Examination and approval authority of private education
Article 27 of the Education Law stipulates that the establishment, alteration and termination of schools and other educational institutions shall go through the formalities of examination and approval, registration or filing in accordance with relevant state regulations. Article 11 of the Law on the Promotion of Private Education stipulates that the establishment of private schools that implement academic education, preschool education, self-study exams and other cultural education shall be examined and approved by the education administrative department of the people's government at or above the county level in accordance with the authority prescribed by the state; The establishment and implementation of vocational qualification training and vocational skills training in private schools shall be examined and approved by the administrative department of labor and social security of the people's government at or above the county level in accordance with the authority prescribed by the state, and copied to the education administrative department at the same level for the record.

Schools that organize the implementation of higher vocational and technical college education shall be submitted to the provincial people's government for examination and approval after being examined and approved by the provincial education administrative department; Schools that organize and implement other higher education shall be audited by the provincial education administrative department, and reported to the education administrative department of the State Council for examination and approval with the consent of the provincial people's government;

The establishment of higher training schools with higher education self-study examination, correspondence education counseling and continuing education as the main contents, and the implementation of secondary professional education shall be examined and approved by the provincial education administrative department;

Schools that organize and implement high school education and schools that implement secondary professional education but do not have the qualification to issue secondary school diplomas shall be examined and approved by the municipal and state education administrative departments;

Schools and kindergartens that implement junior high school and primary school education but do not have the nature of primary training will issue academic certificates, which will be examined and approved by the education administrative department of the county (city, district);

Educational institutions that organize and implement short-term training shall be examined and approved by the administrative department of labor and social security. Except for educational institutions that organize and implement vocational qualification training, technical level training and employment vocational skills training, other educational institutions shall be examined and approved by the administrative department of education at the same level;

Schools that hold special industries such as health and sports must be approved by the competent department of the same industry and reported to the education administrative department for examination and approval.

The examination and approval authority shall not approve the application for the formal establishment of a private school under any of the following circumstances:

(a) social organizations or individuals to run private schools do not meet the conditions prescribed by laws and administrative regulations, or public schools that implement compulsory education are converted into private schools;

(two) to raise funds from students and their parents to set up private schools or raise funds from the public to set up private schools;

(three) do not have the corresponding conditions for running a school, can not meet the corresponding standards;

(four) the articles of association of the school do not conform to the provisions of these regulations, and are still not amended after being told;

The composition of the school board of directors, the board of directors or other decision-making bodies does not meet the statutory requirements, or the school principals, teachers and accountants do not have the statutory qualifications and still do not correct after being told.
