2006 is a year of great significance in the development of people's procuratorial work. The central government has made a decision on further strengthening the work of people's courts and people's procuratorates, which has pointed out the direction for doing a good job in procuratorial work under the new situation. The Supreme People's Procuratorate led local people's procuratorates at all levels and special people's procuratorates, and under the guidance of Deng Xiaoping Theory and Theory of Three Represents, comprehensively implemented Scientific Outlook on Development, conscientiously implemented the central decision and the spirit of the Fourth Session of the Tenth National People's Congress, and made new progress in procuratorial work.
First, earnestly perform procuratorial duties and serve economic and social development.
Around the overall work of the party and the state, procuratorial organs throughout the country adhere to the principle of establishing procuratorial organs for the public and enforcing law for the people, deeply practice the work theme of "strengthening legal supervision and safeguarding fairness and justice", continue to strive to improve the level of law enforcement and the quality of handling cases, and devote themselves to maintaining social stability, ensuring fairness and justice, promoting social harmony and creating a good legal environment for economic and social development.
(1) Combating criminal offences according to law. Adhere to maintaining stability as an important task, actively participate in the comprehensive management of social security and the construction of peace, and conscientiously perform the duties of arrest and prosecution. Throughout the year, * * * approved the arrest of 89 1620 suspects and prosecuted 999086 people.
Severely crack down on criminal crimes that seriously endanger social order according to law. Work closely with relevant departments to crack down on organized crime, serious violent crime and "two robberies and one theft" and other multiple crimes. 47,228 suspects of intentional homicide, arson, explosion, rape and kidnapping were arrested, and 46,607 people were prosecuted; 4 19578 suspects of robbery, robbery and theft were arrested, and 445849 people were prosecuted. In accordance with the unified arrangements of the central authorities, we actively carried out a special struggle to crack down on evil, promptly intervened in investigation activities on major cases, approved the arrest of criminal suspects of evil forces 18446, prosecuted 8343 people, and investigated and dealt with a number of duty-related crimes committed by state staff who acted as "protective umbrellas" for evil forces, effectively cracking down on crimes committed by evil forces.
Intensify efforts to crack down on crimes that undermine market economic order and environmental resources. Severely punish crimes that seriously endanger economic security, disrupt market order and endanger people's lives and health, approve the arrest of 242 suspects11,and initiate public prosecution of 27,728 people, up by 14.2% and1%respectively. We strengthened the judicial protection of intellectual property rights and environmental resources, approved the arrest of 3,729 criminal suspects who made and sold fake goods and infringed trademark rights, copyrights and trade secrets, and prosecuted 3,634 people, up by 16.7% and12.6% respectively. It was approved to arrest 7,974 criminal suspects who damaged environmental resources such as major environmental pollution accidents and illegal mining, and prosecuted12,240 people, up 15.4% and 24.8% respectively. We will continue to carry out special work to investigate and deal with dereliction of duty crimes that undermine the order of the market economy, and put on record 295 state functionaries who neglected their duties in market supervision and sheltered and connived at economic crimes.
Attach great importance to the handling of death penalty cases. In view of the fact that the power to approve death penalty cases is unified in the Supreme People's Court, and the death penalty cases of second instance are heard in court according to law, the Supreme People's Procuratorate issued a document stressing that it is necessary to do a good job in the arrest and prosecution of cases that may be sentenced to death according to law, strictly control the facts, evidence, procedure and application of law, and strengthen legal supervision over the whole process of handling death penalty cases, including death penalty review, according to law, so as to ensure the quality of handling cases. At the same time, it will work with the Supreme People's Court to formulate a judicial interpretation to standardize the trial procedure of death penalty cases of second instance. For a long time, most places have not held court sessions to hear death penalty cases of second instance, so the procuratorial organs have no special handling power and staffing. In the face of the greatly increased workload, provincial procuratorates have taken measures such as temporarily adjusting their internal handling power and seconding business backbones from lower procuratorates to ensure the smooth handling of death penalty cases in the second instance.
(two) in-depth investigation and prevention of duty crimes. Resolutely implement the overall plan of the central anti-corruption struggle and perform the duties of investigating and handling duty crimes according to law. In the whole year, 33,668 cases of duty crimes such as corruption, bribery, dereliction of duty and infringement were investigated and dealt with, and 24,448 cases and 29,966 people were prosecuted.
