Article 280 Whoever forges, alters or buys or sells identity cards, passports, social security cards, driver's licenses and other certificates that can prove his identity according to law shall be sentenced to fixed-term imprisonment of not more than three years, criminal detention, public surveillance or deprivation of political rights, and shall also be fined; If the circumstances are serious, he shall be sentenced to fixed-term imprisonment of not less than three years but not more than seven years and shall also be fined. Whoever uses forged, altered or embezzled other people's identity cards, passports, social security cards, driver's licenses and other documents that can prove his identity according to law in activities that should provide identification according to state regulations, if the circumstances are serious, shall be sentenced to criminal detention or control and shall also or only be fined. Whoever commits the acts mentioned in the preceding paragraph and constitutes other crimes shall be convicted and punished in accordance with the provisions of heavier punishment.
Article 397 Any functionary of a state organ who abuses his power or neglects his duty, thus causing heavy losses to public property and the interests of the state and the people, shall be sentenced to fixed-term imprisonment of not more than three years or criminal detention; If the circumstances are especially serious, they shall be sentenced to fixed-term imprisonment of not less than three years but not more than seven years. Where there are other provisions in this Law, such provisions shall prevail.
Article 418 State functionaries who practise fraud in recruiting civil servants and students, if the circumstances are serious, shall be sentenced to fixed-term imprisonment of not more than three years or criminal detention.
