The term "farmer's market" as mentioned in these Measures refers to the trading place where the promoters provide fixed venues and facilities, operators enter the market to conduct centralized public retail transactions of agricultural and sideline products, and are registered by the market supervision department according to law. Article 3 The management of farmers' markets follows the principles of unified leadership, territorial management, graded responsibility and division of labor and cooperation.
The people's government at the county level shall be responsible for the unified organization, leadership, supervision and management of the farmers' market within its jurisdiction.
People's governments at all levels shall ensure the funds for the supervision and management of farmers' markets.
Business, market supervision, agriculture and rural areas, natural resources and planning, comprehensive administrative law enforcement (urban management), housing and urban construction, ecological environment, public security, health emergency and other relevant departments and township (town) people's governments and sub-district offices shall, according to their respective functions and duties, do a good job in the supervision and management of farmers' markets. Chapter II Planning and Construction Article 4 The special planning of farmers' markets shall be incorporated into the overall planning of land and space.
The special planning of the farmers' market in the central city shall be prepared by the competent department of commerce, natural resources and planning of the Municipal People's Government in conjunction with other relevant competent departments, and shall be promulgated and implemented to the public after being approved by the Municipal People's Government.
The special planning of farmers' markets in other areas shall be organized by the relevant competent departments of local people's governments at the county level, and shall be announced to the public for implementation after being submitted for approval according to procedures. Fifth people's governments at the county level shall, according to the special planning of farmers' markets, formulate the implementation plan for the planning and construction of farmers' markets within their respective jurisdictions, and organize the implementation with the consent of the municipal commerce department.
To formulate the implementation plan for the planning and construction of farmers' markets, the following provisions shall be met:
(a) in line with the special planning of farmers' markets and the standards for the construction of farmers' markets;
(two) the location and scale of the farmer's market should be adapted to the living population and service radius of the service area;
(three) the establishment of farmers' markets should facilitate people's lives and meet their needs;
(four) the layout of the farmers' market should be coordinated with the community commercial service facilities and adapt to the degree of economic and social development. Sixth new residential areas or the transformation of the old city, the development and construction units should be supporting the construction of the corresponding farmers' market, and synchronized with the main project planning, simultaneous construction, synchronous delivery.
In accordance with the planning of the farmers' market demolition should follow the principle of demolition, construction, construction, relocation and demolition.
The planned farmers' market shall not be closed, dismantled or changed without authorization. If it is really necessary to suspend business, dismantle or change its use, the market promoter shall submit a written application to the local natural resources and planning department in accordance with the law, and the natural resources and planning department in conjunction with the commerce department shall put forward opinions and examine and approve them in accordance with the provisions of laws and regulations. Chapter III Opening of the Market Article 7 The establishment of a farmers' market shall meet the following conditions:
(a) in line with the special planning of the farmers' market, the construction standards of the farmers' market and the relevant national building technical specifications;
(two) there are fixed sites, facilities, management institutions and full-time management personnel suitable for the scale of the farmers' market;
(3) Having funds commensurate with the scale of the farmers' market;
(4) Other conditions stipulated by laws and regulations.
To open a farmer's market, a business license shall be obtained according to law. Eighth farmers' market operators should ensure the quality and safety of agricultural and sideline products, and abide by the following provisions:
(a) the establishment of edible agricultural products safety management system, equipped with edible agricultural products safety management personnel, professional and technical personnel, to carry out safety knowledge training of edible agricultural products, strengthen the inspection of edible agricultural products;
(two) the establishment of the seller's file, record the basic situation of the seller and the varieties of edible agricultural products, purchase channels, origin and other information;
(3) signing an agreement on the quality and safety of agricultural and sideline products with the operators entering the farmers' market, clarifying the responsibility for food safety, and urging the implementation of the system of claiming certificates and tickets;
(4) Establish and improve the quality inspection and registration system of agricultural and sideline products, regularly or irregularly send special personnel to check the purchase vouchers of important agricultural and sideline products of operators, check and keep the quarantine inspection certificates of edible agricultural products such as livestock products, aquatic products and poultry that enter the farmers' market, and shall not allow agricultural and sideline products that have not obtained certificates or failed the inspection to enter the market for sale;
(five) establish and improve the exit system of unqualified agricultural and sideline products. If unqualified agricultural and sideline products are found, immediately ask the operators to stop selling or supervise their destruction, and make delisting treatment;
(6) Set up an independent pesticide residue testing room in the farmer's market, equipped with rapid testing instruments and staff, conduct spot checks on pesticide residues in vegetables and fruits sold in the market every day, truthfully make testing records, and publicize the testing results on the bulletin board set up in the market;
(7) Establish a docking system for the purchase and sale of agricultural and sideline products, encourage operators to establish a docking relationship with high-quality agricultural product production bases, livestock and poultry slaughterhouses, reputable production enterprises, standardized processing units and wholesale markets, and large wholesalers, clarify the quality responsibilities of suppliers and products, and ensure the quality and safety of agricultural and sideline products;
(eight) to formulate plans for handling food safety accidents;
(9) Other provisions of laws and regulations.
