Defendant Wu Baoliang, male, was born in Xiaoxian County, Anhui Province on June 5, with the ID number of 34220 1 196065438. He used to be the deputy county magistrate, deputy secretary of the county party committee and county magistrate of Xiaoxian County, and lived in Room 2, Building 2, No.220 Xichang South Road, Nanguan Office, Yongqiao District, Suzhou City. Defendant Wu Baoliang was detained on September 4th, 20 12 on suspicion of accepting bribes. On the same day, he was criminally detained by Hefei Public Security Bureau, arrested with the approval of Anhui Provincial People's Procuratorate on September 4, 20 12, and arrested by Hefei Public Security Bureau on September 7, 20 12.

This case is under the jurisdiction of the People's Procuratorate of Anhui Province and investigated by the Anti-Corruption Bureau of our hospital. On 20 12 12 17, the investigation organ transferred the defendant Wu Baoliang to our hospital for examination and prosecution. After accepting the case, the court informed the defendant the next day that he had the right to entrust a defender, interrogated the defendant according to law, listened to the opinions of the defendant's defender and reviewed all the case materials. During the period, it was returned twice for supplementary investigation, and the time limit for examination and prosecution was extended according to law.

According to this law, it is hereby determined that:

During the period from 2003 to 20 12, the defendant Wu Baoliang took advantage of his position as deputy county magistrate, county magistrate, deputy secretary of the county party committee and secretary of the county party committee to seek benefits for others in engineering projects, land acquisition and demolition, and cadre adjustment, and illegally accepted other people's property totaling RMB 20.389 million, USD 42,000, shopping cards of RMB 64,000 and watches of RMB 35,000. The specific facts are as follows:

1.09 From 2009 to 20 10, Wu Baoliang received a total of RMB 9 million from Zhou Changqing, an individual builder in Xiaoxian County, and Wu Xiuzhi, general manager of Wang Wan Flour Group Co., Ltd. to help him buy and develop the old railway station plot in Xiaoxian County. In August 2008 and the first half of 2009, Wu Baoliang also received an Omega watch with a value of RMB35,000 and RMB50,000 from Wu Xiuzhi to help Wang Wan Flour Group declare the national debt project.

2. Li Ling, director of Xiaoxian Family Planning Commission, had a good relationship with Wu Baoliang from 20 10 to 20 12, and was supported in his work. A total of 50,000 yuan was given to Wu Baoliang for many times (including 20,000 yuan from Li Lingcheng and 20,000 yuan from Wang Zhonghua), and Wu Baoliang accepted it.

3. From 2006 to 20 1 1 year, Wu Baoliang received a total of RMB 482,000 from Sun Feng, the general manager of Xiaoxian Lianhua Supermarket, to help its enterprises to purchase commercial premises, declare projects and implement project site selection.

4. From 2008 to 20 10, Wu Baoliang received RMB 440,000 from Li Jianshe, the general manager of Linxian Linping Paper Company, for many times to help him get a bank loan and solve his friend's son's job.

5. From 2008 to 2009, Wu Baoliang accepted Huang Meizeng, the legal representative of Xiaoxian Yujian Real Estate Company, totaling 350,000 yuan to help his company develop the plot of Hushan Farmers' Market in Xiaoxian County.

6.？ From 2007 to 2008, Wu Baoliang repeatedly received RMB 338,000 from Ma Xiaojun, the legal representative of Xiaoxian People Real Estate Co., Ltd., to help his enterprise develop land in Xiguan, Longcheng Town, Xiaoxian County.

7.？ During the period from 20 10 to 20 1 1, Wu Baoliang received RMB 200,000 and USD 6,543,800,000 from Li Ruiyuan, the chairman of Xin Jinfeng Investment Group Co., Ltd. for three times, providing assistance to his enterprises in land acquisition and government loans.

8. From 2005 to 2009, Wu Baoliang received a total of RMB 270,000 from Hui Ding, the chairman of Suzhou Quangou Mining Company, for many times, providing help for its enterprise development and acquisition of coal mines.

9. From 2007 to 2009, Wu Baoliang received RMB 250,000 from Cheng Peng, the manager of the fourth branch of Xiaoxian Engineering Construction Corporation, for many times to help its enterprises to undertake projects and collect project funds.

