Measures for the supervision of insurance sales practitioners

Chapter I General Provisions

In order to strengthen the management of insurance sales practitioners, protect the legitimate rights and interests of the insured, the insured and the beneficiaries, maintain the order of the insurance market, and promote the healthy development of the insurance industry, these Measures are formulated.

Article 2 The insurance sales practitioners mentioned in these Measures refer to those who sell insurance products for insurance companies, including insurance sales personnel of insurance companies and insurance sales personnel of insurance agencies.

Article 3 The China Insurance Regulatory Commission (hereinafter referred to as the China Insurance Regulatory Commission) shall, in accordance with the law and the authorization of the State Council, exercise unified supervision and management over insurance sales practitioners.

The dispatched offices of China CIRC shall perform their supervisory duties according to law within the scope authorized by China CIRC.

Article 4

Insurance sales practitioners shall meet the qualifications stipulated by the China Insurance Regulatory Commission, obtain the qualification certificate issued by the China Insurance Regulatory Commission, and obtain the practicing certificate issued by the insurance company or insurance agency where they are located before practicing.

Article 5 Insurance sales practitioners engaged in insurance sales activities shall abide by laws, administrative regulations and the relevant provisions of the China Insurance Regulatory Commission.

Chapter II Vocational Qualifications

Article 6

Personnel engaged in insurance sales shall pass the qualification examination for insurance sales practitioners organized by the China Insurance Regulatory Commission (hereinafter referred to as the qualification examination) and obtain the Qualification Certificate for Insurance Sales Practitioners (hereinafter referred to as the qualification certificate).

Article 7 Persons who sign up for the qualification examination shall have a college education or above and full capacity for civil conduct.

In any of the following circumstances, the application for registration shall not be accepted:

(1) Concealing relevant information or providing false materials;

(2) Concealing relevant information or providing false materials, and being declared invalid and dissatisfied with the examination results 1 year;

(three) the violation of examination discipline is serious and the examination results have been declared invalid for less than 3 years;

(4) Obtaining the qualification certificate by cheating, bribery or other improper means, and the qualification certificate has been revoked for less than 3 years according to law;

(5) Being prohibited from entering the industry by the financial supervision and regulation institution within a certain period of time, and the prohibition period has not expired;

(6) Being sentenced to a penalty for a crime, and the execution of the penalty has not been completed for more than 5 years;

(seven) other circumstances stipulated by laws, administrative regulations and the China Insurance Regulatory Commission.

Article 8

To participate in the qualification examination, the examination results are qualified and there are no circumstances stipulated in the second paragraph of Article 7 of these Measures, and the China CIRC shall issue the qualification certificate within 20 working days from the date of applying for the qualification certificate.

Article 9 In any of the following circumstances, the China CIRC will cancel its qualification certificate:

(a) the qualification certificate has been revoked;

(2) The qualification certificate has been revoked according to law;

(3) Other circumstances stipulated by laws, administrative regulations and the China Insurance Regulatory Commission.

Article 10 In any of the following circumstances, the qualification certificate holder shall change, renew or reissue the qualification certificate to the China CIRC:

(a) the registered items have changed;

(two) the damage affects the use;

(3) lost.

Article 11 The dispatched offices of the China Insurance Regulatory Commission may, according to local actual conditions, make appropriate adjustments to the academic qualifications of the applicants for the qualification examination within their respective jurisdictions, and relevant measures shall be formulated separately by the China Insurance Regulatory Commission.

If the qualification certificate is obtained by lowering academic qualifications, the business area shall not exceed the jurisdiction of the dispatched office of the China Insurance Regulatory Commission.

Article 12

After filing with the China Insurance Regulatory Commission, the dispatched offices of the China Insurance Regulatory Commission may implement special policies on qualification examination for applicants in rural grassroots areas below the county level and ethnic minority applicants in ethnic autonomous areas.

Chapter III Practice Management

Article 13

Insurance companies and insurance agencies shall, for those who have obtained qualification certificates and are not under the circumstances specified in the second paragraph of Article 7 of these Measures, go through the practice registration in the insurance intermediary supervision information system of the China Insurance Regulatory Commission (hereinafter referred to as the information system) and issue the Practice Certificate for Insurance Sales Practitioners (hereinafter referred to as the Practice Certificate).

