I. Registration
(1) Registration conditions.
1. Persons who meet the following conditions may register for the national judicial examination:
(1) has China nationality;
(two) support the constitution of People's Republic of China (PRC), enjoy the right to vote and be elected;
(3) Having full capacity for civil conduct;
(4) graduated from a law major in an institution of higher learning, or graduated from a non-law major in an institution of higher learning with legal professional knowledge (the degree of legal professional knowledge that a non-law major institution of higher learning should have is not required for the time being);
(5) Good conduct.
According to the Ministry of Justice's Opinions on Determining the Place of Relaxing the Qualification for the National Judicial Examination (Sifatong [2007] No.38) and the Notice of the General Office of the State Council on the Policy Scope of Revitalizing the Old Industrial Bases in Northeast China and Developing the Western Region in Six Central Provinces (Guo Ban Han [2007] No.2), autonomous counties (banners) under the jurisdiction of all provinces, autonomous regions, municipalities directly under the Central Government and counties (banners) under the jurisdiction of all autonomous regions. Counties (county-level cities and districts) in the six central provinces that implement policies related to the development of the western region (except county-level cities and districts that are not the focus of national or provincial poverty alleviation and development); Western China (except Tibet), 1 1 counties under the jurisdiction of provinces, autonomous regions and municipalities directly under the central government (including key poverty alleviation and development counties at the provincial level and county-level cities and districts enjoying the policy of ethnic autonomous areas); The cities, regions, counties, county-level cities and municipal districts under the jurisdiction of Xizang Autonomous Region can relax the qualification conditions for registration to the college degree of law major in colleges and universities, and the application period of this policy is up to 20 1 1, 12, 3 1.
According to Article 68 of the Higher Education Law of People's Republic of China (PRC), the above-mentioned institutions of higher learning refer to universities, independent colleges and junior colleges, including higher vocational and technical schools and adult institutions of higher learning.
20 10 college graduates can register for the national judicial examination. Ordinary institutions of higher learning refer to institutions of higher learning established in accordance with the Higher Education Law of People's Republic of China (PRC) and approved by the education administrative department of the State Council to hold full-time undergraduate-level ordinary higher education, including full-time ordinary undergraduate colleges and independent colleges.
Holders of academic qualifications (degrees) certificates from Hongkong, Macau, Taiwan Province Province or foreign institutions of higher learning may register for the national judicial examination after their academic qualifications (degrees) certificates have been certified by the Study Abroad Service Center of the Ministry of Education.
2. Persons under any of the following circumstances cannot register for the national judicial examination, and if they have gone through the registration procedures, the registration is invalid:
(1) has received criminal punishment for intentional crime;
(2) Being expelled from public office by a state organ or having his lawyer's practice certificate or notary's practice certificate revoked;
(three) was sentenced to two years shall not take the national judicial examination or sentenced to life shall not take the national judicial examination.
3. Those who have passed the national judicial examination and obtained the A-class legal professional qualification certificate, and those who have obtained the B-class legal professional qualification certificate but have not yet obtained the bachelor's degree or above in colleges and universities may not register for the national judicial examination again.
(2) Registration method and time.
1.The 2009 national judicial examination registration method is divided into two stages: online registration and on-site confirmation.
2. Unified online registration for the national judicial examination in 2009. Online registration time is from June/kloc-0 to 25th. Applicants should log on to the website of the Ministry of Justice (website:) for online registration within the above period. Those who have not registered online cannot make on-site confirmation.
3. On-site confirmation time of the national judicial examination in 2009: Jinan, Qingdao, Zibo, Yantai, Weifang, Jining and Linyi on July 6-20; Zaozhuang, Dongying, Tai 'an, Weihai, Rizhao, Laiwu, Dezhou, Liaocheng, Binzhou and Heze 10 is from July 10 to July 20th. Online applicants must go to the registration point designated by the judicial administrative organ of the registration place for confirmation within the above-mentioned time limit.
(3) the place of registration.
