Regulations on the administration of industrial accidents
I. Purpose

Standardize the management of work-related injuries and work-related injury insurance, timely and reasonably handle work-related injuries, prevent and control the occurrence of work-related injuries, standardize work-related injury handling procedures, improve employees' awareness of safety in production, and minimize the risk of work-related injuries of the company and employees.

Second, the applicable object:

Applicable to all employees who have passed pre-job training and work in the company.

Three. accountability

(a), the general manager is responsible for the overall leadership of the company's work-related injury management.

(2) The company's full-time security officer is fully responsible for the construction and implementation of the company's safety management system; Leading the investigation and report writing of industrial accidents; Cooperate and supervise the work-related injury management.

(3) The leaders of each department (workshop) are fully responsible for the work-related injury management of their own departments (workshops).

(4) The leaders of all departments (workshops) should take effective measures to control the rate of industrial accidents.

(5) The Administration Department is responsible for handling work-related injury insurance for new employees (formally employed) and handling reimbursement procedures according to relevant information provided by various departments (workshops).

(6) All departments (workshops) shall not conceal or falsely report industrial accidents, control and reduce the rate of industrial accidents, and actively cooperate with the administrative department and company leaders to investigate and handle industrial accidents.

Iv. Identification of work-related injuries:

Work-related injury identification shall be implemented in accordance with the relevant provisions of the state on work-related injury insurance.

(a), employees in any of the following circumstances, it shall be recognized as work-related injuries:

1, accidentally injured due to work reasons at time and workplace;

2, before and after working hours in the workplace, engaged in work-related preparations or finishing work by accident;

3. Being injured by violence and other accidents during working hours and workplaces due to the performance of duties;

4. Suffering from occupational diseases;

5. When going out to work, he is injured due to work reasons or the whereabouts of an accident are unknown;

6. Being injured by a traffic accident that is not my main responsibility or an urban rail transit, passenger ferry or train accident on the way to and from work;

7. Other circumstances that should be recognized as work-related injuries as stipulated by laws and administrative regulations.

(2) An employee shall be regarded as a work-related injury in any of the following circumstances:

1, died of sudden illness or died within 48 hours after being rescued;

2. Injured in activities such as emergency rescue and disaster relief to safeguard the interests of the company and the state.

(three), one of the following circumstances, not included in the scope of work-related injuries:

1, intentional crime;

2. Drunk or taking drugs;

3. Self-mutilation or suicide;

4. The casualties are caused by the company's explicit prohibition.

5. Other circumstances stipulated by laws and administrative regulations.

Verb (abbreviation of verb) Handling of industrial accidents

(1) When an employee suffers from work-related injuries, the department team leader shall keep the site and notify the company safety officer, the administrative department minister and the department leader within 30 minutes. The Administration Department will arrange vehicles to transport the injured employees to the designated hospitals for work-related injuries and medical insurance for treatment (the seriously injured employees will be sent to Tangxia People's Hospital or Ruian Human Resources and Social Security Department in writing, and the draft will be reviewed and issued by the Administration Department, copied to the workshop director and team leader of each department manager, and copied to the general manager's deputy general manager's hospital with the theme of work-related accidents and safety management system). Minor skin injuries, such as cuts and scratches, will be bandaged in the workshop office, and the heavier ones will be designated to see a doctor in Luo Feng Health Center, and the "safety officer and administrative department minister" will decide whether to go to the hospital according to the injury).

(2) The full-time security officer of the company lends the medical expenses of the injured employees to the Finance Department, and goes through the admission and discharge procedures.

(3) On the day of work-related injury, the full-time safety officer of the company should do a good job in accident injury investigation, understand the process of employee injury, analyze the cause of the accident, clarify the responsibility for the accident, and fill in the accident investigation report form within 2 working days and submit it to the Administration Department. Pay attention to neat and clear handwriting, accurately, concisely and clearly describe the accident, and fill in the names and contact information of more than three references in the remarks column.