Where the registered items of practice change, the insurance company and insurance agency shall make changes in the information system in time, and renew the practice certificate within 3 working days.

Article 14 A practice certificate shall include the following contents:

(1) Name and serial number;

(2) The name, gender, ID number and photo of the holder;

(three) the name and number of the qualification certificate;

(4) The name of the insurance company or insurance agency where the holder is located;

(5) Business scope and practice area;

(6) Date of issue;

(seven) the complaint telephone number of the insurance company or insurance agency where the holder is located;

(eight) the telephone number and website of the practice certificate information inquiry.

Article 15 Insurance companies and insurance agencies shall not issue practicing certificates to the following persons:

(1) Persons without qualification certificates;

(2) Persons who are not registered in the information system;

(3) Persons registered as practitioners by other institutions.

Article 16 Insurance companies and insurance agencies shall not entrust persons who do not hold qualification certificates and practice certificates issued by their own institutions to engage in insurance sales.

Article 17 The practice area of the holder of a practice certificate shall not exceed the scope of the practice area specified in the qualification certificate.

Article 18 Under any of the following circumstances, an insurance company or insurance agency shall withdraw its practice certificate within 5 working days and cancel its practice registration in the information system:

(1) The insurance salesman leaves his post;

(2) The qualification certificate of insurance sales practitioners has been cancelled;

(3) Insurance sales practitioners terminate their practice for other reasons;

(4) The insurance company or insurance agency is closed, dissolved or unable to continue its business for other reasons.

Article 19 Insurance sales practitioners shall engage in insurance sales within the scope authorized by insurance companies and insurance agencies.

Insurance sales practitioners engaged in insurance sales shall produce their practice certificates, and insurance sales practitioners of insurance agencies shall also inform customers of the name of the insurance company they represent.

Chapter IV Management Responsibility

Article 20

Insurance companies and insurance agencies shall establish insurance sales employees management files, and timely, accurately and completely register the basic information, training and business conditions of insurance sales employees.

Article 21

Insurance companies and insurance agencies shall train insurance sales employees to make them have basic professional qualities and professional ethics. The training content should at least include professional knowledge, legal knowledge and professional ethics.

When an insurance company entrusts an insurance agency to sell insurance products, it shall train the insurance salesmen of the insurance agency. The training content should at least include the relevant knowledge of the company's insurance products.

Insurance companies and insurance agencies may entrust industry organizations or other institutions to organize training.

Article 22

Insurance companies and insurance agencies shall not issue misleading advertising on the income or other interests of insurance sales employees, and shall not take the purchase of insurance products as a condition for issuing practice certificates.

Article 23

Insurance companies and insurance agencies shall immediately correct the illegal acts of insurance sales practitioners in insurance sales, and report to the dispatched office of the China Insurance Regulatory Commission.

Article 24 Insurance companies and insurance agencies shall regulate the sales behaviors of insurance sales employees, and it is strictly forbidden for insurance sales employees to have the following behaviors in insurance sales activities:

(1) Deceiving the applicant, the insured or the beneficiary;

(2) Concealing important information related to insurance contracts;

(3) Obstructing the applicant from fulfilling the obligation of telling the truth, or inducing him not to fulfill the obligation of telling the truth;

(4) Giving or promising to give benefits other than those stipulated in the insurance contract to the applicant, the insured or the beneficiary;

(5) Forcing, inducing or restricting the applicant to conclude an insurance contract, or seeking illegitimate interests for other institutions or individuals by improper means such as administrative power, position or professional convenience;

(6) Forging or altering an insurance contract without authorization, or providing false certification materials for the parties to the insurance contract;

(seven) misappropriation, interception, embezzlement of insurance premiums or insurance benefits;

(8) Entrusting institutions or individuals that have not obtained legal qualifications to engage in insurance sales;

(9) fabricating and spreading false information, damaging the business reputation of competitors, or disrupting the order of the insurance market by other unfair competition behaviors.

