The term "private training schools" as mentioned in these Measures refers to private schools such as specialized schools and training centers organized by social organizations or individuals other than state institutions for the society (hereinafter referred to as cultural private training schools) and private schools that do not have the qualification to independently issue academic certificates (hereinafter referred to as skill private training schools).
These Measures shall not apply to the management of pre-school education registered in the administrative department for industry and commerce, private schools with independent qualifications for issuing academic certificates, and operating private training institutions. Article 3 The municipal education administrative department shall be in charge of the management of private training schools in the whole city. District and county (city) education administrative departments are responsible for the management of private training schools within their respective jurisdictions.
City, district, county (city) administrative department of labor and social security in accordance with the provisions of relevant laws and regulations and these measures, responsible for the management of skilled private training schools within the scope of their duties.
Civil affairs, institutional registration, price, taxation, industry and commerce, quality and technical supervision and other administrative departments shall, in accordance with their respective statutory duties, do a good job in the relevant management of private training schools. Article 4 The management of private training schools shall follow the principles of active encouragement, strong support, correct guidance and management according to law. Fifth private training schools should implement the national education policy, run schools according to law, ensure the quality of education and teaching, train qualified personnel, and accept the supervision and management of the relevant administrative departments.
The trade associations of private training schools should play the role of industry representatives, industry self-discipline, industry service and industry coordination, standardize the school-running behavior of private training schools, and safeguard the legitimate rights and interests of private training schools.
Encourage and support trade associations of private training schools to explore the establishment of a risk margin system for private training schools, implement the responsibility of running private training schools, and protect the legitimate rights and interests of students. Chapter II Establishment, Change and Termination of Private Training Schools Article 6 To apply for the establishment of a private training school, the following conditions shall be met:
(1) Social organizations that run private training schools shall have the qualifications of legal persons, and individuals that run private training schools shall have political rights and full capacity for civil conduct;
(2) It has a standardized name, and the establishment of the board of directors, the Council or other forms of decision-making bodies [hereinafter referred to as the board of directors] meets the requirements of laws and regulations;
(3) Having legal start-up funds and stable sources of funds;
(4) Having a school place suitable for the scale of running a school, equipped with facilities and equipment that meet the needs of education and teaching activities and necessary living and safety facilities;
(5) Having qualified full-time principals (hereinafter referred to as principals), qualified full-time education and teaching administrators and full-time teachers;
(6) Having the school's articles of association, development plans, teaching plans and relevant management systems. Article 7 The establishment of a cultural private training school shall meet the following standards:
(a) the start-up capital is not less than 6.5438+0 million yuan;
(two) the total construction area of the school building is not less than 500 square meters, of which the teaching space is not less than two-thirds of the total construction area of the school building, and the lease period of the school building is not less than 3 years; School buildings shall comply with the provisions of relevant laws, regulations and rules on planning, fire protection, sanitation and housing safety;
(three) the principal has a professional and technical position above the intermediate level or a bachelor's degree or above, and has been engaged in education management for more than 5 years;
(four) there are more than two full-time education and teaching managers with college degree or above and more than three full-time teachers with corresponding teacher qualifications.
Where there are other provisions of the state and province on the standards for the establishment of cultural private training schools, those provisions shall prevail. Article 8 The establishment of a skilled private training school shall meet the following standards:
(a) start-up capital of not less than 600 thousand yuan;
(two) the office space is not less than 50 square meters, and the area of the centralized teaching place for theoretical courses is not less than 300 square meters; Lease school buildings for a term of not less than 3 years; School buildings shall comply with the provisions of relevant laws, regulations and rules on planning, fire protection, sanitation and housing safety;
(four) the principal has a college degree or above, with intermediate professional and technical positions or national vocational qualifications above the third level, and has more than 2 years of vocational education and training experience;
(five) there are more than five full-time education and teaching management personnel, who should have a college degree or above, and have a professional and technical position at or above the intermediate level or a national vocational qualification at or above the third level, and have more than two years of vocational education and training experience;
(6) There are 1 above vocational guidance personnel engaged in vocational guidance and employment service training, and there are more than 2 financial management personnel with accounting personnel qualifications;
(seven) there are full-time and part-time teachers with corresponding teacher qualifications, suitable for the scale of running a school and reasonable structure. The number of internship instructors is not less than half of the total number of teachers, and the number of full-time teachers is not less than a quarter of the total number of teachers; Among them, the theoretical teachers who undertake advanced vocational skills training should have bachelor degree or above, intermediate professional and technical positions and more than 3 years of teaching experience in this major, and the internship instructors should have more than 2 national vocational qualifications and more than 3 years of teaching experience in this major (type of work); Theoretical teachers who undertake vocational skills training below the intermediate level should have college degree or above in related majors, professional and technical positions above the junior level and more than 2 years of teaching experience in this major (type of work), and practical guidance teachers should have national vocational qualifications above the third level and more than 2 years of teaching experience in this major (type of work).
