In China's vertical educational laws and regulations system, educational administrative laws and regulations are formulated by the Education Department Law.

Educational administrative regulations refer to the normative documents formulated by the highest administrative organ of the state for the implementation and management of educational undertakings in accordance with the Constitution and educational laws. This form is common in all countries.

China's existing educational laws and regulations system consists of five vertical levels and six horizontal departments. China's education laws and regulations system has five vertical levels: education law, education department law, education administrative regulations, local education regulations and education regulations. At the horizontal level of China's educational laws and regulations system, there should be six departmental laws: compulsory education law, vocational education law, higher education law, teacher law, adult education law and private education promotion law.