Resolutely investigate and deal with major cases Strengthen the organization and command of higher-level procuratorates in handling cases, strengthen cross-regional investigation cooperation, and improve the ability to find and break through major cases. Major cases of duty crimes 1824 1 were put on file for investigation, including 623 cases of corruption and bribery of more than one million yuan. There are 2736 national staff at or above the county level who are suspected of duty crimes, including 202 at the bureau level and 6 at the provincial and ministerial levels. In conjunction with the public security organs, a special pursuit operation was launched, and 1.670 fugitives were arrested, an increase of 1.37% over the previous year.
Seriously investigate and deal with cases that infringe upon the vital interests of the masses. There are 3,878 rural grass-roots organizations that have been put on file for investigation of corruption, misappropriation of state funds for agriculture, compensation for land acquisition, poverty alleviation and disaster relief, 10742 staff members of state-owned enterprises who have embezzled, embezzled, misappropriated state-owned assets or betrayed the interests of state-owned enterprises, and 930 staff members of state organs who illegally detained and extorted confessions by torture to infringe upon citizens' personal rights and democratic rights. For major production safety accidents, we simultaneously intervened in the investigation of relevant competent (regulatory) departments, paid attention to discovering and investigating the duty crimes behind the accidents, and put on record and investigated 629 state workers who neglected their duties and connived at illegal production, causing heavy losses. The Supreme People's Procuratorate directly participated in the investigation of eight major accidents, and 50 state employees suspected of dereliction of duty were put on file for investigation.
Actively participate in the special work of controlling commercial bribery. The Supreme People's Procuratorate conscientiously implemented the central government's major decision to control commercial bribery, formulated the procuratorial organ's work plan in time, organized national special reports and publicity, established and improved the case investigation mechanism and transfer acceptance mechanism with relevant competent (regulatory) departments, listed and supervised 45 major typical cases, and directly directed the investigation and handling of major cases such as bribery and serious dereliction of duty by relevant personnel of the US Food and Drug Administration in drug registration and approval. Procuratorial organs at all levels focused on engineering construction, land transfer, property rights transaction, medicine purchase and sale, government procurement, resource development and distribution, actively investigated clues, dug deep into a series of cases, and * * * filed and investigated 9582 commercial bribery crimes committed by state employees, involving a total amount of 65.438+0.5 billion yuan. Seriously investigated and dealt with a number of major commercial bribery cases involving a wide range, a large number of people and a large amount of money, which deterred illegal crimes and curbed the spread of commercial bribery.
Do a good job in preventing job-related crimes based on procuratorial function. Combined with handling cases, strengthen the analysis of the causes and characteristics of typical cases and crimes in industries and fields prone to duty crimes, promptly suggest relevant departments to improve the system and plug loopholes, and * * * put forward procuratorial suggestions 13662. Taking the case as a mirror, more than 33,000 times of preventive warning education were carried out, and more than 2.28 million people received education. Establish bribery crime files in engineering construction, government procurement and other fields, and provide 73 19 query.
Strengthen international judicial cooperation against corruption and bribery. The Supreme People's Procuratorate initiated the establishment of the International Association of Anti-Corruption Authorities and hosted the first member congress. President Hu Jintao attended the meeting and delivered an important speech. Representatives from 137 countries and regions attended the meeting. The establishment of this international organization has set up a new platform for China to carry out international cooperation against corruption.
(3) Strengthening legal supervision over litigation activities. Fully perform the legal supervision duties of filing, investigation, trial and penalty execution activities, highlight the key points of supervision, increase supervision and enhance the effectiveness of supervision.
The problem of lax supervision and law enforcement according to law and ineffective crackdown. For those who should have filed a case but did not, urge the investigation organ to file a case 16662. For those who should be arrested but did not ask for arrest, they should be prosecuted but not transferred for prosecution, and it was decided to arrest 14858 people and prosecute 10703 people. In cases of commutation, parole and temporary execution outside prison, 2,846 people put forward rectification opinions. In some areas, the Supreme People's Procuratorate organized a special inspection on the escape and leakage of prison execution criminals, supervised and corrected 6,074 escape and leakage of prison execution criminals, and urged relevant departments to put 207 criminals who no longer meet the conditions for execution outside prison into prison.
