Provisions of Civil Code on Civil Capacity
Legal analysis: Adults are persons with full capacity for civil conduct and can independently conduct civil legal acts. /kloc-Minors over 0/6 years old whose main source of livelihood is their own labor income are regarded as persons with full capacity for civil conduct. If an adult is unable to identify or fully identify his or her own behavior, his or her interested parties or relevant organizations may apply to the people's court to identify the adult as a person with no or limited capacity for civil conduct. If a person is recognized by the people's court as a person without or with limited capacity for civil conduct, the people's court may, upon the application of himself, an interested party or a relevant organization, recognize the adult as a person with limited capacity for civil conduct or a person with full capacity for civil conduct according to his mental and psychological health recovery. Adults with full capacity for civil conduct may, in advance, consult with their close relatives and other individuals or organizations willing to act as guardians and determine their guardians in writing. If he loses or partially loses his capacity for civil conduct, the guardian shall perform his guardianship duties. Capacity for civil conduct refers to the qualification of a civil subject to exercise civil rights and undertake civil obligations by relying on his own independent behavior. Based on the actor's will, the actor is independently responsible for the consequences of civil legal acts. According to the different recognition abilities of natural persons, the civil capacity of natural persons is divided into complete civil capacity, limited civil capacity and no civil capacity in Chinese laws.

Article 18 adult are persons with full capacity for civil conduct and can independently carry out civil juristic act. /kloc-Minors over 0/6 years old whose main source of livelihood is their own labor income are regarded as persons with full capacity for civil conduct.

Article 20 Minors under the age of eight are persons without capacity for civil conduct, and their legal representatives shall act as agents to carry out civil legal acts.

Article 24 If an adult is unable to identify or fully identify his/her own behavior, his/her interested parties or relevant organizations may apply to the people's court to identify the adult as a person with no or limited capacity for civil conduct. If a person is recognized by the people's court as a person without or with limited capacity for civil conduct, the people's court may, upon the application of himself, an interested party or a relevant organization, recognize the adult as a person with limited capacity for civil conduct or a person with full capacity for civil conduct according to his mental and psychological health recovery. The relevant organizations mentioned in this article include: residents' committees, villagers' committees, schools, medical institutions, women's federations, disabled persons' federations, organizations for the elderly established according to law, and civil affairs departments.
