The calculation base of overtime pay is the normal attendance monthly salary corresponding to the employee's post, excluding special circumstances such as year-end bonus, commuting allowance, working meal allowance, housing allowance, night shift allowance, summer high temperature allowance and overtime pay. Specifically determined according to the following principles:
(1) If the monthly salary of the employee is clearly stipulated in the labor contract, it shall be determined according to the monthly salary corresponding to the position of the employee as stipulated in the labor contract; If the actual performance is inconsistent with the labor contract, it shall be determined according to the monthly salary corresponding to the employee's actual performance.
(2) The monthly salary of the laborer is not clearly stipulated in the labor contract, and if the monthly salary corresponding to the post is stipulated in the collective contract (special collective contract for wages), it shall be determined according to the monthly salary corresponding to the post stipulated in the collective contract (special collective contract for wages).
