Regulations on the protection of basic farmland

Fifteenth basic farmland protection areas are demarcated according to law, and no unit or individual may change or occupy them. Energy, transportation, water conservancy, military facilities and other national key construction projects can not avoid the basic farmland protection areas, and need to occupy basic farmland. Involving the conversion of agricultural land or land expropriation, it must be approved.

Sixteenth approved occupation of basic farmland, the local people's government shall, according to the approval documents, modify the overall land use planning, supplement the same amount and quality of basic farmland. The occupying unit shall, in accordance with the principle of how much it occupies and how much it reclaims, be responsible for reclaiming the cultivated land equivalent to the quantity and quality of the basic farmland it occupies; If there are no conditions for reclamation or the cultivated land does not meet the requirements, the cultivated land reclamation fee shall be paid in accordance with the provisions of provinces, autonomous regions and municipalities directly under the Central Government, which shall be used exclusively for reclamation of new cultivated land. Units occupying basic farmland shall, in accordance with the requirements of local people's governments at or above the county level, use the topsoil of basic farmland for soil improvement of newly reclaimed cultivated land, inferior land or other cultivated land.

Article 17 It is forbidden for any unit or individual to build kilns, build houses, build graves, dig sand, quarry, mine, borrow soil, pile up solid wastes or engage in other activities that damage basic farmland in the protected areas of basic farmland. It is forbidden for any unit or individual to occupy basic farmland to develop forestry and fruit industry and dig ponds to raise fish.

Eighteenth prohibit any unit or individual idle, barren basic farmland. Approved key construction projects occupy basic farmland, which can be cultivated and harvested after idle 1 year, and can be recovered by the collective or individual who originally cultivated basic farmland, or cultivated by the land-using unit; If the construction has not started for more than 1 year, the idle fee shall be paid in accordance with the provisions of provinces, autonomous regions and municipalities directly under the central government; If it has not been used for 2 consecutive years, the people's government at or above the county level shall recover the land use right of the land-using unit without compensation upon approval; If this land was originally owned by farmers' collectives, it should be handed over to the former rural collective economic organizations to resume farming and be re-classified into basic farmland protection areas.

If a unit or individual contracted to operate basic farmland abandoned cultivated land for two consecutive years, the original contractor shall terminate the contract and recover the contracted basic farmland.