10.20 10 One day in April, Cheng Zuwei, the chairman of Xiaoxian Song Xin Shoes Company, gave Wu Baoliang RMB 200,000 to get the support and help of investing in Xiaoxian, and Wu Baoliang accepted it. Later, before the Spring Festival of 20 12, Wu Baoliang returned the 200,000 yuan.

11.0 During the period from 2007 to 20 12, it received RMB 120,000 yuan and USD100,000 yuan from Meng, the legal representative of Xiaoxian Yongxing Construction Company, for many times, providing help for its enterprises to undertake projects and collect project funds.

12.from 2005 to 2006, Wu Baoliang received RMB170,000 yuan from Zhang quanxian, secretary of the Party Committee of Anhui Huaibei Shenghuo Mining Company, to help the development of Chaishan Coal Mine in Xiaoxian County operated by his wife and brother.

13. From 2007 to 2008, it received RMB160,000 yuan from Wang, the manager of Xiaoxian Construction Engineering Corporation, to help its enterprises collect project funds and other matters.

13. From 2007 to 20 10, it received RMB160,000 yuan from Sun, the chairman of Anhui Golden Corn Agricultural Science and Technology Development Company, to help its enterprise development, land certificate transfer and land use indicators.

During the period from 14.2008 to 20 10, Wu Baoliang accepted a total of150,000 yuan from Huang Chuanwu, the chairman of Xiaoxian Jinlong Real Estate Company, to help his enterprise develop clean land for the demolition of Century Home Community.

During the period from 15.2008 to 20 1 1, Wu Baoliang received RMB130,000 yuan from Zhang Shougang, the chairman of Suzhou Jinhuangzhuang Transportation Company, to provide help for the company's business development and land acquisition. 20 12 Before the Spring Festival, Wu Baoliang returned 50,000 yuan to Zhang Shougang.

16.from 2007 to 2008, Wu Baoliang accepted RMB130,000 yuan from Gao Jinlin, an individual businessman, and promised to help him in civil litigation and land development.

17.from 2008 to 2009, it received RMB120,000 yuan from Li, the chairman of Xiaoxian Oriental Glass Company, four times, providing assistance for its enterprise construction and loan application.

18. From 2005 to 2007, Wu Baoliang received RMB120,000 yuan from Li Xingdong, the original director of Xiaoxian Oriental Glass Factory, for many times to help its enterprise development and new site construction.

19.from 2007 to 2009, Wu Baoliang received RMB115,000 yuan from Li Xiangci, the legal representative of Xiaoxian Hualong Refractory Company, for many times, providing assistance for the land acquisition of its enterprises and the job transfer of its relatives.

20. From 2005 to 2006, Wu Baoliang received RMB 1 10000 yuan from Wang Bingzhong, the general manager of Xiaoxian Zhonghui Coal Company, for three times to help his enterprise to resume production.

21.In 2008, Wu Baoliang received RMB1.4000 yuan and a shopping card from Wu Xiue, the legal representative of Suzhou Jiangyuan Water Industry Company, twice, providing help for its production and operation.

One day after the Spring Festival in 22.20 10, Ma Jian, the general manager of Jiangsu Zhihong Logistics Company, gave RMB 654.38+million through Wang, and accepted it.

23. One day in March and April, 2005, he received RMB 654.38 million from Liu, the chairman of Anhui Longpan Company, to help his enterprise attract investment.

On the day of 24.20 1 1 year/month, Wu Baoliang accepted RMB 654.38+million from Huang Ke, the chairman of Suzhou qingda mining company, to help his company solve the mine and land disputes.

25. From 2008 to 2009, Wu Baoliang received RMB 90,000 from Tang Yi, an individual builder, to help him undertake projects in Xiaoxian County.

26. From 2007 to 2009, Wu Baoliang received a total of RMB 85,000 from Zhang Ciping, the chairman of Xiaoxian Jinge Noodle Company, to help its enterprise development and apply for subsidies.

27. From 2006 to 20 10, Wu Baoliang received a total of RMB 80,000 from Qiao Zhigang, manager of Anhui Ansha Real Estate Company of China Coal Sanjian Group, to help his company develop Fengshan Garden Community in Xiaoxian County.