(4) The administrative assistant of the administrative department shall go through the work-related injury registration formalities within three days in accordance with the regulations of the state on work-related injury insurance. (For serious accidents, all reporting procedures must be completed within 12 hours.)

(5) The administrative assistant of the administrative department shall fill in the Application Form for Work-related Injury Identification according to the reported Accident Investigation Report Form, and submit it to the Municipal Labor and Social Security Bureau for identification within 30 days from the date when the employee is injured (major accident shall be reported within 3 days).

(6) The Administration Department is responsible for the identification of work-related injuries and the treatment plan after medical treatment, and reports it to the leaders in charge of the company for review.

(VII) Employees must go to the designated work-related injury medical institution or other places designated by the company for treatment after work-related injuries. If you don't go to the designated medical institution or designated place for treatment, all the expenses incurred will be borne by yourself.

(8) If an employee is injured at work and is not disabled, he/she shall immediately report the medical proof materials and expense documents to the Administration Department (submit them to the Finance Department for reimbursement) after the medical treatment is terminated; One month after the "medical appraisal", the disabled went to the administrative department to ask for the results. And cooperate with the administrative department to handle all kinds of work-related injury closing procedures.

(nine) the work-related injury identification materials

1. Identity card, medical record card or copy of medical record card of the accident person;

2. Medical invoices, medication lists, diagnosis certificates, outpatient medical records, hospitalization files, discharge certificates, CT report forms and other materials issued by the hospital.

3, due to the performance of their duties by violence, the need to submit proof of the public security organs or the people's court verdict and other valid proof;

4. If you are injured by traffic accidents or other accidents due to work reasons when you go out to work, you need to submit the Travel Application Form or the original proof materials that can prove that you are going out to work and the proof materials that prove the reasons for your work while you are out; During the period of going out to work, if the whereabouts of an accident are unknown, a written ruling declaring death by the people's court shall be submitted;

5. If you are injured by a motor vehicle accident on your way to and from work, you need to submit a schedule of work and rest, a normal road map from the unit to the place of residence, a letter of responsibility from the traffic management department of the public security organ or other valid certificates; If an individual drives a motor vehicle and a traffic accident occurs, he needs a motor vehicle driver's license;

6 in emergency rescue, disaster relief, rescue and other activities to safeguard national interests and public interests, it is necessary to submit the relevant certificates issued by the unit or the civil affairs department and public security department of the county government; The diagnosis certificate of the hospital and the appraisal conclusion of the labor appraisal Committee after the recurrence of the old injury;

Intransitive verb paid downtime:

After an industrial accident, the time when employees need to stop working and receive industrial injury treatment is paid downtime (that is, industrial injury medical treatment period).

(1) The paid term of employees with work-related injuries shall be confirmed by the labor and social security administrative department of the local government according to the local Regulations on the Classification of Paid Workers and the diagnosis certificate issued by the medical machine.

(2) The paid suspension period generally does not exceed 12 months. In case of serious injury or special circumstances, it may be appropriately extended after being reported to the local labor appraisal committee for appraisal and confirmation, but the extension time shall not exceed 12 months.

(3) If it is necessary to carry out disability appraisal after the paid shutdown expires, regardless of whether the disability appraisal results are reported or not, they shall resume their jobs.

Seven, the classification of industrial accidents:

(1) Minor injury accident: refers to an accident in which physical, chemical, biological and other external factors act on the human body, causing certain damage or partial dysfunction of tissues and organs, and resting for more than one working day after injury, which does not constitute serious injury but does not belong to minor injury.

(2) Serious injury accident: refers to an accident that causes physical disability, disfigurement, hearing loss, loss of vision, loss of other organ functions or other injuries that have great harm to personal health, and meets one of the circumstances listed in the national standards for serious injury identification.

(3) Fatal accident: refers to an accident with death 1 person and less than 3 people (excluding).

(4) Major fatal accident: refers to an accident in which three people (inclusive) died at one time.