(10) disclosing the business secrets and personal privacy of the insurer, the applicant and the insured that are known in the insurance sales;

(eleven) interfere with the customer after the customer explicitly refuses to insure;

(twelve) to sign insurance contracts instead of the insured;

(thirteen) in violation of laws, administrative regulations and other provisions of the China Insurance Regulatory Commission.

Insurance sales practitioners who commit one of the acts specified in the preceding paragraph shall be ordered by the China Insurance Regulatory Commission to make corrections, and may take regulatory measures such as public disclosure and regulatory talks with relevant insurance companies.

Article 25 An insurance company shall require an insurance agency to provide basic information, training and other contents of insurance salesmen who sell their insurance products.

Article 26

If an insurance company finds that an insurance agency and its insurance sales personnel have violated laws and regulations in selling insurance products, it shall immediately correct them. If the insurance agency and its insurance sales employees refuse to make corrections, the insurance company shall immediately terminate the principal-agent relationship with the insurance agency and report to the dispatched office of the China Insurance Regulatory Commission.

Twenty-seventh any institution or individual shall not detain or disguise the qualification certificate of others.

Chapter V Legal Liability

Article 28 Anyone who obtains a qualification certificate by cheating, bribery or other improper means shall have his qualification certificate revoked according to law, and shall be given a warning by the China Insurance Regulatory Commission and fined 1 10,000 yuan.

Article 29

Those who provide false registration materials for others, take the qualification examination instead of others, or assist or organize others to cheat in the qualification examination shall be given a warning by the China Insurance Regulatory Commission and fined 1000 yuan.

Article 30

Anyone who forges, alters, transfers or rents a qualification certificate or practicing certificate shall be given a warning by the China Insurance Regulatory Commission, and shall be fined at least one time and three times the illegal income, but the maximum amount shall not exceed 30,000 yuan. If there is no illegal income, a fine ranging from 654.38 yuan to 0,000 yuan shall be imposed.

Article 31

Those who engage in insurance sales without obtaining qualification certificates and practice certificates shall be ordered by the China Insurance Regulatory Commission to make corrections, and the personnel and related insurance companies and insurance agencies shall be punished in accordance with laws and administrative regulations; If there are no provisions in laws and administrative regulations, the China CIRC will give a warning to the relevant insurance companies and insurance agencies and impose a fine of more than 3 times the illegal income/kloc-0, but the maximum amount shall not exceed 30,000 yuan. If there is no illegal income, a fine of 1000 yuan shall be imposed. The person was given a warning and fined 6,543,800 yuan.

Article 32

In violation of the provisions of Article 13, Article 15, Article 18, Article 20 to Article 23 and Article 27 of these measures, the China Insurance Regulatory Commission shall order it to make corrections, give it a warning and impose a fine of more than 3 times the illegal income/kloc-0, but the maximum amount shall not exceed 30,000 yuan. If there is no illegal income, a fine of less than 1 10,000 yuan shall be imposed.

Article 33

Insurance sales practitioners who violate the provisions of Article 17, Article 19 and Article 27 of these Measures shall be ordered by the China Insurance Regulatory Commission to make corrections, given a warning and imposed a fine of more than one time and less than three times the illegal income, but the maximum amount shall not exceed 30,000 yuan. If there is no illegal income, a fine of 654.38+0,000 yuan will be imposed.

Article 34

Insurance sales practitioners who commit one of the acts listed in Article 24 of these Measures shall be punished by the China Insurance Regulatory Commission in accordance with laws and administrative regulations on insurance sales practitioners and related insurance companies and insurance agencies; If there are no provisions in laws and administrative regulations, the relevant insurance companies and insurance agencies shall be given a warning, and the illegal income shall be fined 1 times and less than 3 times, but the maximum amount shall not exceed 30,000 yuan. No illegal income, a fine of 654.38+0000 yuan; Give a warning to the insurance sales practitioners and impose a fine of 6.5438+0 million yuan.

Article 35 Where an insurance company violates the provisions of Articles 25 and 26 of these Measures, it shall be ordered by the China Insurance Regulatory Commission to make corrections. If no correction is made within the time limit, a warning shall be given and a fine of 1 10,000 yuan shall be imposed.