Supervise the acts that infringe upon the lawful rights and interests of participants in litigation according to law. Those who illegally use criminal means to intervene in civil economic disputes will not be placed on file, and the investigation organs will be urged to withdraw 4569 cases. For those who do not meet the conditions for arrest, they decided not to approve the arrest of 96,382 people; If criminal responsibility should not be investigated according to law or the evidence is insufficient, it is decided not to prosecute 7204 people. Put forward 1 1368 times to correct the violations in the investigation activities. Consolidate the results of centralized clean-up of extended detention, supervise and correct 233 person-times of extended detention, and continue to maintain no extended detention in procuratorial links. The Supreme People's Procuratorate, together with the Ministry of Public Security, organized a special inspection on arrest, and * * * spot-checked 654.38+million arrest cases handled in recent years, rectified the existing problems such as too wide or too strict conditions for arrest, and failed to implement them in time after arrest, which promoted the correct application of arrest measures according to law.
Conduct trial supervision according to law. Strengthen the supervision of cases of guilt, innocence, and excessive sentencing, and lodge protests against criminal judgments and rulings that are considered wrong 3 16 1 piece; Put forward 2200 corrective opinions on illegal acts in criminal trial activities. We strengthened supervision over civil trials and administrative proceedings, promptly accepted and examined complaints from parties who refused to accept the effective judgments of the people's courts, raised 65,438 civil and administrative protests+02,669, and put forward 5,949 suggestions for retrial and procuratorial work. For 37,524 complaints against correct judgments, we should conscientiously do a good job in litigation for the interests of the parties.
Seriously investigate and deal with crimes committed by judicial staff. Pay attention to the clues of job-related crimes behind unfair law enforcement and judicial injustice found in the supervision of litigation activities, improve the working mechanism for investigating and handling job-related crimes of judicial staff, and put on record 2,987 judicial staff suspected of abusing their powers, bending the law, soliciting and accepting bribes and other crimes.
(four) to strengthen the prosecution of complaints and actively resolve contradictions and disputes. Starting from the promotion of social harmony, we put the resolution of social contradictions in a more prominent position according to law, and handled 477,596 letters and visits from the masses according to law.
Further improve the working mechanism of letters and visits. Open channels for letters and visits, carry out joint visits by procuratorates at higher and lower levels, and explore case visits and regular visits. In the whole year, 739 letters and visits from difficult cases were received, and 27,283 were received. Adhere to the procurator-general reception day system and improve the responsibility system for the first office. The accountability system was strictly implemented, and the letters and visits cases of law enforcement mistakes were investigated, and 63 people were held accountable.
Seriously solve the problem of letters and visits from the masses related to inspections. Implement the system of "four decisions" and "two sessions", and set leaders, special personnel, plans and time limits. After the case was closed, the complainant's opinions were heard face to face, and 2,942 letters and visits related to inspection were properly handled according to law. The Supreme People's Procuratorate has sent 23 inspection teams to 17 provinces to directly supervise inspection-related petition cases. In the case of letters and visits, the problem of illegal seizure and freezing of money and materials by procuratorial organs was corrected, and the money and materials returned to the parties were equivalent to more than RMB 33 million. In recent years, 549 cases in which the procuratorial organs have made compensation decisions but have not implemented them have been comprehensively cleaned up, and 54 1 case has been implemented.
Actively explore effective ways to do a good job in mass work in law enforcement and case handling. Many local procuratorial organs have implemented the system of answering questions and reasoning in the work links of not approving arrest and not prosecuting. While enhancing the rationality of legal documents, they patiently explained the law and reasoned against the doubts and objections of the parties, striving to convince people by law and reasoning, which not only handled the case according to law, but also solved the contradictions and problems related to the case.
