Article 1 In order to strengthen the supervision of land and resources, ensure the implementation of laws and regulations on land and resources management, and correctly and timely investigate and deal with illegal acts of land and resources, these Provisions are formulated in accordance with relevant laws and regulations of the state and combined with the actual situation of this Municipality. ? Article 2 The term "land and resources supervision" as mentioned in these Provisions refers to the administrative law enforcement activities in which the administrative departments of land and resources supervise and inspect the implementation and compliance of laws and regulations on land, geology and mineral resources management by units and individuals according to law, and correct and punish illegal acts. ? Article 3 These Provisions shall apply to the supervision of land and resources within the administrative area of Dalian. ? Article 4 Dalian Municipal Bureau of Land Resources and Housing Management is in charge of the supervision of land resources in the whole city, and its subordinate land resources supervision institutions are entrusted by the competent authorities to be specifically responsible for the supervision of geology and mineral resources and land in Zhongshan District, Xigang District, Shahekou District, Ganjingzi District, Jinzhou District, Lushunkou District, Dalian Economic and Technological Development Zone, Dalian Hi-tech Industrial Park and Dalian Bonded Zone, and directly investigate and deal with major land violations in the whole city. ?

County (city) land and resources department is in charge of land supervision within its jurisdiction, and its subordinate supervision institutions are entrusted by it to perform their duties of land supervision, and accept the guidance of the municipal land and resources supervision institutions in business. ?

Administrative law enforcement, supervision, public security, development and reform, finance, agriculture, forestry, water affairs, planning, auditing and other relevant departments shall, in accordance with their respective responsibilities, do a good job in the supervision of land and resources. ? Article 5 The supervision of land and resources shall adhere to the principles of unified management of urban and rural areas, equal emphasis on resources and assets, and the combination of professional supervision and mass supervision. ? Article 6 To investigate and deal with illegal cases of land and resources, we must take facts as the basis and law as the criterion, so that the facts are clear, the evidence is conclusive, the nature is accurate, the handling is fair, the process is quick and the procedure is legal. ? Article 7 All units and individuals must abide by the laws and regulations on land, geology and mineral management, and have the right to report illegal acts to the administrative departments of land and resources. The administrative departments of land and resources shall commend and reward those who have made outstanding contributions to the investigation and handling of illegal cases. ? Article 8 Land and resources supervision institutions shall perform the following supervisory duties:

(a) publicity of land and resources management laws, regulations and policies; ?

(two) the supervision and inspection of units and individuals to comply with the laws and regulations of land and resources; ?

(three) to accept reports and complaints about illegal acts of land, geology and minerals; ?

(four) to investigate and deal with illegal cases of land, geology and mineral resources; ?

(five) entrusted by the administrative department of land and resources at the same level, to supervise and inspect the performance of land and resources management duties by the subordinate management departments and the agencies of the same level management departments; ?

(six) training and supervision of land and resources supervision personnel; ?

(seven) other regulatory duties entrusted by laws and regulations. ? Article 9 Contents of land and resources supervision:

Land management?

1, cultivated land protection; ?

2, the implementation of the overall land use planning; ?

3, construction land management laws and regulations; ?

4, the allocation, transfer, transfer, lease, mortgage and termination of state-owned land use rights; ?

5, collective land non-agricultural construction land; ?

6, the payment of land use rights transfer fees, land acquisition compensation and the use of related funds; ?

(three) other matters stipulated by laws and regulations on land, geology and minerals. ? Tenth cases of illegal land, geology and mineral resources shall meet the following conditions:

(a) there is a clear actor; ?

(two) the fact that there is a violation of laws and regulations on land, geology and mineral management; ?

(three) in accordance with the laws and regulations on the management of land, geology and mineral resources, legal responsibility should be investigated. ? Eleventh cases of illegal land, geology and mineral resources, it should be timely to determine the undertaker, the undertaker shall not be less than two. Major and complex cases can be formed into a case-handling team.

If the case undertaker and the person in charge of the land and resources supervision institution at the same level have an interest in the case or have close relatives with the parties to the case, which may affect the impartial investigation and handling of the case, they shall withdraw. ?

The withdrawal of the undertaker shall be decided by the person in charge of the land and resources supervision institution at the corresponding level. The withdrawal of the person in charge of the land and resources supervision institution at the corresponding level shall be decided by the administrative department of land and resources at the corresponding level or the land and resources supervision institution at a higher level. ? Twelfth land and resources supervision institutions to investigate illegal cases of land, geology and mineral resources, the relevant units and individuals shall truthfully answer inquiries, provide relevant information or materials, and shall not obstruct.