Eight, employees during the shutdown, wage payment standard is:

When the work-related injury is identified, during the paid work-related injury shutdown, the salary standard is the average payment salary of 65,438+2 months in February before the work-related injury. The company divides the accident into two situations, one is caused by factors other than my own force majeure, and the other is personal responsibility for some operational mistakes. According to the severity of work-related injuries, employees are compensated according to the following standards:

(1) The accident was not caused by force majeure or my own fault;

Bear the corresponding rescue expenses according to the compensation standard of one-time industrial injury pension stipulated by the state.

(2) The accident is recognized as a work-related injury due to my negligence or non-compliance with operating procedures;

(3) If it can't be recognized as a work-related injury, the company will not bear the medical expenses and wages, and the company that buys accident insurance can make claims for it, and the physical therapy expenses and lost time expenses will be settled by the insurance company.

(4) If the employee violates the safety operation rules or disobeys the work arrangement of the superior, which causes losses to the company, the company will not bear any responsibilities other than compensation for work-related injury insurance, and at the same time, the company reserves the right to impose administrative and economic penalties on the employee according to the degree of damage caused to the company's interests by the behavior of the parties concerned.

(5) Handling of the accident parties after the work-related injury safety accident:

1. The company reserves the right to investigate the property losses caused by its negligence;

2. Employees who have lost more than 5,000 RMB due to negligence will be dismissed by the company; If there is special approval from the chairman/general manager, it shall be implemented according to the instructions of the chairman.

3. The department heads at all levels have the leadership responsibility for the work-related injury accidents in their own departments. If any work-related injury accident happens to its employees, it shall be handled according to the Regulations on Work-related Injury Rewards and Punishment.

(six) do not send workers with work-related injuries to pick them up separately for re-examination, dressing change and discharge. The company can bear the transportation expenses incurred and reimburse them according to the invoice. The transportation expenses incurred by the administrative assistant in handling work-related accidents and other personnel accompanying the employees with work-related injuries to the hospital shall be borne by the company and reimbursed according to the invoice.

Nine, the responsibility system for production safety

(I) General Manager's Safety Responsibility The general manager is the first person in charge of the company's safety production and is fully responsible for the safety production of the enterprise. Specifically:

1, conscientiously implement the national guidelines, policies, decrees and instructions from superiors, and put occupational safety and health work on the important agenda of enterprise management. It is necessary to personally preside over important occupational safety and health work meetings, review the safety-related documents of superiors, and issue major decisions on occupational safety and health work.

2, responsible for the implementation of the responsibility system for production safety at all levels. Supervise and inspect the heads of all departments to do a good job in production safety.

3. Improve safety management institutions and enrich full-time and part-time safety technical management personnel. Listen to the work report of the safety supervision department regularly, and study and solve or approve major issues related to safety production in time.

4, organize the examination and approval of enterprise safety rules and regulations, safety technical regulations and major safety technical measures, to solve the cost of safety measures.

5. Organize the investigation and handling of major accidents according to the principle of "three-no pass" in accident handling.

6, strengthen the leadership of various safety activities, decided to important rewards and punishments in safety.

(II) In charge of the safety responsibilities of the vice president, the vice president of production is the person directly responsible for the company's safety production. In accordance with the principle that whoever is in charge is responsible, be responsible for production safety within the business scope of the supervisor, and do the following work well:

1. Adhere to the principle of "five simultaneities", supervise and inspect the implementation of various occupational safety and health rules and regulations by competent departments, and promptly correct dereliction of duty and violations.

2. Organize to formulate and revise the safety rules and regulations, safety technical regulations and safety technical measures plan of the competent department, and seriously organize their implementation.

3. Organize the safety inspection within the business scope, implement the rectification of major accident hidden dangers, and be responsible for the approval of hot work at all levels.

4, organize the competent department to carry out safety production competition activities, summarize and promote the advanced experience of safety work, and reward advanced units and individuals.

5, responsible for the safety education and assessment work in charge of the department.

6. Organize the competent department to report the accident investigation and handling to the superior safety competent department and report to the superior in time.

