1. Teachers who physically punish students can be punished as follows: teachers of schools and other educational institutions at all levels who physically punish students, if they do not change after education, shall be given administrative sanctions or dismissed by their schools, other educational institutions or educational departments in accordance with the existing teacher management authority. The types of administrative sanctions include: warning, demerit recording, demerit recording, demotion, dismissal and dismissal. There are two kinds of dismissal: the termination of the post employment contract and the arrangement of other jobs by schools or other educational institutions; Teachers' employment contracts are terminated, and those who are dismissed find other jobs.
2. Legal basis: Article 37 of the Teachers Law of People's Republic of China (PRC).
Teachers in any of the following circumstances shall be given administrative sanctions or dismissed by their schools, other educational institutions or educational administrative departments.
(a) deliberately not to complete the task of education and teaching, resulting in losses to education and teaching;
(two) corporal punishment of students, the education is invalid;
(three) bad conduct, insulting students, bad influence.
If a teacher falls under any of the circumstances listed in Items (2) and (3) of the preceding paragraph and the circumstances are serious enough to constitute a crime, he shall be investigated for criminal responsibility according to law.
Second, do teachers punish students for breaking the law for money?
It is illegal for teachers to punish students with money. Because fines are administrative penalties, only law enforcement departments have the power to enforce the law. Teachers are only staff members of public institutions and cannot have the right to enforce the law. Teachers have no right to impose fines on students, which are generally imposed by administrative organs. Moreover, according to the relevant regulations, teachers are not allowed to physically punish students. If the circumstances are serious enough to constitute a crime, criminal responsibility shall be investigated according to law.