(five) to strengthen the standardization of law enforcement. We will continue to deepen the special rectification activities of "standardizing law enforcement behavior and promoting justice in law enforcement", and persist in improving law enforcement norms and implementing the system on the one hand. In view of the law enforcement posts and links that are prone to problems, the Supreme People's Procuratorate has formulated and revised 33 normative documents, including Quality Standards for Examining Arrest Cases, Standards for Filing Crimes of Dereliction of Duty and Infringement, and Provisions on Seizing Frozen Funds and Articles. Focusing on the implementation of legal provisions and system norms, all localities carry out step-by-step inspections and mutual checks, promptly urge rectification of problems found, and strive to implement system norms in every grass-roots unit, every law enforcement post and every case-handling link. Many local procuratorial organs closely combine standardized law enforcement with information management, actively promote the construction of a "trinity" mechanism of business, team and information, and use computer networks to conduct process management, process control and dynamic supervision of law enforcement and case handling activities, thus promoting strict, fair and civilized law enforcement. Through hard work, the quality of handling cases by procuratorial organs has been further improved, and the prosecution rate and guilty verdict rate of duty crimes have reached 89.5% and 99.4% respectively.
Over the past year, the awareness of procuratorial organs to perform their duties and serve the overall situation has been continuously enhanced. After the Supreme People's Procuratorate made the opinion of serving the western development and revitalizing the old industrial base in Northeast China a few years ago, he also made the opinion of serving the rise of central China and the construction of a new socialist countryside. Procuratorial organs throughout the country actively explore ways and measures for service development, improve law enforcement methods, pay attention to law enforcement effects, strive to create an environment conducive to reform and entrepreneurship, and promote economic and social development.
Two. Promoting procuratorial reform and ensuring judicial justice
We will continue to conscientiously implement the central government's plan on the reform of the judicial system and working mechanism, implement the three-year implementation opinions of procuratorial reform formulated by the Supreme People's Procuratorate in 2005, and persist in strengthening the legal supervision function and strengthening the supervision and restriction of our own law enforcement activities as the main line to further improve the procuratorial system and working mechanism.
(a) improve the supervision mechanism of investigation and evidence collection activities. In view of the problems exposed in the unjust, false and misjudged cases discovered in recent years, the Supreme People's Procuratorate has carefully analyzed the reasons and summed up the lessons, and formulated "Several Opinions on Strengthening Evidence Examination in the Examination of Arrest and Prosecution", which further improved the supervision mechanism for illegal investigation. It is emphasized that in handling criminal cases transferred by investigation organs, we should pay more attention to the examination of the legality of evidence, supervise and correct illegal evidence collection in time, resolutely exclude verbal evidence obtained by torture, and protect innocent people from criminal investigation.
(2) Improve the linkage mechanism between criminal justice and administrative law enforcement. In order to urge the administrative law enforcement organs to transfer suspected criminal cases to the judicial organs in time and intensify the crackdown on criminal crimes, especially economic crimes, the Supreme People's Procuratorate, together with relevant departments, issued the Opinions on Timely Transfer of Suspected Criminal Cases in Administrative Law Enforcement, which clarified the specific procedures for procuratorial organs to supervise the transfer of suspected criminal cases by administrative law enforcement organs, broadened the channels of supervision and improved the means of supervision. Over the past year, procuratorial organs across the country have suggested that administrative law enforcement agencies transfer 857 suspected criminal cases, and investigate and deal with administrative law enforcement personnel who do not transfer criminal cases for selfish ends 130.
(3) Deepening the openness of procuratorial work. In order to better accept the supervision from all walks of life and the people, and promote justice through publicity, the Supreme People's Procuratorate formulated the Opinions on Further Deepening the Openness of Procuratorial Affairs of People's Procuratorates, adding the item 12 on the working system and handling procedures that are open to the society and litigants, improving the system of informing litigants of their rights and obligations, setting up spokespersons in people's procuratorates at or above the provincial level, and establishing a system of investigating the responsibility for procuratorial violations to further improve the transparency of law enforcement.
(four) continue to implement the system of synchronous audio and video recording of the whole process of interrogating duty criminal suspects. After the establishment of this system in 2005, the Supreme People's Procuratorate formulated two technical specifications last year and improved the specific operating procedures. At present, 2 17 1 procuratorate has implemented synchronous audio and video recording, accounting for 59% of the total number of procuratorial organs in China. The implementation of this system has strengthened the supervision of procuratorial organs' own law enforcement and handling cases, and played a positive role in preventing irregular behaviors in interrogation and improving the investigation level of duty crimes.
