1, suitable for people
Registered users of electronic patent applications in China can use the online payment system to pay patent fees.
2. Applicable payment methods
(1) individual users
Individual users can pay by bank card as long as they have a bank card with "UnionPay" logo and online payment function in the corresponding bank.
(2) institutional users
At present, there are 17 banks supporting corporate account payment, namely: China Industrial and Commercial Bank, China Agricultural Bank, China Bank, China Construction Bank, Bank of Communications, China CITIC Bank, China Everbright Bank, Huaxia Bank, China Minsheng Bank, Ping An Bank (formerly SDB), China Merchants Bank, Industrial Bank, Shanghai Pudong Development Bank, Hebei Bank and Huizhou Bank. (The actual supporting bank is subject to the display of UnionPay online payment platform)
3. Types of applicable fees
At present, the online payment system can pay two kinds of fees: the fee for ordinary national applications and the fee paid by PCT international application number when PCT first enters the national phase.
The fees for ordinary national applications include application fee, application surcharge, publication and printing fee, priority claim fee, substantive examination fee, reexamination fee, patent registration fee, publication and printing fee, annual fee, request fee for restoring rights, request fee for extending time limit, request fee for changing description items, request fee for patent evaluation report and request fee for invalidation.
The fees paid by PCT for entering the national phase for the first time with its international application number include application fee, application surcharge, publication and printing fee, priority requirement fee, substantive examination fee for invention patent application, grace fee, translation error correction fee and singularity recovery fee. After the PCT application enters the national phase, the fees paid by the national application number are regarded as the fees for ordinary national applications.
4. Applicable payment time
(1) bank card payment
Bank card payment supports all bank card 7*24 hours payment services.
(2) Payment to company account
At present, among the banks that support corporate account payment, all other banks support 7*24 hours payment service except China Bank, which only supports 5*8 hours payment service. (The time for paying the bank service fee from the enterprise account shall be subject to the bank announcement. )
(3) Preparations for using the online payment system
1, system preparation
(1) browser
The recommended browser version of online payment system is IE7.0.
You should turn off the browser's pop-up blocker before using it, otherwise you can't connect to the UnionPay payment page after generating the order.
(2)Excel version
Please use Excel version for online payment template file, that is, Excel2003 version.
2. Bank card or account preparation
(1) bank card
Open the online payment function of bank card.
You can log in to UnionPay Online Payment Help Center:/static/help/detail _ 38.html to check the payment limit of bank cards in advance.
(2) Company account

Two, the legal effect of using the online payment system for patent fees to pay patent fees
Article 94 of the Detailed Rules for the Implementation of the Patent Law of People's Republic of China (PRC) stipulates that all fees stipulated in the Patent Law and these Detailed Rules can be paid directly to the patent administration department in the State Council, remitted by post office or bank, or paid in other ways stipulated by the patent administration department in the State Council. As the patent administrative department of the State Council, China National Intellectual Property Administration's AnnouncementNo. 172, Notice on Patent Applicants and Patentees Paying Patent Fees, and AnnouncementNo. 180, Notice on Opening Online Payment Service for Public Accounts stipulate that online payment is a new way to pay patent fees. Online payment has the same legal effect as direct payment, post office remittance or bank remittance. The standards and requirements for paying patent fees are the same as the current payment methods.
Determination of payment date
The payment date of online payment is determined by the date corresponding to the actual payment time received by the online payment system from UnionPay online payment platform. Please pay full attention to the network situation, and try to use the online payment system to complete the payment of patent fees before 23: 30 every day, so as to avoid the sunset on the second day of the order generation day when the operation is around 0: 00, which will affect the normal payment of patent fees due to network reasons.
Three, the use of online payment system to pay the patent fee receipt.
(1) individual users
Individual users can obtain receipts through online payment in the same way as bank remittance and post office remittance. The online payment system provides a page for filling in the payee information. After the payer fills in the detailed address information of the recipient of the receipt, the Patent Office will send the receipt to this address by registered mail.
(ii) Institutional users
Receipts for online payment by institutional users can be obtained by mail or by self-collection. The mailing method is the same as that for individual users to receive the receipt, that is, the payer fills in the detailed address information of the recipient of the receipt in the online payment system, and the Patent Office sends the receipt to this address by registered mail; Self-service collection means that the payer chooses the self-service collection place in the online payment system and directly goes to the patent agency of China National Intellectual Property Administration Patent Office in the region to collect the receipt by himself.
Four, there are several ways to use the online payment system for patent fees to pay patent fees.
The online payment system for patent fees has four interfaces for filling in payment forms, which can also be called four payment portals: importing the national application payment form, importing the PCT application payment form for the first time in the national phase, paying the national application number, and paying the PCT application for the first time in the national phase.

Article 94 of the Detailed Rules for the Implementation of People's Republic of China (PRC) Patent Law
The fees specified in the Patent Law and these Detailed Rules may be paid directly to the patent administration department in the State Council, or by other means specified by the post office, bank or the patent administration department in the State Council.
If remittance is made by post office or bank, the correct application number or patent number and the name of the fee paid shall be indicated on the remittance slip sent to the patent administration department in the State Council. If it does not conform to the provisions of this paragraph, it shall be deemed that it has not gone through the payment formalities.
If the fee is paid directly to the patent administrative department of the State Council, the payment date shall be the payment date; If payment is made by post office remittance, the postmark date of post office remittance shall be the payment date; If payment is made by bank remittance, the actual remittance date of the bank shall be the payment date.
If the patent fee is overpaid, re-paid or wrongly paid, the party concerned may, within 3 years from the date of payment, request a refund from the patent administration department in the State Council, and the patent administration department in the State Council shall refund it.