28. From 2005 to 2008, Kun Wang, the general manager of Ke Rui Trading Company in Huainan City, gave Wu Baoliang a total of 70,000 yuan to win care and support for the development of the enterprise, which was later accepted by Wu Baoliang.

29. From 2003 to 20 1 1, Wu Baoliang received a total of 55,000 yuan from Wang Qingxi, the manager of Xiaogang Noodle Company in Xiaoxian County, to help him with the project payment, business operation and friends' work arrangement.

▲ 30. From 2008 to 20 10, Bao Baoliang accepted Xing Hua, director of Xiaoxian Sports Bureau, and his wife Wang Jianle, deputy director of Xiaoxian Health Bureau and director of CDC, totaling 280,000 yuan to help him to resume his work and adjust his post.

During the period from 3 1.08 to 20 1 1, Wu Baoliang received a total of RMB 284,000 (including RMB 24,000 from Liu Shanan and Wang Kui) and US$ 6,543,800, providing assistance for his work and personal promotion.

32. From 2004 to 20 1 1, Wu Baoliang received a total of RMB 244,000 from Li Ming, director of Xiaoxian government office, to help him with his work and personal promotion.

33. From 2004 to 20 1 1 year, Wu Baoliang received a total of 223,000 yuan from Hu Yongshu, a member of Xiaoxian People's Congress Standing Committee and director of Urban Construction Environmental Protection Committee, to help him and his relatives get promoted.

34. From 2004 to 20 12, he received a total of RMB 297,000 from the director of Xiaoxian Housing and Construction Bureau for many times (including RMB170,000 from Wang) to provide help for his work and job adjustment.

35. During the period from 2008 to 20 1 1, Wu Baoliang accepted Li Hua, member of the Party Committee of Xiaoxian Public Security Bureau and captain of the traffic police brigade, totaling 2 10000 yuan, to provide assistance for his work and personal promotion.

36. From 2008 to 2009, he received RMB 6,543.8 yuan+RMB 5,500 yuan from Zhu, Minister of the United Front Work Department of Xiaoxian County, for many times to help him in his work and personal promotion.

37. From 2003 to 20 1 1, Wu Baoliang received a total of RMB 228,000 from Cai Hui, Party Secretary of Huangkou Town, Xiaoxian County (including RMB 8,000 from Cai Hui and Li Zhongxin, RMB 20,000 from Du Guangyi and RMB 20,000 from Yan) to help him with his work and post adjustment.

38. During the period from 2005 to 20 1 1, Wu Baoliang received RMB130,000 yuan and USD100,000 yuan from Zhu Wei, the investment promotion director of Xiaoxian County, for many times to help him in his work and job adjustment.

39. During the period from 2003 to 20 1 1, Wu Baoliang received a total of RMB180,000 yuan from Jong Li, Party Secretary of Gu Yong Town, Xiaoxian County (including RMB 5,000 yuan from Li Zhongxin and Yu Deguang) to help him with his work and job adjustment.

40. From 2003 to 20 1 1 year, Wu Baoliang received a total of RMB177,000 yuan from Li Xianglong, director of Xiaoxian County Transportation Bureau, to help him adjust his post and build a facade house for his relatives.

During the period from 4 1.07 to 20 1 1, Wu Baoliang received a total of RMB177,000 yuan from Ou Yangfei, director of Xiaoxian Economic Development Zone, for many times, providing assistance for his work and job adjustment.

42. During the period from 2004 to 20 10, Wu Baoliang received RMB173,000 yuan from Wang Baoping, chairman of Xiaoxian Disabled Persons' Federation, for many times, providing help for his work development, personal and son's work adjustment.

43. During the period from 2004 to 20 1 1, Wu Baoliang received RMB162,000 yuan from Li Lezhong, deputy director of the Finance and Economic Committee of Xiaoxian People's Congress, for many times to help him with his work and job adjustment.

44. From 2004 to 20 1 1 year, due to work and job adjustment, Bu Baoliang accepted a total of RMB 16 1000 yuan from Xu and Peng Lingchang.

