The educational facilities mentioned in these Regulations refer to the venues, buildings, structures and ancillary facilities of kindergartens, primary schools, junior high schools, ordinary high schools, secondary vocational schools, special education schools, comprehensive practice bases for primary and secondary school students and extracurricular activity centers for young students. Article 3 The planning, construction and management of educational facilities shall follow the principles of government leading, unified planning, priority arrangement, rational layout and supporting construction. Article 4 The people's governments at the city and county levels shall incorporate the planning and construction of educational facilities into the national economic and social development plan, make overall arrangements for the capital construction land and construction funds of educational facilities, and coordinate and solve major problems in planning and construction management. Article 5 The people's governments at the city and county levels shall be responsible for organizing the implementation of these Regulations.
City and county education, development and reform, planning, land, construction, finance, housing management, urban management and other relevant administrative departments shall, in accordance with their respective responsibilities, do a good job in the planning and construction management of educational facilities. Chapter II Planning and Management of Educational Facilities Article 6 The planning of educational facilities in this Municipality includes the special planning of urban educational facilities and the special planning of county educational facilities. Seventh educational facilities planning should be based on the national economic and social development planning, urban and rural planning and land use planning. According to the administrative division, population living distribution, existing educational resources, service radius of primary and secondary schools and kindergartens and related standards, the layout of educational facilities, land use scope and land area are determined. Eighth city and county (city) education administrative departments shall, jointly with the planning administrative departments at the same level, organize the preparation of special plans for educational facilities in cities and counties. Article 9 Before the plan of educational facilities is submitted for examination and approval, the administrative department of education shall publish the draft plan and solicit the opinions of experts and the public through argumentation meetings, hearings or other means. Tenth education facilities planning shall be reported to the municipal and county (city) people's government for approval before promulgation and implementation, and shall not be changed without legal procedures.
Approved urban and county (city) urban educational facilities planning should be incorporated into the local urban regulatory detailed planning as a mandatory content for management. The planning of rural educational facilities should be incorporated into the township (town) planning or village planning. Article 11 The municipal and county (city) education administrative departments shall, jointly with the planning administrative departments at the same level, regularly evaluate the implementation of educational facilities planning, and timely revise the educational facilities planning that is defective or does not meet the development needs according to the urban and rural planning, the needs of educational reform and development, and the implementation evaluation of educational facilities planning. Twelfth planning administrative departments shall, according to the planning of educational facilities, reserve land for the construction of educational facilities, and verify its location and boundaries. Thirteenth reserved land for the construction of educational facilities shall not be changed without authorization. If it is really necessary to change due to major infrastructure construction, the planning administrative department shall plan the land for the construction of educational facilities in the same or similar areas with an area not less than the original area. And with the consent of the administrative department of education, reported to the people's government at the same level for approval. Fourteenth new primary and secondary schools and kindergartens in this Municipality shall meet the following requirements:
(1) The average senior high school should have no less than 1 0,000 students, a per capita area of not less than 25m2 and a total land area of not less than 100 mu.
(two) every thousand people according to the calculation of 39 junior high school students equipped with the corresponding size of junior high school. Every 23,000 to 38,000 students should have no less than 1 institute 18 to 30 classes of junior high schools, with an average construction area of no less than 18 square meters.
(three) according to the calculation of 78 pupils per thousand people, the construction of primary schools of corresponding size. Every 7,000 to 20,000 people should set up primary schools with no less than 1 institute 12 to 36 classes, with an average area of no less than 16 square meters.
(four) according to the calculation of thirty-nine preschool children per thousand people, there are kindergartens of corresponding size. Every 4600 to 9200 people should have at least one kindergarten with six to twelve classes, with an average construction area of not less than 14 square meter.
Boarding schools should increase the area of ten square meters for each boarder. The planned area of nine-year compulsory education schools is not less than the sum of the respective areas of corresponding primary schools and junior high schools. Schools that can't meet the requirements of the general layout due to the irregular shape of land should appropriately increase the construction area. Fifteenth existing urban primary and secondary schools, kindergartens, the per capita area of students does not meet the standards stipulated in Article 14 of these regulations, the people's governments at the city and county levels shall, in accordance with the planning of educational facilities, give priority to urban construction and transformation. Sixteenth county (city) people's government should reasonably determine the layout of rural junior high schools, primary schools (including teaching points) and kindergartens.
Every township (town) in rural areas should set up at least one junior high school, administrative villages with relatively concentrated population should set up at least one primary school or teaching point, and every township (town) government should set up at least one public kindergarten.
Mountainous counties should plan and build boarding junior middle schools in the county, and plan and build boarding primary schools in the seat of township (town) government or administrative villages with perfect infrastructure and convenient transportation, so as to solve the enrollment problem of school-age students in mountainous rural areas as a whole.
The construction of rural primary and secondary schools and kindergartens shall be implemented in accordance with relevant national standards and norms.
