The People's Procuratorate of Chaoyang District of Beijing charged the defendant with the crime of intentional injury with indictmentNo. (2006) 1985, and filed a public prosecution with our hospital on August 9, 2006. As the defendant Wan voluntarily pleaded guilty, at the suggestion of the People's Procuratorate of Chaoyang District, Beijing, and with the consent of the defendant Wan, our court formed a collegial panel according to law to simplify the application of ordinary criminal procedures and heard the case in public. The prosecutor of Beijing Chaoyang District People's Procuratorate appeared in court to support the public prosecution, and the defendant Wan attended the lawsuit. The trial has now ended.

It was found through trial that the defendant Wan had an altercation with Li (male, 20 years old, from Jiangxi Province) in Shijiafen Village, Donghu, Chaoyang District, this city at 9 o'clock on May 2, 2005. In the fight, the defendant slashed the victim Li with a knife, causing Li to have "traumatic shock and multiple skin injuries on his head, neck and face". Defendant Wan fled the scene and was arrested by the police at Beijing West Railway Station on March 23, 2006. The relatives of the defendant Wan have negotiated with the victim Li to solve the civil compensation problem in this case.

The defendant Wan raised no objection during the trial, which was confirmed by the statement of the victim Li, the testimony of witnesses, Hu Guihua and Ha Guangtao, the hospital diagnosis certificate, the criminal science and technology appraisal book and documentary evidence.

The court believes that the defendant has a weak concept of the legal system, and he can't handle things calmly, cutting others with a knife, causing serious injuries to the victim. His behavior has violated the personal rights of citizens, which constitutes the crime of intentional injury and should be punished according to law. Beijing Chaoyang District People's Procuratorate accused the defendant Wan of intentional injury with clear facts and sufficient evidence, and was convicted. The defendant Wan was under the age of 18 when he committed the crime, and his punishment should be mitigated according to law. In view of the defendant's voluntary confession in court, his relatives have reached an agreement with the victim on civil compensation and given a lighter punishment as appropriate. To sum up, in accordance with the provisions of the second paragraph of Article 234, the first paragraph and the third paragraph of Article 17 and Article 61 of the Criminal Law of People's Republic of China (PRC), our court makes the following judgment:

The defendant committed the crime of intentional injury and was sentenced to one year and six months in prison (the sentence is counted from the date of execution of the judgment. In case of detention before the execution of the judgment, one day of detention shall be reduced to one day of fixed-term imprisonment, that is, from March 23, 2006 to September 22, 2007).

If you refuse to accept this judgment, you can appeal to Beijing No.2 Intermediate People's Court through our court or directly within ten days from the second day of receiving the judgment. If you appeal in writing, you should submit one original and two copies.