45. From 2006 to 20 10, Wu Baoliang received a total of RMB147,000 from Wei Guangxin, secretary of the Party Committee of Zulou Town, Xiaoxian County, to help him with his work, personal promotion and handling health emergencies.

46. From 2007 to 20 10, Wu Baoliang accepted a total of RMB130,000 yuan from Chang Qiang, secretary of the Party Committee of Datun Town, Xiaoxian County, and promised to provide help for his work and job adjustment.

47. From 2003 to 20 1 1 year, Wu Baoliang received a total of RMB122,000 yuan from Zhang Yucheng, director of Xiaoxian Radio and Television Station (including RMB122,000 yuan from Zhang Yucheng and Li Minghua, and RMB 5,000 yuan from Wang Bingjie) for his unit in financial allocation and equipment purchase.

On July and August of 201/kloc-0, Wu Baoliang accepted RMB 654.38+million from Shen Yan, director of the Bianhe Police Station in Yongqiao District, Suzhou City, to help him adjust his post.

49. From 2006 to 20 12, Wu Baoliang received 84,000 yuan (including 5,000 yuan jointly donated by Wang Bingjie and Li Minghua) from Wang Bingjie, deputy director of Xiaoxian Organization Department.

50. From 2004 to 2008, he received 72,000 yuan and 5,000 yuan gift cards from Zhu, the head of discipline inspection team of Xiaoxian Science and Technology Bureau, to help him adjust his rank and solve his father's salary relationship.

During May1.08 to October12, Wu Baoliang received 70,000 yuan in property from Shan Yanfa, director of Xiaoxian Public Security Bureau, to help him with his work.

52. From 2008 to 2009, Wu Baoliang received 70,000 yuan from Li Zhide, deputy director of Xiaoxian Housing and Construction Bureau, to help him adjust his rank.

53. From 2008 to 20 1 1, Wu Baoliang received 70,000 yuan from Zhu Yaguang, director of Xiaoxian Agriculture Committee, to help him promote himself.

54. During the period from 2007 to 20 10, he received a personal promotion fee of 60,000 yuan from Feng, the director of Xiaoxian Municipal Organs Administration Bureau.

55. During the period from 2003 to 20 10, he received RMB 59,000 from Chen Feng, director of Xiaoxian Grain Bureau (including RMB 30,000 from Chen Feng and Wang) for many times to help him with his work and job adjustment.

56. From 2004 to 20 12, Wu Baoliang received a total of 58,000 yuan and 20,000 yuan from Zhang Zhongcheng, a member of the Standing Committee of Xiaoxian People's Congress, to help him adjust his work.

57. From 2007 to 20 10, Wu Baoliang received RMB 5 10/00000 from Zhao Xu, the director of Xiaoxian Safety Supervision Bureau, for many times to provide assistance for his work and job adjustment.

58. During the period from 2005 to 20 1 1, Zheng Dongfang, director of the management committee of Huangcangyu National Forest Park in Xiaoxian County, received support from Wu Baoliang in his work, and gave him a total of 92,000 yuan for many times, and accepted his request. In 2009, Wu Baoliang received RMB30,000 from Zheng Dongfang's driver Tian Zhen to help Tian Zhen's son arrange work.

59. During the period from 2007 to 20 1 1, Chen and others, secretary of the Party Committee of Yanji Town, Xiaoxian County, gave a total of 58,000 yuan (including 44,000 yuan from Chen) for good relations, which he accepted.

60. During the period from 2003 to 20 1 1, the secretary of the Party Committee of Dulou Town in Xiaoxian County received support in his work in order to have a good relationship with him, and he successively gave a total of 9 1 10,000 yuan (including 24,000 yuan jointly given by He Ren) and accepted it.

61.During the period from 2007 to 20 1 1, Wujiang, director of Xiaoxian Civil Affairs Bureau, got support in his work and gave him RMB 90,000 several times, which he accepted.

62. During the period from 2007 to 20 1 1, Lu Bohua, director of Xiaoxian Coal Management Bureau, received support in his work in order to have a good relationship with Wu Baoliang, and gave him RMB 65,000 several times and accepted his request.

