China issued by the former Ministry of Personnel (No.1995) shall be abolished at the same time.
