National policy on online schools
Legal analysis: In order to promote the healthy and orderly development of educational information service and modern distance education on the Internet and standardize the behavior of engaging in modern distance education and providing educational information service through the Internet, modern distance education and educational information service are an important part of socialist education in China, and the development of modern distance education and educational information service must follow the national education policy.

Legal basis: Article 8 of the Interim Measures for the Administration of Educational Websites and Online Schools. Anyone who applies for the establishment of educational websites and online schools within the territory of People's Republic of China (PRC) must apply to the administrative department of education, and it can only be established after examination and approval. Established education websites and online schools, without the approval of the administrative department of education, should handle the application and examination and approval procedures in time. Without the approval of the administrative department of education, educational websites and online schools shall not be opened without authorization.

Article 9 To start various educational websites, the following basic conditions must be met: (1) Effective proof of necessary funds and sources of funds. (2) It meets other conditions stipulated by national laws, regulations and national education administrative departments.

Article 14 If the subject, name and location of the sponsor of an approved education website or online school need to be changed, an application shall be submitted to the original education administrative department responsible for approval within 20 working days before the change, and the education administrative department shall examine the qualifications of the new organizer, and only after passing the examination can the approval procedures for the change be handled.

Fifteenth approved education websites and online schools should indicate the information approved by the administrative department of education on their homepages, including the approval date and document number.

Article 16 Where an approved educational website applies for listing at home and abroad in the form of an enterprise, it shall obtain the consent of the Ministry of Education in advance.

Seventeenth approved educational websites and online schools shall be announced to the public regularly by the leading group of informatization work of the Ministry of Education.

Article 18 Education websites and online schools shall abide by the relevant laws and regulations of the state, and shall not produce, publish or disseminate the following information on the Internet: (1) divulging state secrets and endangering state security; (2) Violating the national ethnic, religious and educational policies; (3) propagating feudal superstitions, cults, obscene products, violating social morality, gambling, instigating crimes, etc. ; (4) inciting violence; (5) spreading rumors, disturbing social order and encouraging the masses to make trouble; (6) Exposing personal privacy, attacking others and harming their legitimate rights and interests; (seven) damage to the public interest; (8) Computer viruses; (nine) other harmful information prohibited by laws and regulations. If the above harmful information is found, it shall be reported to the relevant competent department in time, and effective measures shall be taken to stop its spread.
