City, county (city) people's government adjusts and announces the scope of urban built-up areas according to urban development, and delineates and announces other areas subject to urbanization management. Article 3 The work of city appearance and environmental sanitation shall adhere to the principles of unified leadership, graded responsibility, public participation and social supervision. Article 4 The people's governments of cities and counties (cities, districts) shall incorporate the cause of city appearance and environmental sanitation into the national economic and social development plan, ensure the funds needed for the cause of city appearance and environmental sanitation, strengthen the construction of city appearance and environmental sanitation facilities, promote the digitalization, refinement and intelligence of urban management, and improve the service capacity of city appearance and environmental sanitation. Fifth city and county (city, district) people's government administrative department of city appearance and environmental sanitation (hereinafter referred to as the administrative department of city appearance and environmental sanitation) is responsible for the management of city appearance and environmental sanitation within their respective administrative areas.
The administrative departments of development and reform, public security, finance, land and resources, environmental protection, urban and rural planning, housing and urban and rural construction, transportation, water supply, forestry, health and family planning, industry and commerce, food and drug supervision and urban management shall, according to their respective functions and duties, do a good job in the management of city appearance and environmental sanitation.
The agency of the Municipal People's Government with administrative functions shall be responsible for the management of city appearance and environmental sanitation in this region according to the authorization of the Municipal People's Government.
Street offices and town (township) people's governments shall be responsible for the management of city appearance and environmental sanitation within their respective jurisdictions. Article 6 The administrative punishment stipulated in these Regulations and the administrative coercive power related to administrative punishment shall be implemented by the administrative department of city appearance and environmental sanitation, unless otherwise stipulated in these Regulations. Article 7 The administrative department of city appearance and environmental sanitation shall enforce the law in a legal, standardized, fair and civilized manner, and implement the responsibility system for administrative law enforcement. Eighth city and county (city, district) people's governments shall, according to local conditions, organize the preparation of city appearance and environmental sanitation development plans, and incorporate them into the overall urban planning.
The competent administrative department of city appearance and environmental sanitation shall, jointly with relevant departments, organize the preparation of special plans for city appearance and environmental sanitation such as city lighting, city parking, outdoor advertising, garbage disposal and comprehensive utilization, and report them to the people's government at the same level for examination and approval before promulgation and implementation. Ninth city appearance and environmental sanitation management department shall, jointly with the departments of housing and urban and rural construction, urban and rural planning and so on. According to the national city appearance standards, formulate the city appearance standards of this administrative region and report them to the people's government at the same level for approval before promulgation and implementation.
The formulation of urban appearance standards should be coordinated with the completed urban design and other related achievements, taking into account the relationship between the overall urban style and modern urban construction, and highlighting the characteristics of national science and technology cities. Article 10 The administrative departments of city appearance and environmental sanitation, the departments of culture, radio, film and television, press and publication, education, health and family planning, judicial administration, and the business units or management units of public places such as airports, stations, parks, tourist attractions and scenic spots shall strengthen the publicity and education of city appearance and environmental sanitation laws, regulations and related knowledge, and cultivate and enhance citizens' awareness of maintaining city appearance and environmental sanitation.
Broadcasting, television, newspapers, internet and other mass media and publicity columns (columns) in public places shall arrange public welfare publicity content of city appearance and environmental sanitation. Eleventh units and individuals have the right to enjoy good city appearance and environmental sanitation, have the obligation to maintain the city appearance and environmental sanitation, and can discourage, complain and report acts that damage the city appearance and environmental sanitation.
Encourage units and individuals to participate in public welfare activities of city appearance and environmental sanitation.
Advocate neighborhood (village) committees to organize residents (village) to formulate management conventions for maintaining city appearance and environmental sanitation, and encourage residents (village) to participate in city appearance and environmental sanitation management. Chapter II Responsibility System for City Appearance and Environmental Sanitation Article 12 This Municipality implements the responsibility system for city appearance and environmental sanitation. The relevant units and individuals shall, in accordance with the provisions of these regulations, do a good job in the city appearance and environmental sanitation work in the area of responsibility.
The area of responsibility for city appearance and environmental sanitation refers to the buildings, facilities, places and areas within a certain range where units and individuals undertake the responsibility for city appearance and environmental sanitation management. Thirteenth city appearance and environmental sanitation responsibility area and the determination of the responsible person, the following provisions shall apply:
(a) the implementation of property management in residential areas, by the property service enterprises; For residential areas that do not employ property service enterprises, the neighborhood (village) committee shall be responsible for determining the specific responsible person;
(two) organs, organizations, schools, hospitals and other enterprises and institutions and the area within the planning red line, the property owner, manager or user is responsible for;
(3) Hotels, guesthouses, shopping malls, supermarkets, shops, commercial squares, exhibition places, temporary stalls, entertainment places, cultural and sports places, parking lots, car washes and other places shall be the responsibility of the property owners, managers or users;
(4) Newsstands, information kiosks, telephone booths, bus shelters, sentry boxes, outdoor advertisements, posting boxes, box-type power distribution rooms, communication handover boxes, inspection wells, water grates, manhole covers, box covers and other facilities and overhead pipelines shall be the responsibility of the property owners, managers or users;
(five) tourist attractions, scenic spots, parks, highways, railways, airports, stations, docks, rail transit and its facilities are owned by property owners, managers or users;
(six) public toilets, garbage transfer stations, garbage disposal sites and other environmental sanitation facilities shall be the responsibility of the property owners, managers or users;
(seven) septic tanks, septic tanks by the property owner is responsible for, unclear property rights by the local administrative department of city appearance and environmental sanitation;
(eight) rivers, waters, coastal greening, hydraulic construction, by the property owners, managers or users;
(nine) the land reserved and requisitioned by the government is the responsibility of the land and resources department; The construction land for which the land use right has been defined shall be the responsibility of the land use right holder or manager; The builder is in charge of the construction site.
The city appearance and environmental sanitation of urban roads, underground passages, public squares and other public areas in the urban built-up area shall be the responsibility of the local administrative department of city appearance and environmental sanitation. The city appearance and environmental sanitation of other urbanization management areas outside the urban built-up area shall be the responsibility of the town (township) people's government where the city is located.
If the responsible area or person is unclear, it shall be determined by the local sub-district office and the town (township) people's government; If the responsibility of the area of responsibility across administrative regions is not clear, it shall be determined by the administrative department of city appearance and environmental sanitation at the next higher level.