63. During the period from 2008 to 20 1 1, Sun Pu, director of Xiaoxian Water Conservancy Bureau, got support in his work and gave Wu Baoliang a total of 78,000 yuan (including 25,000 yuan from Sun Pu and Du Shangxun), which was accepted by Wu Baoliang.

64. During the period from 2003 to 20 10, Wang Kui, deputy head of Xiaoxian County, got support in his work in order to have a good relationship with Wu Baoliang, and gave him RMB 58,000 several times, which Wu Baoliang accepted.

65. From 2005 to 20 12, Zhong Wang Huawei, secretary of the Political and Legal Committee of Xiaoxian County, had a good relationship with Wu Baoliang and got support in his work. Wu Baoliang was given a total of/kloc-0.06 million yuan for many times (of which Wang Zhonghua and Jiang Cuiping jointly gave 0.6 million yuan), and Wu Baoliang accepted it.

66. During the period from 2003 to 20 1 1, Yu Deguang, director of Xiaoxian Forestry Bureau, was supported in his work in order to have a good relationship with Wu Baoliang, and gave him a total of RMB 6 10/0,000 several times, which was accepted by him.

67. From 2007 to 20 1 1 year, Wang Zhiyong, secretary of the Party Committee of Guanqiao in Xiaoxian County, won support in his work and gave him a total of 55,000 yuan (including 20,000 yuan for Wang Zhiyong and 20,000 yuan for Xia Mao) for many times, and accepted his request.

68. From 2007 to 20 1 1 year, Li Wei, secretary of the Party Committee of Xiaoxian County, got good relations and received support in his work and job adjustment. He gave a total of 65,000 yuan for many times (including 25,000 yuan from Li and Zheng Yuhang) and accepted his request.

69. During the period from 2003 to 20 1 1, Li Minghua, chairman of Xiaoxian Federation of Trade Unions, got support in his work in order to have a good relationship with Wu Baoliang, and gave him a total of 85,000 yuan many times, which he accepted.

The total amount is RMB 54,000, which has been accepted by Wu Baoliang.

70. During the period from 2007 to 20 1 1, Zhang Ping, director of Xiaoxian Economic and Information Technology Committee, received support in his work and job adjustment in order to have a good relationship with Wu Baoliang, and gave him a total of 62,000 yuan for many times and accepted his request.

71.From 2003 to 20 1 1, Chen Anyuan, the chairman of Xiaoxian CPPCC, got support in his work in order to have a good relationship with Wu Baoliang, and gave him a total of 57,000 yuan many times, which he accepted.

72. During the period from 2003 to 20 1 1, Wang Anmin, vice chairman of Xiaoxian CPPCC, got support in his work and gave him a total of 66,000 yuan (including 50,000 yuan from Wang Anmin and Peng Lingchang) for many times, which was accepted by Wu Baoliang.

73. During the period from 2007 to 20 1 1, Zhu Yishu, deputy director of Xiaoxian County People's Congress, won support in his work, and repeatedly gave Wu Baoliang a total of 78,000 yuan (including 65,000 yuan from Zhu Yishu and Wu Shuping), which Wu Baoliang accepted.

74. During the period from 2006 to 20 10, Mao Wei, Party Secretary of Xiaoxian Development and Reform Commission, gave him 70,000 yuan (including 5,000 yuan from Mao Wei and Wang Biao) in order to build a good relationship with Wu Baoliang and win his support in his work, and accepted his request.

The evidence for ascertaining the above facts is as follows:

1. Documentary evidence such as the process of bringing the case to justice, household registration certificate, employment documents, business license and project agreement; 2. Testimony of witnesses Liang Shangmin, Zong, Jiang, and others; 3. The defendant's confession and defense; 4. Physical evidence watches, etc.

Our court believes that the defendant Wu Baoliang, as a national staff member, took advantage of his position to illegally accept other people's property totaling RMB 20.389 million, US$ 42,000, shopping cards worth RMB 64,000 and watches worth RMB 35,000, so as to seek benefits for others. His behavior violated the provisions of Articles 383, 385 and 386 of the Criminal Law of People's Republic of China (PRC). The facts of the crime are clear and the evidence is indeed sufficient. According to the provisions of Article 172 of the Criminal Procedure Law of People's Republic of China (PRC), if a public prosecution is initiated, please be sentenced according to law.