1. The applicant shall make on-site confirmation at the registration point designated by the municipal judicial administrative organ where the household registration is located within the specified time. Those who work and study outside the domicile can be confirmed at the place of work and study with the certificate issued by the work and study unit.
2. Graduates of law majors with non-relaxed local household registration are not allowed to register and take exams in relaxed places because they do not meet the registration conditions of the national judicial examination.
3. Applicants can choose papers written in minority languages, but only in Xinjiang, Inner Mongolia, Xizang Autonomous Region and Jilin Province.
4. According to the Notice of the Ministry of Justice and the General Political Department of the People's Liberation Army on Organizing Servicemen to Participate in the 2002 National Judicial Examination ([2002] Zhengban Zi No.5), it is convenient for servicemen stationed in remote areas to register and take the examination locally, and with the letter of introduction from political organs at or above the unit level, they can register for the examination at the registration point designated by the local judicial administrative organ.
(4) application materials.
The applicant shall submit the following materials when registering:
1. Original and photocopy of my valid ID card (second-generation resident ID card, military officer's card and soldier's card).
Applicants who have not renewed their second-generation ID cards may apply with their first-generation valid ID cards.
Persons who register for the national judicial examination with passports must submit their valid identity documents or household registration certificates at the same time.
2. The original and photocopy of my diploma.
20 10 undergraduate graduates from ordinary colleges and universities register with the certificate issued by their school. The format certificate can be downloaded from the website of the Ministry of Justice.
Holders of graduation certificates (degrees) from Hongkong, Macau, Taiwan Province Province or foreign institutions of higher learning must also submit the graduation certificates (degrees) issued by the Study Abroad Service Center of the Ministry of Education.
3. Applicants with household registration in places where the registration qualification is relaxed must submit a copy of the household registration certificate (printed version) if they want to enjoy the local relaxation policy; The household registration code filled in the registration form should be consistent with the household registration place.

If the above application materials are true and complete and meet the registration conditions, the judicial administrative organ of the registration place will issue the main certificate of the admission ticket, and after the examination and approval by the Shandong Provincial Department of Justice, a supplementary certificate of the admission ticket will be generated, which will be downloaded by the applicants themselves from the website of the Ministry of Justice. If the applicant really can't download the supplementary certificate of the admission ticket, it can be obtained in the following ways:
(1) Fill in my mailing address accurately on the envelope provided at the registration point and mail it by the judicial administrative organ. If the mail cannot be delivered due to the applicant's wrong filling, the responsibility shall be borne by the applicant.
(2) Pick it up from September 1 to September 10 at the judicial administrative organ of the registration place.
Second, the exam.
(1) Examination time.
The national judicial examination time in 2009 is September 19/20. Specifically:
Test paper1:08: 30am September19-1:30, test time 180 minutes.
Test paper 2: September 19, afternoon 14: 00- 17: 00, test time 180 minutes.
Test paper 3: 08: 30 am on September 20th-11:30, and the examination time is 180 minutes.
Test paper 4: On the afternoon of September 20th, 14: 00- 17: 30, the examination time is 2 10 minutes.
(2) Contents, methods and subjects of the examination.
The contents of the national judicial examination include: theoretical law, applied law, current legal provisions, legal practice and legal professional ethics.
The national judicial examination implements a national unified proposition, and the scope of the proposition is subject to the "2009 National Judicial Examination Outline" formulated and published by the Ministry of Justice.
The national judicial examination takes the form of closed-book written examination. The exam is divided into four volumes, each volume 150, and the total score of the four volumes is 600. Test paper 1, test paper 2 and test paper 3 are machine-readable multiple-choice questions, and test paper 4 is written example (case) analysis questions. The specific theme of each volume is:
Test paper 1: Comprehensive knowledge. Including jurisprudence, legal history, constitution, economic law, international law, private international law, international economic law, judicial system and legal professional ethics;
Examination Paper 2: Criminal and Administrative Legal System. Including: criminal law, criminal procedure law, administrative law and administrative procedure law;
Examination paper 3: Civil and commercial legal system. Including: civil law, commercial law, civil procedure law (including arbitration system);
Test paper 4: Example (case) analysis. Including jurisprudence, constitutional law, administrative law and administrative procedure law, criminal law, criminal procedure law, civil law, commercial law and civil procedure law.
