(2) Confidential important foreign scientific and technological research achievements;
(3) Proprietary technologies and traditional technologies that are not available or classified abroad;
(four) the key contents of important scientific and technological projects being studied and trial-produced in China;
(five) China's unique agriculture, animal husbandry, livestock and poultry varieties and precious germplasm resources. Article 3 Classification of scientific and technological secret projects
(a) involving national security or China's unique science and technology, once the leak will cause serious harm and heavy losses to the country, it is classified as top secret;
(two) science and technology that exceeds the international level and is of great significance to national construction or people's lives, as well as confidential projects that will cause great losses to the country once leaked, are classified as secrets;
(3) Science and technology that has reached or is close to the international advanced level and is of great significance to national construction or people's lives, as well as confidential projects that will cause losses to the country once leaked, shall be classified as secrets. Article 4 The examination and approval authority of scientific and technological secret projects
(a) for the invention project, the reporting unit shall put forward classification opinions when reporting the invention, and report to the State Science and Technology Commission for approval after being audited by the Municipal Science and Technology Commission; The relevant departments of the State Council in Shanghai units of such projects, please report to the competent authorities to determine, and send a copy to the Municipal Science and Technology Commission;
(two) top secret science and technology projects, approved by the municipal unit, reported to the State Science and Technology Commission for the record; The relevant departments of the State Council reported to the Shanghai competent department and copied to the Municipal Science and Technology Commission;
(three) confidential science and technology projects, approved by the competent department of the municipal unit, reported to the Municipal Science and Technology Commission for the record; The relevant departments of the State Council shall be determined by the poster department (bureau) and send a copy to the Municipal Science and Technology Commission;
(four) secret science and technology projects shall be examined and approved by the relevant departments of the competent authority. Article 5 The classification of scientific and technological projects shall generally be submitted for approval according to the administrative affiliation of the competent unit. In order to master the standards in a unified way, some cross-industry system projects should be concentrated by specialty. The centralized division of labor is as follows: medical care, including Chinese and western medicine, is centralized by the Municipal Health Bureau; Drugs, including Chinese and western medicines, commonly used medicinal plants and medical devices, are under the jurisdiction of the Municipal Bureau of Medicine; Crops (including related wild plants), fruits, vegetables, sericulture, tea, livestock, pasture and veterinary drugs are under the jurisdiction of the Municipal Agriculture Bureau; Woody plants, dried fruits, flowers and wild animals are under the jurisdiction of the Municipal Bureau of Landscape Architecture; The centralized management of microorganisms, insects, wild medicinal materials and spore plants is led by Shanghai Branch of Chinese Academy of Sciences, and experts from all relevant parties are organized to agree.
When it is difficult to determine the project classification, the competent unit may ask the centralized department to give a reply. The centralized department has the right to intervene, criticize and correct the improper handling of classified information by relevant units. Article 6 Units undertaking scientific and technological research and trial-production projects shall, when issuing plans, determine the project classification according to the procedures specified in Article 4 of these Detailed Rules. After the completion of the scientific research and trial production tasks of each project, if the original classification is not suitable, it can be adjusted appropriately. Seventh scientific and technological secret projects can be removed or reduced according to actual needs. If some science and technology need to be classified as confidential or confidential, it can be classified as confidential or confidential in time. Each unit shall conduct a classified cleaning in the fourth quarter of each year, and handle the work of decryption, reduction, increase and increase. The examination and approval authority in this respect shall be handled in accordance with the provisions of Article 4 of these Rules. Eighth units should do a good job in the management of scientific and technological confidential files, provide necessary storage facilities, and establish a system for the utilization and destruction of scientific and technological confidential files.
Top-secret scientific and technical materials are only used by designated units and personnel who need them directly; People who are only partially related to the work can only touch the relevant parts. Confidentiality is limited to units and personnel directly related to the project. The secret level can be used by work-related units and personnel.
Other units and personnel, such as the need to use scientific and technological confidential information, must obtain the consent of the original security examination and approval authority. Article 9 It is forbidden to report confidential scientific and technological contents by means of open newspapers, books, radio, television, movies, videos and exhibitions. In order to prevent the disclosure of publicity reports, manuscripts involving scientific and technological confidential projects must be reviewed by the competent authorities, and manuscripts involving scientific and technological projects above the confidential level must be reviewed by the competent committees and offices. Internal professional journals should also pay attention to scientific and technological confidentiality when reviewing manuscripts.
Papers provided to foreign countries, such as those involving undisclosed scientific and technological contents, should be reported to the competent authorities for examination, and those involving scientific and technological confidential items above the confidential level should be reported to the competent committees and offices for examination. Without examination and approval, no unit or individual may send unpublished scientific and technical papers abroad without authorization. Tenth foreign scientific and technological exchanges, private exchanges and communications shall not involve scientific and technological secrets. Without approval, no unit or individual may provide confidential technical data, samples and new products to foreigners without authorization.
Units opening to the outside world, when receiving foreigners to visit, should draw up the outline of foreign introduction, unify the caliber, delimit the foreign guests' visit route, and determine the scope of opening-up projects and information exchange. Any project classified as a scientific and technological secret shall not be allowed to be visited or photographed by foreigners without approval.
Units that are not open to the outside world generally do not arrange foreigners to visit. If it is really necessary to arrange foreigners to visit non-open units, they must be approved by the leading organs at or above the municipal level, and do a good job in scientific and technological confidentiality.
Confidential scientific and technological materials and samples shall not be taken to public places and places for foreign affairs activities.
