Measures of Shaanxi Province on Implementing the Vocational Education Law of People's Republic of China (PRC)
Chapter I General Provisions Article 1 These Measures are formulated for the implementation of the Vocational Education Law of People's Republic of China (PRC) and in light of the actual situation of this province. Article 2 These Measures shall apply to vocational education within the administrative area of this province. Except as otherwise provided by laws and regulations.

The term "vocational education" as mentioned in these Measures includes vocational school education at all levels and various forms of vocational training. Article 3 Vocational education is an important part of national education and an important way to promote economic and social development and employment.

To implement vocational education, we must implement the national education policy, educate the educated in ideological and political education and professional ethics, impart professional knowledge, cultivate professional skills, provide vocational guidance, and comprehensively improve the quality of the educated. Article 4 Citizens have the right to receive vocational education according to law.

Laborers should receive necessary vocational education before taking up employment or taking up their posts. Article 5 People's governments at all levels shall incorporate the development of vocational education into the national economic and social development plan, promote the reform of vocational education, optimize the allocation of educational resources and promote the development of vocational education.

Industry organizations, enterprises and institutions shall fulfill their obligations to implement vocational education according to law. Article 6 The education administrative department of the people's government at or above the county level shall be responsible for the overall planning, comprehensive coordination and macro-management of vocational education within its administrative area.

The relevant administrative departments of education, labor and social security shall be responsible for the relevant work of vocational education according to their respective responsibilities. Seventh people's governments at or above the county level shall commend and reward units and individuals that have made remarkable achievements in vocational education. Chapter II Implementation of Vocational Education Article 8 Vocational school education is divided into primary, secondary and higher vocational school education:

(1) Primary vocational school education refers to the vocational education implemented on the basis of primary education and combined with compulsory education in junior high school, which mainly trains people with primary professional knowledge and practical skills;

(2) Secondary vocational school education refers to high school vocational education implemented on the basis of junior secondary general education, including general secondary specialized schools, technical schools, vocational secondary specialized schools and vocational high schools, which mainly trains intermediate professional and technical personnel, managers and operators;

(3) Higher vocational school education refers to the vocational education in the higher education stage implemented on the basis of senior secondary education, which mainly trains high-tech applied talents in the front line of production, construction, management and service. Article 9 Vocational school education should focus on secondary vocational school education, actively develop higher vocational school education and develop primary vocational school education according to local conditions.

To develop vocational school education, we should make full use of existing educational resources. Article 10 Vocational training includes pre-job training, on-the-job training, job-transfer training, job-transfer training and other vocational training. According to the vocational classification and vocational qualification grade standards stipulated by the state, vocational training is divided into primary, intermediate and advanced vocational training.

To carry out vocational training, it should be carried out in a multi-channel, multi-level and multi-form manner according to the demand of market labor force and the promotion of new technologies and new processes. Eleventh people's governments at or above the county level shall take measures to run vocational schools, vocational training institutions and county-level vocational education centers with leading and exemplary functions, promote the development of rural vocational education, and support the development of vocational education in remote and poor areas. Article 12 The competent government departments and industry organizations shall formulate the vocational education plans of their own systems and industries, organize or jointly organize vocational schools and vocational training institutions, organize, coordinate and guide enterprises and institutions in their own systems and industries to organize vocational schools and vocational training institutions, and supervise and inspect their teaching quality and school-running benefits. Article 13 Enterprises and institutions shall provide employees with on-the-job training, job transfer training and other vocational training in a planned way. Fourteenth to encourage and support social organizations, other social organizations and individual citizens in accordance with the relevant provisions of the state and the province's social forces to run schools, vocational schools, vocational training institutions. Fifteenth the establishment of vocational schools and vocational training institutions must meet the basic conditions stipulated by laws and regulations.

The establishment of a vocational school shall be examined and approved in accordance with the following provisions:

(a) primary vocational schools, declared by the competent department of the school or the school-running unit, audited by the education administrative department at the county level and reported to the people's government at the same level for examination and approval;

(two) vocational high schools, declared by the school authorities or school units, audited by the municipal (regional) education administrative department, and reported to the municipal (regional) people's government for approval;

(III) Vocational secondary specialized schools shall be declared by the school authorities, audited by the education administrative department of the city (region) and submitted to the education administrative department of the province for examination and approval;

(4) Ordinary secondary specialized schools shall be declared by the people's government of the city (region) or the relevant administrative departments of the province, audited by the administrative department of education of the province, and submitted to the provincial people's government for examination and approval;

(five) technical schools, declared by the organizers, audited by the provincial planning department in conjunction with the administrative department of labor and social security, and approved by the provincial planning department;

(six) higher vocational schools shall be declared by the municipal (regional) people's government or the relevant administrative departments at the provincial level, audited by the provincial education administrative departments, and reported to the provincial people's government for examination and approval.

The establishment of vocational training institutions shall be examined and approved by the administrative departments of labor and social security, education and other relevant administrative departments in accordance with the division of responsibilities.

Without approval according to law, no unit or individual may set up vocational schools and vocational training institutions.