In 2009, the National Judicial Examination Volume I and Volume IV contained the concept of socialist rule of law and other related contents.
(3) Examination discipline.
Candidates should carefully read the Rules of the National Judicial Examination and the Measures for Handling Violations of the National Judicial Examination, consciously abide by the examination discipline and consciously maintain the order of the examination room.
(4) Objection to the reference answers to the questions.
In order to ensure the fairness and justice of the national judicial examination and further increase the transparency of the national judicial examination, the Ministry of Justice will announce the examination questions to the public at 8: 00 a.m. on September 2 1 and the reference answers to the examination questions at 8: 00 a.m. on September 24. Candidates who have objections to the reference answers can log on to the website of the Ministry of Justice from September 24th to 29th, and put forward and explain the reasons on the website "2009 National Judicial Examination Reference Answers Objection Zone". The Ministry of Justice will organize a special person to collect and sort out the opinions put forward by all parties on the reference answers to test questions, and submit them to the specially established "Expert Group for Examination of Reference Answers to Test Questions" for research and demonstration before the test papers are officially reviewed.
Third, exam review and counseling
According to the provisions of the Measures for the Implementation of the National Judicial Examination, the Ministry of Justice has formulated and published the outline of the National Judicial Examination in 2009, and those who sign up for the National Judicial Examination can review and prepare for the exam according to the outline.
The Justice Department of Shandong Province does not hold pre-test training courses, nor does it entrust any unit with pre-test training and counseling for the 2009 national judicial examination.
Four, marking and examination results
The national judicial examination shall be marked uniformly throughout the country.
After the marking work, the examination results will be announced by the National Judicial Examination Office of the Ministry of Justice, and the candidates will be notified in writing by the judicial administrative organs of the municipalities.
V examinations and qualifications
According to the provisions of the Measures for the Implementation of the National Judicial Examination, the passing scores of the 2009 National Judicial Examination were determined and published by the Ministry of Justice in the Supreme People's Court and the Supreme People's Procuratorate after the examination.
Those who have passed the national judicial examination shall be granted legal professional qualifications by the Ministry of Justice, and a unified legal professional qualification certificate shall be issued. The procedures and requirements for applying for granting legal professional qualifications will be notified separately.
Persons whose household registration conditions are relaxed and enjoy the relaxation of local policies, who sign up for the examination in non-relaxed places or other relaxed places, and whose examination scores reach the qualified score line, shall apply for granting the legal professional qualification certificate in their household registration places.
Undergraduate graduates who have passed the national judicial examination in 20 10 should apply to the judicial administrative organ of the place of registration for granting legal professional qualification before 201July 3 10 with the notice of passing the examination and graduation certificate.
A person who has passed the examination and obtained a legal professional qualification certificate shall meet other conditions stipulated in the Judges Law, the Prosecutors Law, the Lawyers Law and the Notary Law when he is a judge or a prosecutor and applies for practicing as a lawyer.
Six, Hong Kong and Macao residents registration examination related matters.
In order to facilitate Hong Kong and Macao residents who work, study and live in Shandong Province to sign up for the national judicial examination, the following arrangements are made for the specific matters of the registration examination:
(1) Registration conditions.
1. Identity conditions. China citizens who are permanent residents of Hong Kong and Macao Special Administrative Regions and other China citizens who hold Hong Kong and Macao residents' passes to and from the Mainland can register for the 2009 National Judicial Examination.
In order to confirm the above-mentioned identity of the applicant, the applicant shall submit the following documents and copies to the registered organizer at the time of registration:
(1) Hong Kong and Macao permanent identity cards and SAR passports.