(five) to promote the people's supervisor system pilot. At present, 86% of the country's procuratorates have carried out pilot work. In the whole year, * * * 5 19 1 a job-related crime case that is to be dismissed, not prosecuted and the suspect refuses to accept the arrest decision entered the supervision procedure, among which 252 cases were rejected by the people's supervisor and 78 cases were adopted by the procuratorate, explaining the facts and laws that were not adopted to the people's supervisor. Expand the scope of supervision by people's supervisors and stipulate specific supervision procedures for "five situations" such as illegal search and seizure. The role of the people's supervisor system in promoting fair law enforcement, ensuring the quality of handling cases, and promoting judicial democracy has further emerged.
Third, strengthen team building and improve the overall quality.
Adhere to fair law enforcement as the core, take the education of socialist concept of rule of law as the carrier, and strengthen the ideological, organizational and disciplinary style construction of the procuratorial team.
(a) to carry out the socialist concept of the rule of law education. According to the unified arrangement of the Central Political and Legal Committee, procuratorial organs throughout the country have carried out the education of socialist concept of rule of law with the main content of "ruling the country according to law, enforcing the law for the people, being fair and just, serving the overall situation and leading the party". By organizing centralized training, carrying out advanced typical learning activities, warning education by using negative examples, analyzing misjudged cases and cases with irregular law enforcement, we will guide prosecutors to fully grasp the scientific connotation and essential requirements of the socialist concept of rule of law, find out the problems that are inconsistent with the requirements of the socialist concept of rule of law from the aspects of law enforcement ideas, law enforcement ideas and law enforcement style, improve their ideological understanding and seriously carry out rectification. Through educational activities, some outstanding problems in the team have been further solved, which has promoted the overall strengthening of the construction of the procuratorial team. In the whole year, 1 104 collectives and 2 1 10 individuals were commended at or above the provincial level, and a number of advanced models, such as Bai Jie and Ahemati Yi Ming, emerged.
(2) Strengthen the leadership and discipline construction. Adhere to the construction of leading bodies as the top priority, and further strengthen the education, management and supervision of leading cadres. Implement the political rotation training system and train more than 8000 leading cadres at all levels/kloc-0. Establish and improve the reporting system of leading cadres' personal matters and the system of reporting on work and honesty, and strengthen supervision and inspection of the implementation of the "six prohibitions". The Supreme People's Procuratorate sent staff to inspect the leading bodies of 7 provincial hospitals, and 2/kloc-0 provincial hospitals conducted inspections of lower hospitals. In connection with the general election, the Party Committee cooperated with the selection of the leading bodies of procuratorial organs and conducted exchanges with 662 prosecutors in different places. Strengthen the professional discipline and ethics education of prosecutors, try out the procuratorial supervision system, improve the accountability system for law enforcement faults, and severely investigate and punish 273 prosecutors who violate discipline and law, including 27 who are investigated for criminal responsibility.
(3) Promote the professionalization of the team. Conscientiously implement the law on prosecutors, strictly enforce the professional access of prosecutors, generally implement unified recruitment of new recruits, select prosecutors from those who have passed the judicial examination according to law, and continue to improve and implement the prosecutor selection system. Focusing on leading cadres and prosecutors at the front line of law enforcement and case handling, we strengthened standardized and classified training, extensively carried out on-the-job training, and trained more than 27,000 business backbones in departments such as investigation and supervision, public prosecution and duty crime investigation. Strengthen the undergraduate education of prosecutors in the western region, and organize procuratorial organs in the eastern and central regions to support procuratorial education and training in the western region. the Supreme People's Procuratorate has trained more than 500 professional backbones for ethnic minority areas such as Tibet and Xinjiang.
(four) continue to do a good job in the construction of grass-roots procuratorates. Adhere to the focus of procuratorial work and team building at the grassroots level, implement the Outline of Grassroots Construction of People's Procuratorates, carry out in-depth activities to create advanced procuratorates, and select and commend 200 national advanced grassroots procuratorates. Adhere to the system that the leaders of higher-level procuratorates contact the grassroots, and strive to do practical things for the grassroots. The Supreme People's Procuratorate won the support of relevant departments, and jointly issued the opinion of alleviating the shortage of prosecutors in grass-roots procuratorates in western and poverty-stricken areas, which supplemented some staffing for grass-roots procuratorates. Twenty-eight provincial procuratorates, together with the financial departments, have issued standards for ensuring public funds for county procuratorates, further improving the mechanism for ensuring funds at the grass-roots level.
