Discrimination of network populism

Criminal responsibility of suicide death caused by "cyber violence"

Abstract: With the development of Internet technology, the connection between virtual space and real life is getting closer and closer, and cyber violence incidents emerge one after another, resulting in many cases of suicide because of unbearable humiliation. China's criminal law usually thinks that there is no causal relationship between suicide death and cyber violence, and suicide death is only the result of serious circumstances, but this is unreasonable. The characteristics of cyber violence lie in the compulsion to the spirit and the persistent harm to the body and mind. Cyber violence is higher than ordinary mental injury. Under certain circumstances, cyber violence can be the execution of homicide, which has a causal relationship with the result of suicide. Accordingly, criminal responsibility should be reassessed.

Analysis on the Motivation and Influencing Factors of Cyber Violence of Internet Users in China

Abstract: Network violence is the embodiment of real violence in the network world. With the advent of the Internet 2.0 era, the new media based on the Internet is influencing China in the period of social transformation with unprecedented impact. Different from the traditional media, the new media based on the Internet provides opportunities for the marginalized groups in real life to express their opinions and becomes the main way for them to obtain information and vent their emotions. It is precisely because of the grassroots nature and low threshold of the network that cyber violence has become increasingly rampant and has become a tool with great lethality, which has greatly affected social stability and people's mentality. There are two main motives for netizens to participate in cyber violence: moral judgment and venting attacks. The factors influencing cyber violence include: social environment, cyber environment and psychological factors of netizens. In the past, the research on this issue was carried out from three angles: communication, law and administration, sociology and psychology. The researcher further pointed out the direction of further discussion on this issue from the psychological point of view. These analyses have important theoretical and practical significance for us to understand and prevent cyber violence.