7. Hold regular safety work meetings of competent departments, analyze the trends of safety production, and solve the problems existing in safety production in time.

(III) Safety responsibilities of workshop director The workshop director is fully responsible for the safety production of the unit, and his responsibilities are:

1. Ensure that the laws, regulations, instructions and relevant rules and regulations of the state and enterprises on production safety are implemented in workshops and departments, put occupational safety and health work on the agenda, and achieve "five simultaneities".

2, organize the formulation and implementation of workshop safety management rules and regulations, safety operation procedures and safety technical measures plan.

3. Organize workshop safety education and safety group education for new workers (including interns and trainees); Regularly educate employees on safety ideas, safety knowledge and safety technology; Carry out on-the-job technical training; Organize regular safety technical assessment; Organize and participate in safety group activity days, and handle the opinions put forward by workers in time.

4. Organize a safety inspection of the whole workshop every day, implement hidden dangers rectification, ensure that production equipment, safety equipment, fire-fighting facilities, protective equipment and first-aid equipment are in good condition, and educate employees to strengthen maintenance and use them correctly.

5. Organize various safety production activities, summarize and exchange experience in safety production, and commend advanced teams and individuals.

6. For the timely reporting and handling of accidents in this workshop, we should adhere to the principle of "three passes", pay attention to protecting the site, find out the reasons, distinguish the responsibilities, take preventive measures, put forward handling opinions for those responsible for the accidents, and report them to the competent department for approval before implementation.

7, responsible for organizing the implementation of hot work safety measures.

8, establish and improve the workshop safety management network, equipped with qualified safety technical personnel, give full play to the role of workshop and safety team.

9. Strictly implement the distribution standards of labor protection articles and the regulations that labor protection articles must be worn when entering production posts.

(4), team leader safety responsibilities

1. Implement the instructions and requirements of enterprises and workshops for safety production, and be fully responsible for safety production.

2. Organize employees to learn and implement the safety production rules and regulations and safety technology operating procedures of enterprises and workshops, educate employees to abide by the law and stop illegal behaviors.

3. Organize and participate in safety group activity days and other safety activities, and adhere to safety before class, safety inspection during class and safety summary after class.

4, responsible for new workers (including interns, trainers) post (team level) safety education.

5, responsible for security team inspection, found that unsafe factors in a timely manner to eliminate, and report to the superior. Make detailed records, participate in accident investigation and analysis, and implement preventive measures.

6. Do a good job in inspection and maintenance of production equipment, safety equipment, fire control facilities, protective equipment and first aid equipment, so as to keep them in good condition and normal operation. Supervise and educate employees to use labor protection articles and appliances reasonably and use fire-fighting equipment correctly.

7, do a good job in safety team production competition, in recognition of advanced, sum up experience.

8. Pay special attention to team building and improve team management. Keep the production site clean and tidy, realize civilized production, and do a good job in ideological and political work of the team.

(5), equipment and technical personnel safety responsibilities

1, responsible for production safety within its own scope, and ensuring the safety and reliability of all technical work.

2, responsible for the preparation of the professional safety technical rules and regulations and management system. Reliable safety and health technical measures should be taken when preparing the plan for starting, stopping or equipment maintenance and technical transformation, and the implementation should be checked.

3. Conduct training on safety operation technology and safety production knowledge for employees within the professional scope, organize technical training activities and conduct regular assessment.

4, often in-depth on-site inspection of production safety, found hidden dangers of accidents in a timely manner to put forward measures to eliminate them. Stop illegal operations. In case of emergency, those who don't listen to dissuasion have the right to stop working and immediately request the leadership to deal with it.

5. Participate in the design review and completion acceptance of new and expanded workshops; Participate in the review of equipment modification and process condition change scheme to make it meet the safety technical requirements.

6, to participate in accident investigation and analysis, find out the reason, distinguish responsibility, put forward preventive measures, and timely report to the leadership or the competent department at a higher level.

7, equipment maintenance, shutdown, construction plan, do a good job of disclosure before construction.