(two) Hong Kong and Macao residents' identity cards, Hong Kong and Macao residents' passes to and from the Mainland, and the certificate of "not applying for renunciation of China nationality" issued by the identity authentication institution of the special administrative region.
At the time of registration, the original of the above documents shall be returned immediately after on-site inspection; The registered organizer shall keep a copy. The photocopy of the identity certificate submitted by the Hong Kong applicant must be notarized by a notary public entrusted by China, and the list of notaries entrusted by China can be inquired by the China Association of Commissioned Notaries (Hong Kong); The photocopy of the identity certificate submitted by the Macao applicant must be notarized by the notary department of the Macao Special Administrative Region or a notary institution recognized by the mainland. Hong Kong and Macao residents who have signed up for the national judicial examination, if their identity documents have been notarized, may be exempted from re-notarization of their identity cards or copies of their identity documents.
2. Education. Hong Kong and Macao residents who hold academic certificates of mainland institutions of higher learning can go through the registration formalities directly at the registration organizer; Holders of academic qualifications (degrees) certificates from institutions of higher learning in Hongkong, Macao and Taiwan Province or foreign institutions of higher learning shall also submit academic qualifications (degrees) certificates issued by the Study Abroad Service Center of the Ministry of Education. Hong Kong and Macao residents who have completed their studies but have not yet obtained their diplomas due to academic reasons may apply for academic qualification (degree) certification from the study abroad service center of the Ministry of Education with the diplomas issued by their schools. After the qualification (degree) certification, you can apply to the registration organizer for registration, but you need to make relevant commitments as required.

At the time of registration, the submitted academic certificate (degree) and the original certificate will be returned immediately after on-site inspection; A copy shall be submitted to the registered organizer for retention.
(2) Registration method and place.
1.Online registration and on-site confirmation will be implemented for the registration of Hong Kong and Macao residents in the 2009 National Judicial Examination. Applicants can log on to the website of the Ministry of Justice and fill in the Registration Form for National Judicial Examination (Hong Kong and Macao Residents) in 2009 for online registration. Subsequently, according to the on-site confirmation time stipulated by the Shandong Provincial Department of Justice, the registration site of the municipal judicial administrative organ of the place of residence was reviewed and confirmed. Those who have not registered online cannot go through the on-site confirmation procedures.
2. Residents of Hong Kong and Macao who work, study and live in Shandong Province can register in Hong Kong and Macao, or they can register at the registration point of the municipal judicial administrative organs in Shandong Province.
(3) examination place.
Those who register in Shandong Province will take the exam in the examination room set up by the municipal judicial administrative organ at the place of registration.
Seven, Taiwan Province residents registration examination related matters.
In order to facilitate the residents of Taiwan Province Province who work, study or live in Shandong Province to take the national judicial examination, according to the "Several Provisions on the Participation of Residents of Taiwan Province Province in the National Judicial Examination", the specific matters for registering for the examination are arranged as follows:
(1) Registration conditions.
1. Identity conditions. Taiwan Province residents can register for the 2009 National Judicial Examination.
In order to confirm the above-mentioned identity of the applicant, the applicant shall submit the following valid identity certificates and photocopies to the institution accepting the registration:
Mainland travel permit for taiwan residents (referred to as Taiwan Compatriot Certificate) and Taiwan Province resident ID cards; If the mainland travel permit for taiwan residents cannot be submitted, the Taiwan Province resident identity card and the transcript of household registration or household registration book shall be submitted. Residents of Taiwan Province Province who have completed their studies but have not yet obtained their diplomas due to the academic system may apply for academic qualification (degree) certification from the study abroad service center of the Ministry of Education with their diplomas issued by their schools. After the qualification (degree) certification, those who meet the requirements can apply for registration to the registration acceptance institution, but they need to make relevant commitments as required.

(3) Other relevant information about the residents of Hongkong, Macao and Taiwan Province Province taking part in the 2009 National Judicial Examination shall be published separately by the National Judicial Examination Office of the Ministry of Justice.
