According to the contents, upon examination, the Supreme Court held that the fact that Zhang Zhichao, the defendant in the original trial, raped and killed Wang Guangchao, the defendant in the original trial, was unclear, and there were contradictions between the main evidences. According to the relevant provisions of the Criminal Procedure Law, the Supreme Court decided to instruct the Shandong High Court to form another collegiate bench to retry the case.
Zhang Zhichao used to be the monitor of Class 24, Grade One, Linshu No.2 Middle School. He was accused of raping and killing a schoolgirl in the bathroom of the teaching building when 16 years old.
The Intermediate People's Court of Linyi City, Shandong Province found through trial that at 6: 20 on June 65438+ 10/0, 2005, that is, one month before the body was found, Zhang Zhichao met the murdered girl in the bathroom of the teaching building of Linshu No.2 Middle School, and when she saw no one around, she began to commit adultery. In March 2006, Linyi Intermediate People's Court made a first-instance judgment, found Zhang Zhichao guilty of rape and sentenced him to life imprisonment.
After the verdict of the first instance, Zhang Zhichao and his mother insisted on appealing.
Today, Li Xun, Zhang Zhichao's attorney and lawyer of Beijing Dayu Law Firm, confirmed that the Supreme Court has ordered a retrial of Zhang Zhichao's case.