(6), the safety production responsibilities of employees

1. Abide by labor discipline, implement safety rules and regulations and safety operation procedures, obey orders and fight against all illegal operations.

2. Ensure that the equipment and tools in the workplace of this post are safe and tidy, do not dismantle the safety protection devices at will, do not use mechanical equipment that should not be used, and use protective equipment correctly.

3, learn safety knowledge, improve the level of operation technology, actively carry out technological innovation, put forward reasonable suggestions, improve the working environment and working conditions.

4, timely reflect and deal with unsafe problems, and actively participate in accident rescue work.

5. Have the right to refuse to accept the illegal command, and criticize or accuse the wrong decision of the superior unit and its responsible person and the behavior of ignoring the safety and health of employees.

(7), the company full-time security officer safety responsibilities

1. Under the leadership of the vice president of production, the safety supervisor of the company is responsible for the safety technical work in the production workshop, carrying out the instructions and regulations of the superior on safety production, and inspecting and supervising the implementation. Accept the guidance of the superior safety supervision department in business, have the right to report directly to the superior safety technical supervision department, and give professional guidance to the team safety officer.

2. Be responsible for or participate in the formulation and revision of the company's relevant safety production management system and safety technology operating procedures, and check the implementation.

3, responsible for the preparation of the company's safety technical measures plan and hidden dangers rectification plan, timely report to the company and check the implementation.

4. Assist workshop leaders to do a good job in safety education and assessment of workers' safety ideas and safety technology, be responsible for the first-level safety education of new employees, and supervise and inspect the second-level and third-level safety education of workshops and teams (posts).

5. Be responsible for arranging and checking the activities of the safety team, and often organize anti-accident drills.

6. Participate in the design review, completion acceptance of the company's new construction, reconstruction and expansion projects, review the equipment modification and process condition change scheme to meet the occupational safety and health technical requirements, and implement the safety measures for equipment maintenance, shutdown and start-up.

7. Be responsible for the management of the company's safety equipment, fire fighting equipment, protective equipment and first aid equipment; Master the workshop working environment and put forward suggestions for improvement.

8, every day to in-depth on-site inspection, timely find hidden dangers, stop illegal operations. In case of emergency, those who don't listen to dissuasion can stop working and immediately report to the leaders for handling. Check and implement hot work safety measures to ensure hot work safety.

9. Participate in the investigation and handling of all kinds of accidents in the company, make statistical analysis and report on time.

10, improve the basic information of safety management, complete, practical and standardized.

X. reward and punishment measures for work-related injuries:

1. Accidents caused by poor supervision by on-site management personnel will be treated as warning, minor mistake, major mistake and demotion according to the degree of injury of employees.

2. In the absence of any instructions from the superior, the company will truthfully report the injury process and causes to the social security department, which will handle the whole incident without any compensation.

3. Employees who suffer work-related injuries due to illegal operation will be fined the bonus of the current month (the bonus amount of piecework personnel will be determined separately).

4. safety award (there is no safety accident in the responsible unit/area in that month) is rewarded and punished by the safety officer every month according to the work-related injury report of that month, and reported to the general manager for approval, and then reported to the finance department for inclusion in the salary of the responsible person in that month.

5. If an industrial accident occurs and the amount of industrial injury treatment is within 200 yuan, the company will bear all the expenses and will not be punished; If the processing amount exceeds 200 yuan, the corresponding management personnel shall pay the corresponding punishment according to the above table.

6. The inspector shall be the vice president of production, safety officer and above, and conduct routine and irregular inspections. If violations are found, a penalty sheet shall be issued. Then the department head and the following management personnel deduct the corresponding bonus according to the regulations; If the head of the department finds violations, the source ticket will be issued, and the following personnel will deduct the bonus according to the rules, and so on.

Matters not covered in this scheme shall be stipulated separately or refer to the corresponding provisions of other laws and regulations. The power of interpretation belongs to the administrative department, which will be promulgated and implemented after being approved by the general manager, and the same is true when it is revised.
