Sixty-third provincial education administrative departments should listen to the opinions of students and schools when dealing with students' complaints because they refuse to accept the school's decision on handling or punishment, and can conduct necessary investigations as needed. According to the conclusion of the review, the following treatments are made according to different situations:
(a) if the facts are clear, the basis is clear, the nature is accurate, the procedure is appropriate and the punishment is appropriate, it shall be maintained;
(two) that the facts do not exist, or that the decision made by the school beyond its authority violates the provisions of the superior law, and shall be ordered to cancel the school;
(three) if the facts are clearly ascertained, but the circumstances are wrong, the nature is inaccurate or the application basis is wrong, the school shall be ordered to change or make a new decision;
(four) the facts are unclear, the evidence is insufficient, or in violation of these regulations and the procedures and authority stipulated by the school, the school shall be ordered to make a new decision.
Sixty-fourth from the date of the decision of handling, punishment or review, if the student fails to file a complaint within the appeal period, it will be deemed as giving up the complaint, and the school or the provincial education administrative department will no longer accept the complaint.
If the decision on handling, punishment or review fails to inform the student of the appeal period, the appeal period shall be counted from the date when the student knows or should know the decision on handling and punishment, but the longest period shall not exceed 6 months.
Sixty-fifth students think that the school and its staff violate these regulations and infringe on their legitimate rights and interests; Or the rules and regulations formulated by the school are in conflict with laws and regulations and these Provisions, you can complain to the provincial education administrative department where the school is located.
In the process of supervising or handling complaints, the competent education department finds that the school and its staff have violated laws, regulations and these Provisions or failed to fulfill their corresponding obligations in accordance with these Provisions.
Or the relevant management systems and regulations formulated by the school itself infringe on the legitimate rights and interests of students, and shall be ordered to make corrections; If violations of laws and regulations are found, they shall be investigated, handled or transferred to relevant departments in a timely manner, and the relevant responsible persons shall be held accountable according to relevant laws and regulations.