Delegates, the achievements of procuratorial work in the past year were achieved under the correct leadership of the CPC Central Committee, the leadership of party committees at all levels, and the supervision and support of the National People's Congress, the government, the CPPCC and all sectors of society. The National People's Congress Standing Committee (NPCSC) has carried out inspections on the implementation of the Public Prosecutor Law, and considered the Supreme People's Procuratorate's report on the special rectification work of procuratorial organs to standardize law enforcement. Standing committees of local people's congresses at various levels strengthen supervision over procuratorial work by listening to special reports and organizing inspections by representatives. Deputies to people's congresses at all levels and CPPCC members put forward many good opinions and suggestions on procuratorial work, among which NPC deputies suggested 7 1 piece and CPPCC members suggested 8 pieces. Party committees and governments at all levels have implemented the central government's decision on further strengthening the work of people's courts and people's procuratorates, which has solved many difficulties and problems for procuratorial organs. While summing up the achievements, we also clearly see that there are still many gaps between procuratorial work and the requirements of the party and the people, mainly in the following aspects: First, the legal supervision function has not been fully exerted. The problems of weak supervision consciousness and inadequate performance of duties still exist in some places, and the unfair law enforcement and justice reflected by some people have not been effectively supervised and corrected. Second, the ability of legal supervision does not meet the requirements of building a harmonious socialist society. Some prosecutors' law enforcement level is not high, their law enforcement methods are simple, they do not pay attention to resolving contradictions related to cases, and they are not good at doing mass work, which affects the law enforcement effect. Third, the problem of lax and irregular law enforcement still exists. Some do not strictly enforce the law and the system of handling cases, and do not pay attention to protecting the litigation rights of the parties according to law. Some are driven by interests, illegally seizing, freezing and handling the money and materials involved. Fourth, the discipline style construction of the procuratorial team needs to be further strengthened. Some prosecutors have a weak awareness of law enforcement for the people, and law enforcement is uncivilized and unfair, and some even take bribes illegally and pervert the law. Individual leading cadres have seriously violated the law and discipline, causing adverse effects. In addition, some local procuratorates are not strong in handling cases, and the shortage of funds for procuratorates in central and western regions and poverty-stricken areas is still outstanding. In view of these problems, the Supreme People's Procuratorate should take further effective measures, strengthen leadership and coordination, and seriously solve them.
Four, around the construction of a harmonious socialist society, do a good job in procuratorial work in 2007.
In the new year, procuratorial organs throughout the country should conscientiously implement the spirit of the Sixth Plenary Session of the 16th CPC Central Committee and the current session of the National People's Congress, adhere to the working theme of "strengthening legal supervision and safeguarding fairness and justice", strengthen and improve procuratorial work, and provide strong judicial guarantee for building a harmonious socialist society.
(a) conscientiously perform their duties of legal supervision, maintaining social harmony and stability, fairness and justice. Adhere to the performance of legal supervision duties as the basic way to serve the construction of a harmonious society, and promote the solution of the most concerned, most direct and most realistic interests of the people. Perform the duties of arrest and prosecution according to law, resolutely crack down on criminal crimes that seriously endanger national security, social security and market economic order, and carry out a special struggle to crack down on evil. Perform the duty of investigating and handling duty crimes according to law, resolutely investigate and handle major cases and cases strongly reflected by the people, actively participate in the special work of controlling commercial bribery, and strengthen the work of preventing duty crimes. Perform legal supervision duties on litigation activities in accordance with the law, strengthen supervision over civil trials, administrative litigation and penalty execution activities, resolutely supervise and correct the problems of lax law enforcement and judicial injustice, and effectively prevent unjust, false and wrong cases. Strengthen judicial protection of human rights, resolutely crack down on crimes against human rights, safeguard the legitimate rights and interests of military families and returned overseas Chinese, safeguard the legitimate rights and interests of migrant workers, women, children and the disabled, and safeguard the legitimate rights and interests of litigation participants. Efforts should be made to improve the ability to do mass work, improve law enforcement methods, comprehensively implement the system of answering questions and reasoning without arrest and prosecution, and integrate disputes, contradictions and harmony into the whole process of law enforcement and case handling.
