Measures of Chengdu Municipality on the Administration of Kindergartens
Chapter I General Provisions Article 1 (Purpose Basis)

In order to standardize kindergarten management and promote the healthy development of preschool education, these measures are formulated in accordance with the Education Law of the People's Republic of China, the Law on the Promotion of Private Education in People's Republic of China (PRC) and the Regulations on Kindergarten Management in the State Council, combined with the actual situation in Chengdu. Article 2 (Scope of Application)

These Measures shall apply to the establishment, conservation education, supervision and management of all kinds of kindergartens within the administrative area of this Municipality. Article 3 (System of Running Gardens)

The city follows the principles of public welfare and inclusiveness, and establishes a garden-running system with government-led, social participation and public and private participation. Article 4 (Development Requirements)

The people's governments of all districts (cities) and counties should put preschool education into the priority development category of education, increase the proportion of public kindergartens, support the development of inclusive private kindergartens, expand the coverage of public preschool education, and build a development pattern of preschool education with public financial investment as the main body and public kindergartens as the main body. Article 5 (Responsibilities of Departments)

The administrative department of education is responsible for the management of kindergartens within their respective administrative areas.

Development and reform (price), finance, construction, health, civil affairs, food and drug supervision and other administrative departments are responsible for the relevant work of kindergarten management within the scope of their respective duties. Article 6 (Planning and Layout)

City and district (city) county education administrative departments shall, jointly with the urban and rural planning administrative departments, organize the preparation of special plans for the spatial layout of kindergartens, and report them to the people's government at the same level for approval before implementation. Chapter II Establishment and Revocation Article 7 (Conditions for Establishment)

The establishment of kindergartens shall conform to the educational development plan of this Municipality and meet the following conditions:

(1) Having an organization and articles of association that meet the requirements;

(two) there are qualified teachers, nurses, health care, security, accounting and other personnel;

(three) there are places, facilities and equipment for conservation and education that meet the requirements;

(4) Having necessary funds for running schools and a stable source of funds;

(five) other conditions stipulated by laws, regulations and rules.

To apply for the establishment of a kindergarten, the establishment procedures shall be handled in accordance with relevant laws, regulations and rules. Article 8 (Personnel Requirements)

Kindergarten staff shall meet the following conditions:

(a) the director should have a college degree or above, obtain a kindergarten teacher qualification certificate, have more than five years of experience in preschool education, and obtain a kindergarten director qualification training certificate;

(two) full-time teachers should have a kindergarten teacher qualification certificate;

(three) health care personnel shall abide by the provisions of the state on the management of health care in kindergartens;

(4) Nurses should have graduated from high school or above;

(five) accounting personnel and canteen employees should be required to show certificates;

(six) security personnel shall meet the conditions prescribed by the state and pass the relevant business skills assessment.

All kinds of staff shall participate in the training according to law and obtain the training certificate.

All kindergarten staff must hold corresponding health certificates in accordance with state regulations and have a regular physical examination at least once a year. Patients with chronic infectious diseases, mental patients and those with a history of mental illness are not allowed to work in kindergartens. Article 9 (License Registration)

The district (city) county education administrative department shall, after accepting the application for running the park, send a copy of the setting of the kindergarten canteen to the local food and drug supervision and management department, and make a decision on whether to approve it within 20 working days from the date of accepting the application.

After obtaining the license for running a private kindergarten, it shall register with the relevant administrative departments such as civil affairs according to law. Public kindergartens and kindergartens with state-owned assets engaged in public welfare services may be registered as legal persons of public institutions in accordance with relevant regulations.

If a kindergarten adds a branch park, it shall go through the licensing formalities in accordance with the provisions of the newly established kindergarten.

Kindergarten license to implement the annual inspection system, the district (city) county education administrative department shall announce the annual inspection results to the public.

No unit or individual may hold a kindergarten without obtaining the permission to run the park. Article 10 (termination of change)

If the kindergarten changes the sponsor, name, address and other matters or the kindergarten is terminated, it shall report to the original examination and approval authority for the change or cancellation procedures. The examination and approval authority shall, within fifteen working days from the date of accepting the application, complete the formalities and disclose the relevant information.

Apply for the termination of the kindergarten, the organizer shall properly place the children in the kindergarten, and pay off the debts according to law. Chapter III Protection and Education Article 11 (Educational Protection Activities)

Kindergarten should adhere to the combination of conservation and education, follow the age characteristics of preschool children and the law of physical and mental development, and promote the healthy and happy growth of children.

Kindergartens should take games as the basic form of activities, and should not teach primary school teaching content in advance by centralized teaching, or carry out activities that violate the laws of children's physical and mental development, or organize children to participate in commercial activities.

Without the consent of the local education administrative department, kindergartens are not allowed to suspend classes and have holidays without authorization. Article 12 (Environmental Sanitation)

After the completion of kindergarten construction and decoration, the environmental monitoring report issued by the local environmental protection department should be provided and publicized to parents. Newly established kindergartens shall submit the health assessment report issued by the health administrative department to the district (city) county education administrative department in accordance with the kindergarten health care standards before enrollment.
