According to the preliminary investigation, the murderer Hu refused to accept the court's judgment because of his debt dispute, petitioned for a long time, and was twice administratively detained by the local public security organs. At present, Judge Zhou Long is out of danger.
This is the latest case of frequent retaliation against judges in recent years. Both the Rights and Interests Protection Committee of China Judges Association and the Rights and Interests Protection Committee of Jiangsu Judges issued statements condemning the violence and calling for the protection of the dignity and safety of judges.
And this appeal is not superfluous: while the pain of Fu, a retired judge in Guangxi, has not subsided, this vicious incident has sprinkled a handful of salt on the wound. The brutality of the perpetrator's means and the madness of his mentality are tantamount to directly trampling on the bottom line of the rule of law. To comfort justice, we must severely punish according to law.
In reality, many grass-roots judges are often in the front line of social conflicts, and the professional risks and personal dangers they face are much higher than those of ordinary public officials. The friction and collision between the old and new concepts of order and the struggle and game of different interests often have to flock to the court and rely on a paper judgment of the court to solve disputes.
There is a common sense that almost every referee has an unsupported party, and many lawsuits are also risky. Even if the judge can do a good job in entity, procedure and subsequent legal interpretation, it may not be able to achieve the ideal state of letting both the original and the defendant win and lose.
It may only be the judge who suffers violence every time, but it is by no means a person's misfortune. Judges should also consider possible personal risks when exercising their functions and powers. If judges and executors can't get rid of the threat of violence, then personal safety will replace fairness and justice as the primary pursuit of judges' performance. As the last line of defense for justice, justice is also in danger of being captured by the law that "violence is justice".
In recent years, the protection given to judges at the national level in terms of systems and regulations has also been strengthened. Both the Provisions on Protecting Judicial Personnel from Performing Their Statutory Duties in accordance with the Law promulgated in July, 2065438+2006 and the Implementation Measures for People's Courts to Implement the Provisions on Protecting Judicial Personnel from Performing Their Statutory Duties in accordance with the Law promulgated by the Supreme Law emphasize the protection of judicial personnel's rights to perform their duties in accordance with the law.
However, these documents still focus on the safety protection of working hours and working areas, and the time when judges are most at risk is after work. Recently, many judges were attacked after work or on their way to and from work. Because the danger is latent and uncertain most of the time, it is difficult to send someone to protect the judge around the clock.
However, it is necessary to prevent delay, severely punish insults, slanders, threats, stalking and harassing judges, and punish them together; We should also try our best to introduce unresolved disputes into the road of rule of law and realize more independent trials according to law, instead of making judges the terminal bearers of risks.
Protecting the personal safety of judges is related to judicial authority and the dignity of the rule of law. As the defender of the rule of law and justice, judges should not be the main undertakers of litigation risks. To ensure their safety on duty, there should be more practical measures.
