Personnel engaged in the examination and approval of the minimum living guarantee for urban residents who commit any of the following acts shall be criticized and educated, and shall be given administrative sanctions according to law; If the case constitutes a crime, criminal responsibility shall be investigated according to law:

(1) refusing to sign opinions on enjoying the minimum living guarantee for urban residents for families that meet the conditions for enjoying the minimum living guarantee for urban residents, or deliberately signing opinions on enjoying the minimum living guarantee for urban residents for families that do not meet the conditions for enjoying the minimum living guarantee for urban residents;

(two) dereliction of duty, favoritism, or corruption, misappropriation, withholding, arrears of urban residents minimum living security funds and materials.

According to the Measures for the Examination and Approval of Minimum Living Security (Trial), residents with local permanent residence, whose per capita income of family members living together is lower than the local minimum living standard, and whose family property status meets the conditions stipulated by the local people's government can apply for minimum living security. As long as they think that their basic life is difficult, they can directly apply to the township people's government (street office) where their household registration is located. There is no relevant regulation that you can only apply for subsistence allowance once a year.

Third, what are the relevant provisions of the minimum living allowance?

About the minimum living standard. According to the Interim Measures for Social Assistance, the minimum living standard is determined and published by the people's governments of provinces, autonomous regions, municipalities directly under the Central Government or cities divided into districts according to the living expenses of local residents, and adjusted in a timely manner according to the local economic and social development level and price changes. In accordance with the provisions of the Interim Measures for Social Assistance, various localities have also introduced policies and measures to formulate local minimum living standards, and formulated and announced the minimum living standards to the public according to local actual conditions. There is no problem of being undisclosed and opaque. In addition, considering China's vast territory and great differences in regional development levels, the conditions for formulating a unified national minimum living standard are not yet mature.

(3) On the issue of enjoying subsistence allowances for severely disabled people. According to the Notice of the Ministry of Civil Affairs and the Ministry of Finance on Further Improving the Work of Basic Living Security for People in Difficulties (No.69 [2020] of Civil Affairs), severely disabled people from low-income families and other people with special difficulties are included in the minimum living security with reference to "single family" upon their own application. Low-income families generally refer to marginal families whose per capita income is higher than the local urban and rural minimum living standard, but lower than the minimum living standard 1.5 times, and whose property status meets the relevant local regulations; Severely disabled persons refer to the first-and second-grade severely disabled persons who hold the People's Republic of China (PRC) Disabled Persons' Card, and can be extended to the third-grade mentally and intellectually disabled persons if conditions permit.

When it comes to subsistence allowances, many areas calculate and distribute them according to the difference between the per capita annual income of the applicant's family and the security standard. At the same time, on the basis of the applicant's family income, the minimum living allowance is paid according to the degree of difficulty. Because the regional economic situation and population situation are different, the minimum living allowance in each region is also different. The actual subsidy shall be subject to local regulations.
